最近,Global Santosh轮案的最高法院判决NYK Bulkship (Atlantic) NV (Respondent) v Cargill International SA (Appellant) (“The Global Santosh”) [2016] UKSC 20 推翻了2014年上诉法院的判决 [2014] EWCA Civ 403。
早在2014年12月22日,最高法院法官(Neuberger JSC, Clarke JSC and Reed JSC)批准了Cargill International SA 就Global Santosh轮案的上诉请求。该案的上诉法院判决载于劳氏报告 [2014] 2 Lloyd’s Rep 104。当托运人或收货人在卸货港扣船,且该扣船行为与船东并无关联的情况下,法院判决“承租人的代理人”含义应作广义解释,这对定期租船市场产生很大影响。

Owners Beware – If the vessel is arrested by Charterer’s agent, the word agent will be narrowly construed and all the risk will be on Owners!
In a recent case of NYK Bulkship (Atlantic) NV (Respondent) v Cargill International SA (Appellant) (“The Global Santosh”) [2016] UKSC 20 where it overturned the decision of Court of Appeal [2014] EWCA Civ 403.
Earlier, on 22 December 2014 the Supreme Court (Lord Neuberger JSC, Lord Clarke JSC and Lord Reed JSC) granted Cargill International SA permission to appeal in The Global Santosh. The Court of Appeal’s decision that was reported at [2014] 2 Lloyd’s Rep 104 was notable for the potentially wide ranging ramifications in the time charter market of the extensive meaning the Court attributed to the phrase “charterers’ agents” in context of scenario when a shipper or consignee, with no relation to the shipowner arrests a vessel at the discharge port.
