Oil Pollution in Lake Maracaibo

Members are advised that there have been reports that oil has been found in the water of Lake Maracaibo, in particular close to the PDSVA Terminal. Apparently nearby those areas is a source of oil pollution, although not emanating from the terminal.

Members are advised to consult the Venepandi Circular 006, re-published here for quick reference.

There may be no opportunity to clean the vessel, if the hull becomes fouled, while in Lake Maracaibo.

It should be noted, however, that proceeding with a fouled hull in to another port could expose the vessel to fines and claims for polluting the local waters.

Should an incident occur while in this area, Members are advised to have the Master issue an appropriate protest note, along the following lines:

QUOTE

Dear Sirs,

I hereby issue the following Note of Protest.

Oil Spots and Stains have been observed [... description of locale ...], which were noted on [...time and date and location ...]. I have made appropriate record of these in the Deck Log Book.

As a consequence of this situation, the ship's Hull has been contaminated by oily water.

On behalf of the Vessel, her Crew, Owners, and myself I hereby Protest this situation.

In so far as loss, liability, expense, cost, delay, loss, damage, demurrage or other consequence be occasioned, we shall seek recourse against the appropriate Party or Parties who may be responsible for the same.

I reserve my right to extend and further elaborate on this Protest at a future time.

In the meantime all of the rights of the Vessel, her Crew, Owners , and myself are and remain fully reserved.

Yours faithfully"

The Master should also ensure that high resolution pictures are taken of any oil on the water or on the hull of the vessel. These pictures should be separately saved on the ship's computer as emailing can lower the resolution.
