Different insurers have different procedures when owners apply laid-up return. When a vessel is moored in an anchorage and its operating systems have been shut down, other than submitting relevant documentations, owners should beware of the laid-up return rules which marked in the certificate/policy/application form before applying laid-up return.
In a recent case, PICC rejected a laid-up return application because of late declaration. Although PICC only mentioned that laid-up periods of more than 30 days would be qualified for a return of premium, without mentioned the timeframe that the declaration should be submitted to the insurer, they rejected the laid-up return application by the following clause and explanation.

船东在申请停航退费时,不同保险人的操作程序各不相同。当船舶停泊在锚地,操作系统停止运作时,船东除了要提交申请停航退费的相关文件,还要注意入会证书/保单/申请表中有关停航退费的规则。
在最近的一个案例中,中国人民财产保险公司(PICC)因逾期告知而拒绝了船东停航退费申请。尽管PICC只提到停航时间超过30天有资格申请退还保费,没有提到向保险人告知的时间限制,但是PICC根据以下条款和解释,拒绝停航退费申请。
