A recent judgment has been handed down by the UK High Court concerning a dispute between cargo interests and the carrier over responsibility for cargo damage under a Synacomex 90 charter party.

Background
The vessel “Sea Mirror” (“the Vessel”) carried nearly half a million bags of rice from Karachi, Pakistan, to Abidjan, Ivory Coast, pursuant to two bills of lading. The bills of lading incorporated the terms of a booking note which in turn incorporated the terms of a voyage charter party on the Synacomex 90 Form. The Receivers brought claims in respect of alleged loss and damage arising from: Wet and mouldy bags;Bags allegedly being torn during loading and/or carriage and/or discharge; and Alleged short delivery.

“Sea Mirror”轮运载近50万袋的袋装大米,分两票货从巴基斯坦的卡拉奇运至科特迪瓦的阿比让。两份提单都并入了订舱单中的条款,而这个订舱单亦并入了Synacomex 90格式的航次租约条款。收货人提出索赔,声称损失和损害由以下原因造成: 受潮及发霉的米袋;在装载和/或运输和/或卸货过程中米袋破损;短货。
