自今年2月24日俄罗斯乌克兰战争爆发以来，以美国为首许多国家对俄罗斯进行不同程度的经济制裁，会员在进行与可能涉及制裁相关方主体进行国际贸易/订立租约，均有可能受到相关国家/主体的制裁，并可能触发互保协会制裁条款，导致丧失保险保障。由此，多家国际保赔协会P&I Club和保险服务商纷纷发出通函提醒会员（被保险人）在订立各种合同和/或租船合约之前，谨慎审查，认真履行会员（被保险人）尽职调查责任。从我司与会员客户的日常联系接收到有关如何进行尽职调查操作的疑问，结合国际保赔协会公开信息和我司的工作经验提供下面内容供参考：
在此，我们提醒各位会员，由于制裁政策的不断变化和调整，以及制裁涉及的各因素较为繁多，且由于被制裁个人或企业的内部股权结构，利益从属关系并非完全透明。因而，即便进行了尽职调查，仍不能完全排除可能触发制裁风险的因素的存在。请各位会员知悉。

Sanctions Risk – Member’s obligations of due diligence
Since the outbreak of the war between Russia and Ukraine on February 24th of this year, many countries led by the United States have imposed varying degrees of economic sanctions on Russia. Members might be sanctioned by relevant countries / entities, while entering into an international trade / Charter parties with parties that may be involved in sanctions, and may trigger the sanctions clause in terms of policy, resulting in the losing of the cover therefore. As a result, many international P&I clubs and insurance service providers have issued circulars to remind members (the insured) to carefully review and earnestly fulfill the due diligence responsibilities of members (the insured) before entering into various contracts and / or charter parties. We have received questions about how to conduct due diligence from our daily contact with members, along with the public information of the international P&I club and our work experience, offer the following for our member’s reference only:
Hereby, we remind members that, due to the continuous changes and adjustments of sanctions policies, and various factors involved in sanctions, and the internal ownership structure of sanctioned individuals or enterprises, the interest subordination is not completely transparent, please take note that even if due diligence is carried out, the existence of factors that may trigger the risk of sanctions cannot be completely ruled out.
