Norwegian insurer’s landmark ruling against the Japanese industrial port starts ball rolling for $ 140m payback from charterers.<\/p>\n

The Gard insurance group has won a landmark ruling that has labelled a leading Japanese port “unsafe” paving the way for recovery of nearly $140m from charterers.<\/p>\n

A London High Court judgment appears to have major implications for the industrial port of Kashima, which handles bulkers up to capsize making deliveries to a Nippon Steel & Sumitomo Metal Corp steelworks, as well as VLCCs serving a local oil refinery.<\/p>\n

The claim arises from the loss of the 171,000-dwt capsize Ocean Victory (built 2005), which grounded and broke up in 2006 while trying to flee the port during a severe gale.<\/p>\n
