It is noted that the trading area is stated as follows on some H&M policies provided by Chinese hull insurers: “Worldwide but subject to Institute Warranties 1.7.76 and Current Market War Risk Trading Warranties and Exclusions”.<\/p>\n

Normally the Chinese hull insurers will also provide the war risk (H&M) cover to the assured free of charge. They usually combine these two policies into one. Therefore the insurers state the above wordings in the trading area column on their hull policy.According to the above policy wordings, assureds are required to notify the hull insurers in advance if the vessel trades to the ice zone or war zone. Additional premium \/ terms may be required in order to maintain the H&M cover in these areas.<\/p>\n

Unfortunately, if the shipowners place the war risk insurance cover with other insurers such as Lloyd’s Market, and so they forget to inform the hull insurers that the vessel is trading to war zone, it will create a huge problem to the shipowners because the shipowners will lose their ordinary hull cover if the vessel trades to the war zone.<\/p>\n

Therefore, we would suggest shipowners to check with their hull insurers if they could amend the wordings in trading area column to “Worldwide but subject to Institute Warranties 1.7.76” in order to avoid this potential loss of hull cover. In any event whether the war risks is insured with PICC or in London market, for clarity and to avoid insurers taking advantage of a breach of war risk cover to avoid paying a claim under the marine cover, an additional wording in the policy should be included, the war risk cover is deemed a separate policy of insurance to the marine policy and a breach of policy conditions or warranties in the one policy does not prejudice or affect in any way the other policy.<\/p>\n

\u6211\u4eec\u6ce8\u610f\u5230\u56fd\u5185\u4fdd\u9669\u516c\u53f8\u5728\u8239\u58f3\u9669\u4fdd\u5355\u822a\u533a\u8fd9\u4e00\u9879\u4e0a\u4f1a\u4f7f\u7528\u4ee5\u4e0b\u7528\u8bcd\uff1a”\u5168\u7403\u8303\u56f4\u5185\uff0c\u4f46\u9047\u6709\u9a76\u5165\u51b0\u533a\u6216\u6218\u4e89\u533a\u57df\u822a\u884c\u65f6\u987b\u4e8b\u5148\u901a\u77e5\u672c\u516c\u53f8\u3002”<\/span><\/p>\n

\u4e00\u822c\u800c\u8a00\u56fd\u5185\u8239\u58f3\u9669\u7684\u4fdd\u9669\u516c\u53f8\u90fd\u4f1a\u8d60\u9001\u6218\u4e89\u9669\uff08\u8239\u58f3\uff09\u7684\u4fdd\u5355\uff0c\u5e76\u5c06\u8239\u58f3\u4ee5\u53ca\u6218\u4e89\u9669\uff08\u8239\u58f3\uff09\u7684\u4fdd\u5355\u5408\u5e76\u5728\u4e00\u4efd\u4fdd\u5355\u5185\u3002\u56e0\u6b64\uff0c\u4fdd\u9669\u516c\u53f8\u90fd\u4f1a\u5728\u8239\u58f3\u9669\u4fdd\u5355\u7684\u822a\u533a\u4e00\u680f\u5185\u4f7f\u7528\u4e0a\u8ff0\u7528\u8bcd\u3002 \u6309\u7167\u4ee5\u4e0a\u7528\u8bcd\uff0c\u88ab\u4fdd\u9669\u4eba\u9700\u8981\u5728\u8239\u8236\u9a76\u5165\u51b0\u533a\u6216\u6218\u533a\u4e4b\u524d\u901a\u77e5\u4fdd\u9669\u4eba\u3002\u4fdd\u9669\u4eba\u6216\u5f81\u6536\u989d\u5916\u4fdd\u8d39\u4ee5\u4f7f\u8239\u58f3\u9669\u4fdd\u5355\u5728\u4e0a\u8ff0\u5730\u533a\u4ecd\u7136\u6709\u6548\u3002<\/p>\n

\u4f46\u662f\uff0c\u5982\u679c\u8239\u4e1c\u4ece\u5176\u4ed6\u4fdd\u9669\u516c\u53f8\u5904\u8d2d\u4e70\u4e86\u6218\u4e89\u9669\u4fdd\u5355\uff0c\u4f8b\u5982\u52b3\u6c0f\u5e02\u573a\uff0c\u8239\u4e1c\u6709\u53ef\u80fd\u5fd8\u8bb0\u901a\u77e5\u5176\u8239\u58f3\u9669\u7684\u4fdd\u9669\u516c\u53f8\u8be5\u8239\u4f1a\u9a76\u5165\u6218\u533a\u3002\u5bf9\u4e8e\u8239\u4e1c\u800c\u8a00\uff0c\u8fd9\u4f1a\u4ea7\u751f\u5f88\u5927\u7684\u95ee\u9898\uff0c\u56e0\u4e3a\u8239\u8236\u4e00\u65e6\u9a76\u5165\u6218\u533a\uff0c\u8239\u8236\u5c06\u4f1a\u5931\u53bb\u5b83\u539f\u6709\u7684\u8239\u58f3\u9669\u4fdd\u969c\u3002<\/p>\n
