The legal and insurance consequences are serious if cargo is delivered against a forged bill of lading even if the shipowner is innocent and has exercised due diligence.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">In Motis v Dampskibseelskabet (1999), the shippers sued the shipowner on the basis the shipowner had misdelivered the cargo without production of an original bill of lading. The shipowners&#8217; defense was they had delivered the cargo against a forged bill of lading which they had no way of knowing were been forged. On this basis they said they had not intentionally misdelivered the cargo and were therefore not at fault. The court found the shipowners liable and the fact the shipowner was unaware the bill of lading was forged was no defence. There was nothing in the contract of carriage which gave the shipowner such a defence and it was neither reasonable nor necessary to imply such a term. Public policy dictated that although the shipowner was innocent of fraud, the shipowner had a strict liability to ensure that goods were delivered to the proper party. The shiponwer in this case was in a very unfortunate situation as their P&amp;I Club (an International Group P&amp;I Club) declined to support this claim despite the members had no knowledge of the forged bill of lading. Since the shiponwer had no idea the bill of lading was forged they did not even have a letter of indemnity which would have been required in the situation of delivery of cargo without production of an original bill of lading. The shipowner appealed to the Court Of Appeal and lost. It is clear that under English Law shipowners have no defence at all to such a claim even if they are also an innocent victim. It is also important to know that P&amp;I Clubs would decline liability for such claims based on a rule which exclude liability arising from delivery of cargo without production of an original bill of lading.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">We have researched into the P&amp;I Club rules and the law and in a similar situation, we believe there may still be arguments to put forward to the Club why the rule excluding liability for delivery of cargo without production of an original bill of lading should not apply and why the Club should still cover for such liability. outline: 0px; font-size: 12px; text-align: justify;\">\u57281999\u5e74Motis v Dampskibseelskabet\u4e00\u6848\u4e2d\uff0c\u53d1\u8d27\u4eba\u8d77\u8bc9\u8239\u4e1c\u672a\u6309\u6b63\u672c\u63d0\u5355\u5bfc\u81f4\u9519\u8bef\u653e\u8d27\u3002\u8239\u4e1c\u6297\u8fa9\u79f0\uff0c\u81ea\u5df1\u662f\u4f9d\u636e\u5047\u63d0\u5355\u653e\u8d27\uff0c\u4e14\u6ca1\u6709\u80fd\u529b\u533a\u5206\u63d0\u5355\u7684\u771f\u5047\u6027\u3002\u636e\u6b64\u8ba4\u4e3a\u8239\u4e1c\u5e76\u4e0d\u662f\u6545\u610f\u9519\u8bef\u653e\u8d27\uff0c\u56e0\u6b64\u6ca1\u6709\u8fc7\u9519\u3002\u6cd5\u9662\u8ba4\u4e3a\u8239\u4e1c\u5e94\u5bf9\u9519\u8bef\u653e\u8d27\u627f\u62c5\u8d23\u4efb\uff0c\u8239\u4e1c\u4e0d\u6e05\u695a\u63d0\u5355\u662f\u4f2a\u9020\u7684\u8fd9\u4e00\u4e8b\u5b9e\u4e0d\u80fd\u6210\u4e3a\u6297\u8fa9\u4f9d\u636e\u3002\u8fd0\u8f93\u5408\u540c\u6ca1\u6709\u660e\u793a\u8d4b\u4e88\u8239\u4e1c\u7c7b\u4f3c\u7684\u6297\u8fa9\u4f9d\u636e\uff0c\u6cd5\u9662\u4e5f\u6ca1\u6709\u7406\u7531\u548c\u5fc5\u8981\u63a8\u5b9a\u7c7b\u4f3c\u6297\u8fa9\u4f9d\u636e\u7684\u5b58\u5728\u3002\u516c\u5171\u653f\u7b56\u89c4\u5b9a\u5373\u4f7f\u8239\u4e1c\uff08\u65e0\u8f9c\uff09\u53d7\u5230\u6b3a\u8bc8\uff0c\u4ecd\u7136\u8d1f\u6709\u4e25\u683c\u8d23\u4efb\u786e\u4fdd\u5c06\u8d27\u7269\u4ea4\u7ed9\u6b63\u786e\u7684\u6536\u8d27\u4eba\u3002\u672c\u6848\u7684\u8239\u4e1c\u7531\u6b64\u9677\u5165\u60b2\u60e8\u7684\u5883\u5730\uff0c\u5c3d\u7ba1\u8239\u4e1c\u672c\u8eab\u5e76\u4e0d\u77e5\u9053\u63d0\u5355\u662f\u88ab\u4f2a\u9020\u7684\uff0c\u4f46\u662f\u4ed6\u7684\u4fdd\u8d54\u534f\u4f1a\uff08\u56fd\u9645\u4fdd\u8d54\u534f\u4f1a\u96c6\u56e2\u6210\u5458\uff09\u62d2\u7edd\u5bf9\u672c\u6848\u8fdb\u884c\u8d54\u507f\u3002\u66f4\u4e0d\u5e78\u7684\u662f\uff0c\u7531\u4e8e\u8239\u4e1c\u5e76\u4e0d\u77e5\u9053\u63d0\u5355\u662f\u4f2a\u9020\u7684\uff0c\u6240\u4ee5\u4e5f\u6ca1\u6709\u50cf\u901a\u5e38\u65e0\u6b63\u672c\u63d0\u5355\u653e\u8d27\u60c5\u51b5\u4e0b\u90a3\u6837\u53d6\u5f97\u8d54\u507f\u4fdd\u8bc1\u4e66\u3002\u8239\u4e1c\u5411\u4e0a\u8bc9\u6cd5\u9662\u63d0\u8d77\u4e0a\u8bc9\uff0c\u4f46\u6ca1\u6709\u6210\u529f\u3002\u5728\u82f1\u56fd\u6cd5\u4e0b\uff0c\u8239\u4e1c\u5bf9\u8be5\u7c7b\u7d22\u8d54\u6ca1\u6709\u4efb\u4f55\u6297\u8fa9\u4f9d\u636e\uff0c\u5373\u4f7f\u4ed6\u4eec\u4e5f\u662f\u65e0\u8f9c\u53d7\u5bb3\u65b9\u3002\u53e6\u5916\uff0c\u4fdd\u8d54\u534f\u4f1a\u4e5f\u4f1a\u62d2\u7edd\u627f\u62c5\u8be5\u7c7b\u7d22\u8d54\u7684\u76f8\u5e94\u8d23\u4efb\uff0c\u56e0\u4e3a\u534f\u4f1a\u89c4\u5219\u660e\u786e\u89c4\u5b9a\uff0c\u534f\u4f1a\u5bf9\u7531\u4e8e\u672a\u6309\u6b63\u672c\u63d0\u5355\u653e\u8d27\u6240\u5f15\u8d77\u7684\u8d23\u4efb\u514d\u8d23\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u6211\u4eec\u6b63\u5728\u7814\u7a76\u534f\u4f1a\u89c4\u5219\u548c\u76f8\u5e94\u6cd5\u5f8b\u89c4\u5b9a\uff0c\u76f8\u4fe1\u53ef\u4ee5\u627e\u5230\u4e00\u4e9b\u8bba\u70b9\u548c\u4f9d\u636e\uff0c\u8bc1\u660e\u534f\u4f1a\u5e94\u5bf9\u6b64\u7c7b\u7d22\u8d54\u8d1f\u8d23\uff0c\u800c\u4e0d\u9002\u7528\u672a\u6309\u6b63\u672c\u63d0\u5355\u653e\u8d27\u514d\u8d23\u6761\u6b3e\u7684\u89c4\u5b9a\u3002\u5bf9\u6b64\uff0c\u6211\u4eec\u4f1a\u5728\u4e0b\u4e00\u671f\u7684ALCO\u516c\u53f8\u901a\u51fd\u4e2d\u8fdb\u884c\u8be6\u7ec6\u8ba8\u8bba\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u5982\u679c\u6709\u4efb\u4f55\u6709\u5173\u5047\u63d0\u5355\u4e0b\u8239\u4e1c\u9519\u8bef\u653e\u8d27\u7684\u8d23\u4efb\u7684\u95ee\u9898\uff0c\u8bf7\u8ddf\u6211\u4eec\u8054\u7cfb\u3002<\/p>\n<p style=\"border: 0px;
