The provision of letters of indemnity (LOI) by charterers and receivers to carriers is a long-established practice in the shipping industry. It is, in effect, a promise to make good any loss suffered by carriers when following instructions which might breach their contracts of carriage, but it also risks undermining carriers’ P&I cover.<\/p>\n

IG Members are increasingly being asked to accept LOIs for non-production of bills of lading at discharge ports. This is perhaps due to greater efficiency in the shipping industry, with vessels frequently arriving before the cargo’s paperwork, particularly if the cargo is traded during the voyage.<\/p>\n

\u63a5\u53d7\u4fdd\u51fd\uff0c\u503c\u5f97\u5192\u9669\u5417\uff1f<\/strong><\/span><\/p>\n

\u79df\u5bb6\u6216\u6536\u8d27\u4eba\u5411\u627f\u8fd0\u4eba\u63d0\u4f9b\u4fdd\u51fd\u662f\u822a\u8fd0\u4e1a\u957f\u4e45\u4ee5\u6765\u7684\u4e00\u79cd\u4e60\u60ef\u505a\u6cd5\u3002\u5b9e\u9645\u4e0a\uff0c\u4fdd\u51fd\u662f\u4e00\u79cd\u627f\u8bfa\uff0c\u5f53\u627f\u8fd0\u4eba\u9075\u5faa\u4e86\u8fdd\u53cd\u8fd0\u8f93\u5408\u540c\u7684\u6307\u793a\uff0c\u627f\u8fd0\u4eba\u7531\u6b64\u906d\u53d7\u7684\u635f\u5931\u5c06\u5f97\u5230\u8865\u507f\uff0c\u4f46\u662f\u8fd9\u6837\u505a\u5b58\u5728\u4f7f\u627f\u8fd0\u4eba\u4fdd\u8d54\u9669\u53d7\u5230\u5f71\u54cd\u7684\u98ce\u9669\u3002<\/p>\n

\u8d8a\u6765\u8d8a\u591a\u56fd\u9645\u4fdd\u8d54\u534f\u4f1a\u7684\u4f1a\u5458\u88ab\u8981\u6c42\u5728\u5378\u8d27\u6e2f\u63a5\u53d7\u65e0\u5355\u653e\u8d27\u4fdd\u51fd\u3002\u8fd9\u662f\u7531\u4e8e\u822a\u8fd0\u4e1a\u53d8\u5f97\u8d8a\u6765\u8d8a\u9ad8\u6548\uff0c\u8239\u8236\u603b\u662f\u5728\u8d27\u7269\u5355\u8bc1\u4e4b\u524d\u5230\u8fbe\u5378\u6e2f\uff0c\u7279\u522b\u662f\u8d38\u6613\u5728\u8239\u8236\u5b8c\u8d27\u5f00\u822a\u540e\u624d\u843d\u5b9e\u7684\u60c5\u51b5\u4e0b\u3002<\/p>\n
