Some clubs may describe the voyage of &#8220;high risk&#8221; or &#8220;low risk&#8221; based on the information provided; many clubs would recommend lawyers and experts to investigate and may not even able to confirm the cover issue until full details and positive legal advice from the lawyers and experts. Unless the advice of the lawyers and experts are unequivocal, clubs would not be able to confirm the cover issue.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\">2. &nbsp;Why would sanctions apply to a vessel whose ownership, management has no connection with EU or the US?<\/strong><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">The relevant sanctions might not directly apply to the ship owners having no connection with EU or US but the sanctions do apply to their P&amp;I insurers\/clubs located in EU or US, who are subject to relevant sanctions. It is the owners&#8217; burden under the insurance to exercise due diligence to prove the cargo and the voyage are lawful. Owners would usually be guided by their P&amp;I clubs what they need do to show they have exercised due diligence. As advised, even if the owners have fully followed the Club&#8217;s recommendations to show they have exercised due diligence, the clubs may still not be able to confirm the cover issue unless the lawyer and experts&#8217; replies and opinions are unequivocal.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\">3. &nbsp;What kind of documents or information should the owners provide to the club and the experts?<\/strong><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">It may differ from case to case subject to the club&#8217;s opinion, but we hereby advise as follows per our practice:<\/p>\n<ul style=\"border: 0px; outline: 0px; list-style: none; text-align: justify;\">\n<li style=\"padding-top: 0px; padding-right: 0px; padding-bottom: 0px; border: 0px; outline: 0px;\">Identity of the charterers, cargo interests (shippers, consignees, buyers, sellers, manufacturers and end users in Iran), other possibly related parties though rarely checked in our practice (Iranian port operators, Iranian port agents) etc.<\/li>\n<\/ul>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">It is recommended to have lawyers instructed to check out whether these entities are in the updated US and\/or EU list of sanctioned companies\/people. Payment made to the sanctioned entities will be a breach of sanctions.<\/p>\n<ul style=\"border: 0px; outline: 0px; list-style: none; text-align: justify;\">\n<li style=\"padding-top: 0px; padding-right: 0px; padding-bottom: 0px; border: 0px; outline: 0px;\">Precise nature and ultimate use of the cargoes<\/li>\n<\/ul>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">The expert surveyors appointed by the clubs could probably determine what the cargo actually is and intended use; lawyers could then check out whether the cargo is a sanctioned cargo or not according to US and EU sanctions.<\/p>\n<ul style=\"border: 0px; outline: 0px; list-style: none; text-align: justify;\">\n<li style=\"padding-top: 0px; padding-right: 0px; padding-bottom: 0px; border: 0px; outline: 0px;\">If the cargoes are probably prohibited by the sanctions, further investigations would need to be made whether the carriage of the cargo might be lawful if there are valid certificates or licenses are issued by governmental authorities stating the cargo are not in breach of sanctions and\/or the transaction contracts of the cargoes falls within the exemption of Article 10 of EU sanctions (when US sanctions do not apply).<\/li>\n<\/ul>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">1. &nbsp;Local correspondents of the clubs may help investigate the validity of issued licenses or certificates, even though an opinion from the club&#8217;s local correspondent would not change what is an unlawful cargo to a lawful cargo and the licenses\/certificates are not proof that the cargo is lawful. Owner should also ensure the certificates or licenses are consistent with cargoes carried on board as per the bills of lading. We recommend the owners to let the club have a copy of the license or certificate before the carriage for their comments.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">2. &nbsp;Exemption under EU sanctions: If the cargoes falls within Annex VI, which is necessarily to be advised by the surveyors and lawyers, and (1) this is a pre-October 27th 2010 trade contract concerned with equipments for crude oil and gas, production of crude oil and natural gas, refining, liquefaction of natural gas; or (2) pre-March 24th 2012 trade contract concerned with equipments for petrochemical industry, the exemption of Article 10 could then be applied to the concerned carriage which might be regarded as ancillary contracts necessary for execution of such contracts, provided that notification has been made at least 20 working days in advance to the competent authority of the Member State.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">However legal experts are uncertain on the interpretation of Article 10 to fit as to the meaning of advance notification and the member state referred to in Article 10, is not clearly specified. Legal experts may also require provision of relevant trade contracts for investigation.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">If the voyage or the P&amp;I clubs\/insurers have connections with US, then US sanctions would be applied. In this case, there seem no such exemptions for carriage of equipments cargoes for dated trade contract mentioned above to be lawful under the US sanctions.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">To conclude, owners need to provide following documents of involved cargoes to investigate whether the cargoes are sanctioned or not:&nbsp;<br \/>Bills of lading;&nbsp;<br \/>Certificate or licenses issued by the exporting Governmental body;&nbsp;<br \/>Sales contracts;&nbsp;<br \/>Commercial invoices.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\">4. &nbsp; What else should the owners do to protect themselves?<\/strong><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">Letter of Indemnity (LOI) should also be obtained from the charterers or the cargo side, indemnifying the owners against all of the risks and consequences of permitting the vessel to call at Iranian ports. The financial status of the LOI issuer must be verified as this amounts to a counterparty risk. We recommend the owner to seek specific legal advice on the wording of the LOI from lawyers.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\">5. &nbsp;Problems usually encountered:<\/strong><\/p>\n<ul style=\"border: 0px; outline: 0px; list-style: none; text-align: justify;\">\n<li style=\"padding-top: 0px; padding-right: 0px; padding-bottom: 0px; border: 0px; outline: 0px;\">Charterers do not provide all the information and documents summarized in Point 3.<\/li>\n<li style=\"padding-top: 0px; padding-right: 0px; padding-bottom: 0px; border: 0px; outline: 0px;\">Documents may not tally with each other such as the details of cargoes in the certificates or licenses issued by the exporting Governmental body may not be exactly the same as the details of cargo in the commercial invoices or trade contracts.<\/li>\n<li style=\"padding-top: 0px; padding-right: 0px; padding-bottom: 0px; border: 0px; outline: 0px;\">Explanations together with supporting documentation why a trade contract concluded pre 27th October 2010 or pre 24th March 2012 have not been timely performed within a reasonable time after conclusion of the contract.<\/li>\n<li style=\"padding-top: 0px; padding-right: 0px; padding-bottom: 0px; border: 0px; outline: 0px;\">The nature of cargoes such as technically advanced project cargoes make it impossible for even an expert surveyor to determine whether the cargoes could be used for a sanctioned purpose.<\/li>\n<\/ul>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">Please be kindly reminded that the above contents shall not be considered as all conclusive. outline: 0px; font-size: 12px; text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\">1. &nbsp;\u4fdd\u8d54\u534f\u4f1a\u662f\u5426\u4f1a\u5bf9\u6d89\u53ca\u4f0a\u6717\u7684\u8fd0\u8f93\u4f5c\u51fa\u627f\u4fdd\u7684\u786e\u8ba4\u58f0\u660e\uff1f<\/strong><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u7531\u4e8e\u5165\u4f1a\u89c4\u5219\u4e2d\uff0c\u660e\u786e\u5217\u660e\u5bf9\u4e8e\u4f0a\u6717\u5236\u88c1\u7684\u98ce\u9669\u662f\u5c5e\u4e8e\u9664\u5916\u8d23\u4efb\uff0c\u4fdd\u8d54\u534f\u4f1a\u4e5f\u56e0\u6b64\u5f80\u5f80\u4e0d\u4f1a\u5bf9\u6d89\u4f0a\u6717\u822a\u6b21\u662f\u5426\u627f\u4fdd\u4f5c\u51fa\u80af\u5b9a\u7684\u7b54\u590d\u3002\u4e00\u4e9b\u534f\u4f1a\u53ef\u80fd\u4f1a\u6839\u636e\u4f1a\u5458\u63d0\u4f9b\u7684\u4fe1\u606f\u4ee5&#8221;\u4f4e\u98ce\u9669&#8221; \u6216&#8221;\u9ad8\u98ce\u9669&#8221; \u6765\u63cf\u8ff0\u6d89\u53ca\u4f0a\u6717\u7684\u822a\u6b21\uff1b\u800c\u5f88\u591a\u534f\u4f1a\u5219\u53ef\u80fd\u63a8\u8350\u5f8b\u5e08\u548c\u4e13\u5bb6\u6765\u8fdb\u884c\u8c03\u67e5\uff0c\u5728\u672a\u6709\u8d27\u7269\u7684\u8be6\u7ec6\u5168\u9762\u4fe1\u606f\u3001\u4ee5\u53ca\u6765\u81ea\u5f8b\u5e08\u548c\u4e13\u5bb6\u7684\u79ef\u6781\u6cd5\u5f8b\u610f\u89c1\u4e4b\u524d\u90fd\u4e0d\u80fd\u591f\u4f5c\u51fa\u627f\u4fdd\u7684\u786e\u8ba4\u3002\u9664\u975e\u5f8b\u5e08\u548c\u4e13\u5bb6\u7684\u610f\u89c1\u662f\u660e\u786e\u4e14\u79ef\u6781\u7684\uff0c\u534f\u4f1a\u5c06\u4e0d\u80fd\u591f\u4f5c\u51fa\u6b64\u79cd\u627f\u4fdd\u786e\u8ba4\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\">2. &nbsp;\u4e3a\u4ec0\u4e48\u4f0a\u6717\u5236\u88c1\u6cd5\u5f8b\u4f1a\u5f71\u54cd\u90a3\u4e9b\u6240\u6709\u4eba\u548c\u7ba1\u7406\u4eba\u90fd\u4e0e\u6b27\u76df\u6216\u7f8e\u56fd\u65e0\u5173\u7684\u8239\u8236\uff1f<\/strong><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u5bf9\u4e8e\u548c\u6b27\u76df\u6216\u8005\u7f8e\u56fd\u6beb\u65e0\u8054\u7cfb\u76f8\u5173\u7684\u8239\u4e1c\u4e00\u65b9\uff0c\u4f0a\u6717\u5236\u88c1\u6cd5\u5f8b\u53ef\u80fd\u4e0d\u4f1a\u76f4\u63a5\u9002\u7528\u4e8e\u8239\u65b9\u3002\u4f46\u4fdd\u8d54\u534f\u4f1a\u82e5\u662f\u5728\u76f8\u5173\u5236\u88c1\u6cd5\u5f8b\u7684\u9002\u7528\u8303\u56f4\u4e4b\u5185\u7684\u8bdd\uff0c\u90a3\u4e48\u4f0a\u6717\u5236\u88c1\u6cd5\u5f8b\u5c06\u4f1a\u9002\u7528\u4e8e\u8239\u65b9\u7684\u4fdd\u8d54\u534f\u4f1a\u3002\u56e0\u6b64\u5728\u4fdd\u8d54\u4fdd\u9669\u4e4b\u4e0b\uff0c\u8239\u4e1c\u6709\u4e49\u52a1\u606a\u5c3d\u804c\u5b88\u8bc1\u660e\u8d27\u7269\u53ca\u6d89\u53ca\u4f0a\u6717\u7684\u822a\u6b21\u662f\u5408\u6cd5\u7684\u3002\u8239\u4e1c\u5e94\u5f53\u9075\u4ece\u534f\u4f1a\u6307\u5bfc\u5982\u4f55\u53bb\u8bc1\u660e\u5df2\u7ecf\u5c3d\u5230\u4e86\u606a\u5c3d\u804c\u5b88\u7684\u8d23\u4efb\u3002\u5982\u4e0a\u6587\u6240\u8ff0\uff0c\u5373\u4f7f\u8239\u4e1c\u5df2\u7ecf\u5b8c\u5168\u9075\u4ece\u4e86\u534f\u4f1a\u7684\u6307\u793a\u8bc1\u660e\u5176\u5df2\u505a\u5230\u606a\u5c3d\u804c\u5b88\uff0c\u9664\u975e\u5f8b\u5e08\u548c\u4e13\u5bb6\u7684\u610f\u89c1\u6beb\u4e0d\u542b\u7cca\uff0c\u534f\u4f1a\u53ef\u80fd\u4ecd\u65e7\u4e0d\u80fd\u786e\u8ba4\u627f\u4fdd\u7684\u95ee\u9898\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\">3. &nbsp;\u8239\u4e1c\u5e94\u5f53\u5411\u534f\u4f1a\u548c\u4e13\u5bb6\u4eec\u63d0\u4f9b\u4f55\u79cd\u8d44\u6599\u4e0e\u4fe1\u606f\uff1f<\/strong><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u4e0d\u540c\u7684\u60c5\u51b5\u53ef\u80fd\u4f1a\u6709\u4e0d\u540c\u7684\u8981\u6c42\uff0c\u6211\u53f8\u5728\u6b64\u6839\u636e\u5b9e\u8df5\u7ed9\u51fa\u4ee5\u4e0b\u5efa\u8bae\uff0c\u4f46\u6700\u7ec8\u4ee5\u534f\u4f1a\u610f\u89c1\u4e3a\u51c6\uff1a<\/p>\n<ul style=\"border: 0px; outline: 0px; list-style: none; text-align: justify;\">\n<li style=\"padding-top: 0px; padding-right: 0px; padding-bottom: 0px; border: 0px; outline: 0px;\">\u4ee5\u4e0b\u76f8\u5173\u65b9\u7684\u8eab\u4efd\u4fe1\u606f\uff1a\u79df\u5bb6\u3001\u8d27\u65b9\uff08\u6258\u8fd0\u4eba\u3001\u6536\u8d27\u4eba\u3001\u4e70\u65b9\u3001\u5356\u65b9\u3001\u5236\u9020\u5546\u4ee5\u53ca\u5728\u4f0a\u6717\u7684\u7ec8\u7aef\u4f7f\u7528\u8005\uff09\uff0c\u5c3d\u7ba1\u5b9e\u8df5\u4e2d\u4e0d\u5e38\u89c1\u4f46\u53ef\u80fd\u6d89\u53ca\u7684\u76f8\u5173\u65b9\uff08\u4f0a\u6717\u6e2f\u53e3\u8fd0\u8425\u8005\uff0c\u4f0a\u6717\u7684\u6e2f\u53e3\u4ee3\u7406\uff09\u7b49\u3002<\/li>\n<\/ul>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u5efa\u8bae\u8bf7\u5f8b\u5e08\u67e5\u770b\u4e0a\u8ff0\u5b9e\u4f53\u662f\u5426\u5728\u6700\u65b0\u7684\u7f8e\u56fd\u53ca\/\u6216\u6b27\u76df\u88ab\u5236\u88c1\u7684\u516c\u53f8\/\u4eba\u9ed1\u540d\u5355\u4e0a\u3002\u82e5\u5411\u8fd9\u4e9b\u88ab\u5236\u88c1\u7684\u5b9e\u4f53\u4ed8\u6b3e\u5c06\u4f1a\u8fdd\u53cd\u76f8\u5173\u7684\u4f0a\u6717\u5236\u88c1\u6cd5\u5f8b\u3002<\/p>\n<ul style=\"border: 0px; outline: 0px; list-style: none; text-align: justify;\">\n<li style=\"padding-top: 0px; padding-right: 0px; padding-bottom: 0px; border: 0px; outline: 0px;\">\u8be6\u5c3d\u7684\u8d27\u7269\u4fe1\u606f\u53ca\u5176\u6700\u7ec8\u7528\u9014<\/li>\n<\/ul>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u7531\u534f\u4f1a\u6307\u6d3e\u7684\u4e13\u5bb6\u68c0\u9a8c\u5e08\u53ef\u4ee5\u6839\u636e\u8239\u65b9\u63d0\u4f9b\u7684\u5408\u9002\u7684\u4fe1\u606f\u5224\u65ad\u51fa\u8d27\u7269\u5230\u5e95\u662f\u4ec0\u4e48\u4ee5\u53ca\u53ef\u80fd\u7684\u7528\u9014\uff1b\u7136\u540e\u5f8b\u5e08\u4f1a\u6839\u636e\u7f8e\u56fd\u53ca\u6b27\u76df\u7684\u6cd5\u5f8b\u6765\u5224\u65ad\u627f\u8fd0\u8fd9\u4e9b\u8d27\u7269\u662f\u5426\u8fdd\u6cd5\u3002<\/p>\n<ul style=\"border: 0px;
