{"id":10406,"date":"2012-08-24T08:37:44","date_gmt":"2012-08-24T08:37:44","guid":{"rendered":"http:\/\/192.168.1.14\/index.php\/2012\/08\/24\/guardcon\/"},"modified":"2025-09-01T01:21:43","modified_gmt":"2025-08-31T17:21:43","slug":"guardcon","status":"publish","type":"post","link":"https:\/\/andrewliu.com.hk\/zh\/guardcon\/","title":{"rendered":"Guardcon"},"content":{"rendered":"<p>&nbsp;<img decoding=\"async\" class=\"size-full wp-image-9071\" src=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2010\/06\/pdf.png\" alt=\"pdf\" width=\"16\" height=\"16\" style=\"padding: 0px; outline: 0px;\" \/>&nbsp;<a href=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2012\/08\/B283_ALCO20120058-Guardcon.pdf\" style=\"padding: 0px; border: 0px; outline: 0px;\">ENG<\/a>&nbsp; &nbsp;<img decoding=\"async\" class=\"size-full wp-image-9071\" src=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2010\/06\/pdf.png\" alt=\"pdf\" width=\"16\" height=\"16\" style=\"padding: 0px; outline: 0px;\" \/>&nbsp;<a href=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2012\/08\/B283_ALCO20120058-Guardcon-chi.pdf\" style=\"padding: 0px; border: 0px; outline: 0px;\">\u4e2d\u6587<\/a><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">BIMCO has published GUARDCON contract for the employment of security guards on vessels on 28 March 2012.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">BIMCO developed GUARDCON with the aim to assist the shipping community in particular the shipowners and their P&amp;I Clubs, by providing a clearly worded and comprehensive standard contract on which they can harmonize terms of engagement of PMSC (Private Maritime Security Contractors) and as well as simplifying the processes for vetting and approval of contracts by shipowners as well as their P&amp;I clubs.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">There has been substantial growth in the number of PMSC, each with differing contractual terms. However, there is presently very little regulation governing the activities of these companies and no formal recognized accreditation system to ensure minimum standards are met. Some of them even operate with inadequate insurance cover and without necessary permits and licenses. The issue of GUARDCON aims to raise the standard of security companies in terms of insurance cover for their risks, and permits and licenses to allow them to lawfully transport and carry weapons. However, it is notable that GUARDCON does not represent a recommendation by BIMCO or a substitute for exercising the due diligence by shipowners as part of the pre-contractual process when selecting the PMSC.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">GUARDCON addresses a number of key issues as follows:<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u2022 Security Services<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">It is provided in Clause 3 that the contractors are to provide a security team of at least four members, one of whom must be an appropriately experienced leader. Four is considered to be the minimum number of guards necessary to operate an efficient round-the-clock watch on board a vessel during a transit and providing the required level of protection. However, we noted in practice, certain shipowners would only employ a team of 3 armed guards on board, especially for those comparatively small sized vessels. It is concerned there is one side of the vessel would not be covered by the armed guards where actual attack may incur. Therefore, accepting any less than four guards should be agreed carefully on a case by case basis between owners and contractors and should follow from a proper risk assessment.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u2022 Contractors&#8217; Obligations and Responsibilities<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">It is provided in Clause 6 the contractors shall use &#8220;all reasonable skill and care&#8221; as the benchmark for providing the agreed security services. This clause provides for the obligations and responsibilities of contractors under this service contract including requiring the contractors to advise on and\/or help the owners implementing security measures on board the vessel; having sufficient shore based resources to provide operational and administrative backup to the security team during the transit; responsibility for their sick or injured personnel; qualifications, training and experience required of the security guards; background experience of the guards; working languages; team leader&#8217;s prior experience of providing shipboard security services etc.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">We would like to draw owner&#8217;s attention that it is further provided in sub-clause (a) (iv) that the advice provided by the security team to the Master in respect of routing of vessel is strictly limited to security related matters concerning the routing of the vessel and does not undermine the Master&#8217;s overall authority in respect of the navigation of the vessel.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u2022 Owners&#8217; Obligations and Responsibilities<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">Clause 7 states that owner&#8217;s obligations and responsibilities under the contract. The key obligation is the payment of all sums due to the contractors. Others include the notification of all relevant parties (including but not limited to Flag State, hull and machinery underwriters, P&amp;I underwriters, war risk underwriters and charterers) that the vessel will be carrying armed \/ unarmed security guards; the provision of a secure location for the storage of firearms; and the entering of the guards on the crew manifest as supernumeraries and giving them shipboard familiarization training. Listing the guards as supernumeraries on board the vessel is done to avoid issues in certain port as to the status of non-crew on the ship as if not listed as supernumeraries they could be considered as passengers that might create difficulties in terms of their employment on board and the carriage of their security equipment.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u2022 Master&#8217;s Responsibilities for the safe navigation and overall command of the vessel<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">In Clause 8, it is provided for the use of force. The most fundamental aspect is under no circumstances should there be a derogation of the Master&#8217;s authority when carrying armed civilian guards on board a merchant vessel, the master retains at all times full command of and responsibility for the vessel. However, it is also acknowledged that the Master does not have the necessary expertise to command a team of armed guards in the use of firearms or necessarily to decide upon situations where a graduated response by the guards is appropriate. Therefore, Clause 8 does not require the Master to invoke the Rules for the use of force. It is further provided in sub-clause (b) that if, in the team leader&#8217;s professional opinion, the threat warrants a graduated response from the security guards, he has to advise the Master or, in the Master&#8217;s absence, the officer of the watch, that he intends to invoke the Rules for the use of force. In terms of the actual use of force, sub-clause (c) clearly allocates the decision to each of the security guards alone. It is further provided in sub-clause (d) in terms of emphasizing the Master&#8217;s absolute authority at all times as conferred by the SOLAS Convention although the Master does not invoke the Rules of the use of force or order the use of force by the security guards, he retains the right under all circumstances to order the guards to stop firing.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u2022 Permits and Licenses<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">As mentioned above, an apparent sizable number of PMSCs are operating without the necessary permits and licenses to transport and carry weapons which effectively makes the carriage of weapons illegal. GUARDCON provides comprehensively in Clause 10 that there is a strict obligation on the contractors to ensure that they meet all requirements on permits and licenses. It is also not one-sided and owners also have obligation to obtain and maintain any and all permits to carry armed guards on board.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u2022 Insurance Policies<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">The key feature of GUARDCON is the Insurance Policies Clause 12. It sets out the contractors must maintain not only the liability insurance but also contractual indemnity insurance, where liability insurance only covers claims arising from contractors and their employees own fault (negligence) and contractual indemnity covers contractor&#8217;s undertaking in the contract to indemnity owners for claims made against them. Sub-clause (b) deals with policy limits which are set at USD 5million (or other higher figure as may be agreed by the parties). The contractors are obliged to provide the owners with evidence of insurance with copies of cover notes if the owner so requires. As provided by sub-clause (c), owners should also be adequately insured and have appropriate P&amp;I covers.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u2022 Liabilities and Indemnities<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">The liability and indemnity provision is based on knock for knock principles. Clause 15, whereby each party is responsible loss of \/ damage to and \/ or death of \/ injury to any of its own property and \/ or personnel or that of the entities within its defined &#8220;group&#8221; ; responsibility is without recourse to the other party; and each party, in respect of losses, damages or other liabilities it has assumed responsibility for, indemnifies the other party.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">GUARDCON is accompanied by a separate guidance document &#8220;Guidance on Rules for the Use of Force (RUF) by Privately Contracted Armed Security Personnel (PCASP) in Defense of a Merchant Vessel (MV)&#8221; That guidance is aimed to provide guidance to shipowners and PMSC in respecting of agreeing on the Rules for the use of force that must form part of service contact with armed guards companies. Shipowners should also be aware of that the Rules for the use of force must also comply with the provision of MSC.1\/Circ.1405 and with Flag State and Port State and applicable national laws re carriage and use of firearms.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">It is advised by BIMCO more and more armed guards companies (For example, PVI) are applying GUARDCON. When concluding a security service contract with armed guards companies, we highly recommend shipowners to check their terms and conditions for the key issues highlighted in GUARDCON to protect their interests.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><span style=\"font-size: 14pt; color: #022469;\"><strong>\u300a\u8239\u4e0a\u4fdd\u5b89\u4eba\u5458\u96c7\u4f63\u5408\u540c\u300b<\/strong><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u6ce2\u7f57\u7684\u6d77\u56fd\u9645\u822a\u8fd0\u516c\u4f1a\uff08BIMCO\uff09\u4e8e2012\u5e743\u670828\u65e5\u53d1\u5e03\u4e86\u300a\u8239\u4e0a\u4fdd\u5b89\u4eba\u5458\u96c7\u4f63\u5408\u540c\u300b\uff08\u4ee5\u4e0b\u7b80\u79f0GUARDCON\uff09\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">BIMCO\u53d1\u5e03GUARDCON\u7684\u76ee\u7684\u5728\u4e8e\uff1a\u4e3a\u822a\u8fd0\u7fa4\u4f53\uff0c\u5c24\u5176\u662f\u8239\u4e1c\u53ca\u5176\u4fdd\u8d54\u9669\u534f\u4f1a\u63d0\u4f9b\u63aa\u8f9e\u660e\u6670\uff0c\u5185\u5bb9\u5168\u9762\u7684\u6807\u51c6\u5408\u540c\uff0c\u4f7f\u5404\u79c1\u8425\u6d77\u4e8b\u5b89\u4fdd\u516c\u53f8\uff08PMSC\u4ee5\u4e0b\u7b80\u79f0\u5b89\u4fdd\u516c\u53f8\uff09\u4f7f\u7528\u7684\u5408\u540c\u6761\u6b3e\u5c3d\u91cf\u4e00\u81f4\uff0c\u540c\u65f6\u7b80\u5316\u8239\u4e1c\u53ca\u5176\u4fdd\u8d54\u9669\u534f\u4f1a\u5ba1\u6838\u548c\u63a5\u53d7\u5408\u540c\u7684\u7a0b\u5e8f\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u8fd1\u6765\uff0c\u5b89\u4fdd\u516c\u53f8\u6570\u91cf\u5927\u5e45\u589e\u52a0\uff0c\u4f46\u4f7f\u7528\u7684\u5408\u540c\u6761\u6b3e\u5404\u4e0d\u76f8\u540c\u3002\u7136\u800c\uff0c\u76ee\u524d\u51e0\u4e4e\u6ca1\u6709\u4efb\u4f55\u89c4\u7ae0\u6765\u89c4\u8303\u8fd9\u4e9b\u516c\u53f8\u7684\u7ecf\u8425\u6d3b\u52a8\uff0c\u4e5f\u6ca1\u6709\u6b63\u5f0f\u7684\u3001\u516c\u8ba4\u7684\u8ba4\u53ef\u4f53\u7cfb\u4ee5\u786e\u4fdd\u8fd9\u4e9b\u516c\u53f8\u7684\u670d\u52a1\u8fbe\u5230\u4e00\u4e2a\u6700\u4f4e\u6807\u51c6\u3002\u6709\u4e9b\u5b89\u4fdd\u516c\u53f8\u751a\u81f3\u5728\u6ca1\u6709\u6295\u4fdd\u9002\u5f53\u7684\u4fdd\u9669\uff0c\u6216\u7f3a\u4e4f\u5fc5\u8981\u8bb8\u53ef\u8bc1\u548c\u8425\u4e1a\u6267\u7167\u7684\u60c5\u51b5\u4e0b\u7ecf\u8425\u3002GUARDCON\u7684\u53d1\u5e03\u65e8\u5728\u63d0\u5347\u5b89\u4fdd\u516c\u53f8\u5728\u98ce\u9669\u4fdd\u969c\u3001\u8bb8\u53ef\u8bc1\u548c\u8425\u4e1a\u6267\u7167\u7b49\u8981\u6c42\u4e0a\u7684\u6807\u51c6\uff0c\u786e\u4fdd\u5176\u80fd\u591f\u5408\u6cd5\u8fd0\u8f93\u548c\u643a\u5e26\u6b66\u5668\u3002\u7136\u800c\uff0c\u9700\u8981\u6ce8\u610f\u7684\u662f\uff0cBIMCO\u5e76\u6ca1\u6709\u660e\u786e\u63a8\u8350\u4f7f\u7528GUARDCON\u5408\u540c\u683c\u5f0f\uff0c\u8be5\u5408\u540c\u683c\u5f0f\u7684\u51fa\u73b0\u4e5f\u4e0d\u610f\u5473\u7740\uff0c\u8239\u4e1c\u5728\u9009\u62e9\u5b89\u4fdd\u516c\u53f8\u65f6\uff0c\u4e0d\u518d\u9700\u8981\u606a\u5c3d\u804c\u5b88\u505a\u597d\u5ba1\u67e5\u5408\u540c\u6761\u6b3e\u7684\u5de5\u4f5c\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">GUARDCON \u89c4\u5b9a\u7684\u82e5\u5e72\u4e3b\u8981\u4e8b\u9879\u5982\u4e0b\uff1a<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u2022 \u5b89\u5168\u670d\u52a1<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u7b2c3\u6761\u89c4\u5b9a\uff0c\u5b89\u4fdd\u516c\u53f8\u63d0\u4f9b\u7684\u4fdd\u5b89\u5c0f\u7ec4\u81f3\u5c11\u75314\u540d\u6210\u5458\u7ec4\u6210\uff0c\u5176\u4e2d\u4e00\u4eba\u5fc5\u987b\u4e3a\u7ecf\u9a8c\u4e30\u5bcc\u7684\u9886\u5bfc\u8005\u30024\u540d\u62a4\u822a\u4eba\u5458\u662f\u6700\u4f4e\u4eba\u6570\u9700\u6c42\uff0c\u53ea\u67094\u540d\u53ca\u4ee5\u4e0a\u624d\u80fd\u5728\u8fd0\u8f93\u9014\u4e2d\u5f00\u5c55\u6709\u6548\u768424\u5c0f\u65f6\u8239\u4e0a\u77ad\u671b\uff0c\u7ed9\u8239\u8236\u63d0\u4f9b\u7b26\u5408\u8981\u6c42\u7684\u6709\u6548\u4fdd\u62a4\u3002\u7136\u800c\uff0c\u6211\u4eec\u6ce8\u610f\u5230\u5b9e\u52a1\u4e2d\uff0c\u4e00\u4e9b\u8239\u4e1c\u96c7\u4f63\u53ea\u67093\u540d\u6b66\u88c5\u4eba\u5458\u7684\u4fdd\u5b89\u5c0f\u7ec4\uff0c\u5c24\u5176\u662f\u90a3\u4e9b\u5428\u4f4d\u8f83\u5c0f\u7684\u8239\u8236\u3002\u4ee4\u4eba\u62c5\u5fe7\u7684\u662f\uff0c\u5f53\u6d77\u76d7\u52ab\u6301\u65f6\uff0c3\u540d\u4fdd\u5b89\u65e0\u6cd5\u4f7f\u8239\u8236\u7684\u4e24\u8237\u53ca\u9996\u5c3e\u90fd\u5f97\u5230\u4fdd\u62a4\u3002\u56e0\u6b64\uff0c\u8239\u4e1c\u548c\u5b89\u4fdd\u516c\u53f8\u5e94\u6839\u636e\u4e2a\u6848\u5177\u4f53\u60c5\u51b5\uff0c\u614e\u91cd\u8003\u8651\u4efb\u4f55\u5c11\u4e8e4\u540d\u62a4\u822a\u4eba\u5458\u7684\u5408\u540c\uff0c\u4e8b\u524d\u5fc5\u987b\u505a\u51fa\u5145\u5206\u7684\u98ce\u9669\u8bc4\u4f30\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u2022 \u5b89\u4fdd\u516c\u53f8\u7684\u4e49\u52a1\u548c\u8d23\u4efb<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u5408\u540c\u7b2c6\u6761\u89c4\u5b9a\uff0c\u5b89\u4fdd\u516c\u53f8\u5e94\u4ee5\u5176&#8221;\u4e00\u5207\u5408\u7406\u6280\u80fd\u548c\u8c28\u614e&#8221; \u4e3a\u57fa\u51c6\uff0c\u63d0\u4f9b\u7ea6\u5b9a\u7684\u5b89\u5168\u670d\u52a1\u3002\u672c\u6761\u6b3e\u89c4\u5b9a\u4e86\u670d\u52a1\u5408\u540c\u4e0b\u5b89\u4fdd\u516c\u53f8\u7684\u4e49\u52a1\u548c\u8d23\u4efb\uff0c\u5305\u62ec\u5b89\u4fdd\u516c\u53f8\u9700\u8981\u5bf9\u8239\u4e1c\u91c7\u53d6\u8239\u4e0a\u5b89\u5168\u63aa\u65bd\u7ed9\u4e88\u5efa\u8bae\u548c\u5e2e\u52a9\uff1b\u9700\u62e5\u6709\u5145\u8db3\u7684\u5cb8\u4e0a\u8d44\u6e90\uff0c\u4ee5\u786e\u4fdd\u8fd0\u8f93\u671f\u95f4\u5411\u4fdd\u5b89\u5c0f\u7ec4\u63d0\u4f9b\u64cd\u4f5c\u548c\u7ba1\u7406\u4e0a\u7684\u5cb8\u57fa\u652f\u6301\uff1b\u9700\u5bf9\u4eba\u5458\u7684\u4f24\u75c5\u8d1f\u8d23\uff1b\u9700\u786e\u4fdd\u4fdd\u5b89\u961f\u5458\u7684\u7d20\u8d28\u3001\u57f9\u8bad\u7ecf\u5386\u548c\u5b9e\u6218\u7ecf\u9a8c\u8fbe\u5230\u5b89\u4fdd\u8981\u6c42\uff1b\u9700\u786e\u4fdd\u4fdd\u5b89\u961f\u5458\u7684\u80cc\u666f\u7ecf\u5386\u3001\u5de5\u4f5c\u8bed\u8a00\u3001\u9886\u5bfc\u7684\u524d\u671f\u7ecf\u9a8c\u7b49\u90fd\u80fd\u8fbe\u5230\u62a4\u822a\u8981\u6c42\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u8239\u4e1c\u8fd8\u9700\u6ce8\u610f\u7684\u662f\uff0c\u5728\u9644\u5c5e\u6761\u6b3e(a)(iv)\u4e2d\u8fdb\u4e00\u6b65\u89c4\u5b9a\uff0c\u4fdd\u5b89\u5c0f\u7ec4\u5411\u8239\u957f\u63d0\u4f9b\u7684\u6709\u5173\u8239\u8236\u822a\u7ebf\u7684\u5efa\u8bae\u4ec5\u9650\u4e8e\u4e0e\u822a\u7ebf\u5b89\u5168\u6027\u6709\u5173\u7684\u4e8b\u9879\uff0c\u5e76\u4e0d\u80fd\u6539\u53d8\u8239\u957f\u5bf9\u8239\u8236\u822a\u884c\u5b89\u5168\u5168\u6743\u8d1f\u8d23\u8fd9\u4e00\u6388\u6743\u3002<\/p>\n<p style=\"border: 0px;
