Kos (2012) UKSC 17.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">The owners claim for the balance hire and bunkers were based on two grounds : &#8211;<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">1. &nbsp;Under the law of bailment as the owners were under a common law duty to care for the cargo after their contract with the charterers had been terminated.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">The Supreme Court in the Court Of Appeal held unanimously the owners were entitled to claim charterers for the balance hire and bunkers consumed after withdrawal under the law of bailment.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">2. &nbsp;Under an indemnity from the charterer contained in the charterparty against &#8220;all consequences or liabilities that may arise from the master&#8230;complying with charterers&#8217; orders.&#8221;<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">The indemnity in this case was under clause 13 of Shelltime 3 Form and in the dry cargo trades the words in clause 11 of NYPE 93 are even more specific , &#8220;&#8230;the owners shall without prejudice to th e liberty to withdraw, be entitled to withhold the performance of any and all of their obligations hereunder and shall have no responsibility whatsoever for any consequences thereof, in respect of which the charterers hereby indemnify the owners, and hire shall continue to accrue and any extra expenses resulting from such withholding shall be for the charterers&#8217; account.&#8221;<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">The Supreme Court held by a majority the owners could claim the balance hire and bunkers consumed after withdrawal under the indemnity clause 13 on the basis the owner&#8217;s losses arose effectively from the charterers&#8217; orders to load the cargo.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">Lord Mance dissented as he said the right of imdemnity must be subject there was a direct and casual cause between the charterer&#8217;s orders and the owner&#8217;s loss which there was not in the case. As matter of law, we would tend to agree with Lord Mance&#8217;s dissenting views as it is evident the owner&#8217;s loss was for the reason there was cargo on board, but this did not not solely arise from charterers&#8217; orders, but arose from the owner&#8217;s decision to withdraw. However this Court Of Appeal decision certainly benefits the owners&#8217; position which is welcoming.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><span style=\"font-size: 14pt; color: #022469;\"><strong>\u6709\u8d27\u7269\u5728\u8239\u65f6\u7684\u64a4\u8239\u95ee\u9898<\/strong><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u5982\u4eca\u822a\u8fd0\u5e02\u573a\u4f4e\u8ff7\uff0c\u8239\u4e1c\u56e0\u79df\u5bb6\u672a\u652f\u4ed8\u79df\u91d1\u800c\u9700\u8981\u8003\u8651\u64a4\u8239\u7684\u60c5\u51b5\u65f6\u6709\u53d1\u751f\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u539f\u6765\u7684\u6cd5\u5f8b\u89c2\u70b9\u8ba4\u4e3a\uff0c\u8239\u4e1c\u5e94\u5f53\u5728\u8239\u4e0a\u6ca1\u6709\u8d27\u7269\u65f6\u624d\u64a4\u8239\uff0c\u56e0\u4e3a\u4ece\u64a4\u8239\u5230\u5378\u8d27\u5b8c\u6bd5\u8fd9\u4e00\u671f\u95f4\u7684\u79df\u91d1\u635f\u5931\u548c\u71c3\u6cb9\u6d88\u8017\uff0c\u8239\u4e1c\u7f3a\u4e4f\u6cd5\u5f8b\u4f9d\u636e\u5411\u79df\u5bb6\u8fdb\u884c\u7d22\u8d54\uff0c\u7406\u7531\u662f\u8be5\u635f\u5931\u662f\u7531\u4e8e\u8239\u4e1c\u81ea\u5df1\u7684\u64a4\u8239\u51b3\u5b9a\u5bfc\u81f4\u7684\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">Petroleo Brasiliero v E.N.E.Kos (2012) UKSC 17 \u6848\u7684\u4e0a\u8bc9\u6cd5\u9662\u5224\u51b3\uff0c\u4f7f\u5f97\u6cd5\u5f8b\u73af\u5883\u5b8c\u5168\u8f6c\u53d8\uff0c\u53d8\u5f97\u6709\u5229\u4e8e\u8239\u4e1c\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u672c\u6848\u4e2d\uff0c\u8239\u4e1c\u57fa\u4e8e\u4ee5\u4e0b\u4e24\u4e2a\u7406\u7531\u5411\u79df\u5bb6\u7d22\u8d54\u5269\u4f59\u79df\u91d1\u548c\u71c3\u6cb9\uff1a<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">1. &nbsp;\u6839\u636e\u59d4\u6258\u5173\u7cfb\u3002\u8239\u4e1c\u4e0e\u79df\u5bb6\u7684\u5408\u7ea6\u5173\u7cfb\u7ed3\u675f\u4e4b\u540e\uff0c\u5728\u82f1\u56fd\u666e\u901a\u6cd5\u4e0b\uff0c\u8239\u4e1c\u4f5c\u4e3a\u8d27\u7269\u4fdd\u7ba1\u4eba\u627f\u62c5\u7167\u6599\u8d27\u7269\u7684\u8d23\u4efb\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u6700\u9ad8\u4e0a\u8bc9\u6cd5\u9662\u4e00\u81f4\u8ba4\u4e3a\uff0c\u8239\u4e1c\u6709\u6743\u6839\u636e\u59d4\u6258\u5173\u7cfb\u5411\u79df\u5bb6\u7d22\u8d54\u64a4\u8239\u4e4b\u540e\u7684\u79df\u91d1\u635f\u5931\u548c\u71c3\u6cb9\u6d88\u8017\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">2. &nbsp;\u6839\u636e\u79df\u7ea6\u4e0b\u7684\u8d54\u507f\u6761\u6b3e\u3002\u8be5\u6761\u6b3e\u89c4\u5b9a\u79df\u5bb6\u9700\u8d54\u507f&#8221;\u56e0\u8239\u957f\u9075\u5b88\u79df\u5bb6\u6307\u4ee4\u5f15\u8d77\u7684\u4e00\u5207\u540e\u679c\u6216\u8d23\u4efb&#8221; \u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u672c\u6848\u4e2d\u8d54\u507f\u4f9d\u636e\u7684\u6761\u6b3e\u662f Shelltime 3 \u683c\u5f0f\u7b2c13\u6761\uff0c\u9488\u5bf9\u5e72\u8d27\u8fd0\u8f93\uff0c93\u571f\u4ea7\u683c\u5f0f\u7b2c11\u6761\u7684\u63aa\u8f9e\u66f4\u4e3a\u660e\u786e&#8221;&#8230;\u5728\u4e0d\u5f71\u54cd\u8239\u4e1c\u64a4\u8239\u6743\u5229\u7684\u539f\u5219\u4e0b\uff0c\u8239\u4e1c\u6709\u6743\u4e2d\u6b62\u5c65\u884c\u5176\u4efb\u4f55\u548c\u5168\u90e8\u4e49\u52a1\uff0c\u5e76\u4e14\u5bf9\u7531\u6b64\u4ea7\u751f\u7684\u4efb\u4f55\u540e\u679c\u4e0d\u8d1f\u8d23\u4efb\uff0c\u79df\u5bb6\u5e94\u8d54\u507f\u8239\u4e1c\u56e0\u6b64\u800c\u906d\u53d7\u7684\u635f\u5931\uff0c\u800c\u4e14\u79df\u91d1\u4ecd\u9700\u7167\u4ed8\uff1b\u7531\u4e8e\u8239\u4e1c\u4e2d\u6b62\u5c65\u884c\u5176\u4e49\u52a1\u800c\u4ea7\u751f\u7684\u4efb\u4f55\u989d\u5916\u8d39\u7528\uff0c\u7531\u79df\u5bb6\u627f\u62c5\u3002&#8221;<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u6700\u9ad8\u6cd5\u9662\u5224\u51b3\u4ee5\u591a\u6570\u901a\u8fc7\uff0c\u8ba4\u4e3a\u8239\u4e1c\u53ef\u4ee5\u6839\u636e\u7b2c13\u6761\u8d54\u507f\u6761\u6b3e\u7d22\u8d54\u64a4\u8239\u540e\u7684\u5269\u4f59\u79df\u91d1\u548c\u71c3\u6cb9\u6d88\u8017\uff0c\u7406\u7531\u662f\u8239\u4e1c\u7684\u635f\u5931\u5b9e\u9645\u4e0a\u662f\u56e0\u79df\u5bb6\u88c5\u8f7d\u8d27\u7269\u7684\u6307\u4ee4\u5f15\u8d77\u7684\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">Mance\u6cd5\u5b98\u5bf9\u4ee5\u4e0a\u89e3\u91ca\u6709\u4e0d\u540c\u610f\u89c1\uff0c\u4ed6\u8ba4\u4e3a\u79df\u5bb6\u6307\u4ee4\u548c\u8239\u4e1c\u635f\u5931\u4e4b\u95f4\u5fc5\u987b\u6709\u76f4\u63a5\u56e0\u679c\u5173\u7cfb\uff0c\u8239\u4e1c\u624d\u6709\u7d22\u8d54\u7684\u6743\u5229\uff0c\u4f46\u672c\u6848\u5e76\u975e\u5982\u6b64\u3002\u4ece\u6cd5\u5f8b\u89d2\u5ea6\u8003\u8651\uff0c\u6211\u4eec\u503e\u5411\u4e8e\u652f\u6301Mance\u6cd5\u5b98\u7684\u53cd\u5bf9\u610f\u89c1\uff0c\u56e0\u4e3a\u5f88\u660e\u663e\u8239\u4e1c\u53d1\u751f\u8fd9\u4e9b\u635f\u5931\u539f\u56e0\u662f\u8d27\u7269\u5728\u8239\u4e0a\uff0c\u4f46\u8fd9\u4e0d\u662f\u5355\u5355\u7531\u79df\u5bb6\u7684\u6307\u4ee4\u800c\u5f15\u8d77\u7684\uff0c\u8239\u4e1c\u7684\u64a4\u8239\u51b3\u5b9a\u4e5f\u662f\u539f\u56e0\u4e4b\u4e00\u3002\u4f46\u662f\uff0c\u8be5\u4e0a\u8bc9\u6cd5\u9662\u7684\u5224\u51b3\u6709\u5229\u4e8e\u8239\u4e1c\uff0c\u662f\u8239\u4e1c\u6240\u5e0c\u671b\u770b\u5230\u7684\u3002<\/p>\n<p style=\"border: 0px;
