The charterparty of NYPE form was used. The bills of lading was issued and signed by ship master. After discharging, 5,000mt of steel bar was damaged due to improper stowage in cargo hold.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">In this scenario, cargo owner (i.e. the time charterer) would raise their claim to their cargo insurer in respect of the damaged cargo. After paying the cargo claim, the cargo insurers would obtain the right of subrogation from the cargo owner and would then seek for recovery from the headowner who was the carrier on the bills of lading.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">Headowner, after settling the cargo claims with the cargo owner, will claim for reimbursement from their P&amp;I insurers. The headowner&#8217;s P&amp;I insurer, after paying the cargo claim, would also obtain the right of subrogation from headowner and seek for recovery from the time charterer based on the clause 8 in the NYPE C\/P terms:<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">&#8220;Charterers are to load, stow and trim the cargo at their expense under the supervision of the Captain&#8221;<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">The charterer would be liable to cargo damage arising from the improper stowage.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">Please note that voyage charterer would encounter the same liability. Standard GENCON clause 5 provides that:<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">&#8220;The cargo shall be brought into the holds, loaded stowed and\/or trimmed and taken from the holds and discharged by the Charterers or their Agents, free of any risk, liability and expense whatsoever to the Owners&#8221;<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">Therefore, we would recommend that charterers do not fully exclude their cargo liability even though they carry their owned cargo, unless they have obtained the cargo insurers agreement to waive their right of subrogation against headowner or charterers.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">We would like to remind charterers that if Interclub Agreement 2011 is incorporated in the charterparty with headowner \/ disponent owner, charterers will need to response to the owner&#8217;s demand to security in respect of that cargo claim, regardless of whether the right to apportionment between the owner and charterers has arisen under the Interclub Agreement.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; font-size: 12px; text-align: justify;\">&nbsp;<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><span style=\"font-size: 14pt; color: #022469;\"><strong>\u79df\u5bb6\u5373\u4f7f\u8fd0\u8f7d\u81ea\u5df1\u7684\u8d27\u7269\u4ecd\u9762\u5bf9\u98ce\u9669<\/strong><\/span><\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u8bb8\u591a\u79df\u5bb6\u5305\u62ec\u671f\u79df\u79df\u5bb6\u6216\u7a0b\u79df\u79df\u5bb6\uff0c\u8ba4\u4e3a\u5982\u679c\u627f\u79df\u8239\u8236\u4e0a\u7684\u8d27\u7269\u662f\u7531\u79df\u5bb6\u6216\u5176\u59ca\u59b9\u516c\u53f8\u6240\u62e5\u6709\u7684\uff0c\u627f\u79df\u4eba\u5c06\u4e0d\u627f\u62c5\u8d27\u635f\u8d23\u4efb\uff0c\u6240\u4ee5\u4ed6\u4eec\u4e00\u822c\u4f1a\u5728\u5176\u79df\u5bb6\u8d23\u4efb\u4fdd\u9669\u5254\u9664\u8d27\u7269\u8d23\u4efb\uff0c\u4ee5\u8282\u7701\u4fdd\u8d39\u3002<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u4e8b\u5b9e\u4e0a\uff0c\u79df\u5bb6\u7684\u98ce\u9669\u4ecd\u7136\u5b58\u5728\u3002\u79df\u5bb6\u6709\u53ef\u80fd\u88ab\u8239\u4e1c\u6216\u5176\u4fdd\u8d54\u9669\u4fdd\u9669\u4eba\u8ffd\u8ba8\u56e0\u4e3a\u79df\u5bb6\u6216\u5176\u96c7\u5458\u7684\u758f\u5ffd\u800c\u4ea7\u751f\u7684\u8d27\u7269\u635f\u5931\u3002<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u4f8b\u5982\uff0c\u671f\u79df\u79df\u5bb6\u4ece\u539f\u8239\u4e1c\u79df\u4e86\u4e00\u8258\u8239\u8fd0\u8f7d\u81ea\u5df1\u7684\u8d27\u7269\u3002\u79df\u8239\u5408\u540c\u662f\u4f7f\u7528NYPE\u7684\u683c\u5f0f\u3002\u7531\u8239\u957f\u7b7e\u53d1\u63d0\u5355\u3002\u5378\u8d27\u540e\u53d1\u73b05000\u5428\u94a2\u7b4b\u56e0\u5728\u8d27\u8231\u5185\u4e0d\u5f53\u79ef\u8f7d\u800c\u635f\u6bc1\u3002<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u5728\u8fd9\u79cd\u60c5\u51b5\u4e0b\uff0c\u8d27\u4e3b\uff08\u5373\u671f\u79df\u79df\u5bb6\uff09\u4f1a\u5411\u4ed6\u4eec\u7684\u8d27\u7269\u4fdd\u9669\u4eba\u5c31\u5df2\u635f\u6bc1\u7684\u8d27\u7269\u63d0\u51fa\u7d22\u8d54\u3002\u8d27\u7269\u4fdd\u9669\u4eba\u5728\u652f\u4ed8\u7d22\u8d54\u540e\uff0c\u5c06\u83b7\u5f97\u8d27\u4e3b\u7684\u4ee3\u4f4d\u6743\uff0c\u7136\u540e\u5411\u63d0\u5355\u627f\u8fd0\u4eba(\u5373\u539f\u8239\u4e1c)\u5bfb\u6c42\u8d23\u4efb\u8d54\u507f\u3002<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u539f\u8239\u4e1c\uff0c\u5728\u89e3\u51b3\u8d27\u4e3b\u7684\u7d22\u8d54\u540e\uff0c\u4f1a\u5411\u8239\u4e1c\u4fdd\u8d54\u9669\u4fdd\u9669\u4eba\u63d0\u51fa\u6709\u5173\u7d22\u8d54\u3002\u540c\u6837\uff0c\u539f\u8239\u4e1c\u7684\u4fdd\u8d54\u9669\u4fdd\u9669\u4eba\u5728\u652f\u4ed8\u8239\u4e1c\u8be5\u7b14\u7d22\u8d54\u540e\uff0c\u539f\u8239\u4e1c\u7684\u4fdd\u8d54\u9669\u4fdd\u9669\u4eba\u4e5f\u5c06\u83b7\u5f97\u8239\u4e1c\u7684\u4ee3\u4f4d\u6743\uff0c\u7136\u540e\u6839\u636eNYPE\u79df\u7ea6\u7b2c8\u6761\u6761\u6b3e\u5411\u671f\u79df\u79df\u5bb6\u5bfb\u6c42\u8d23\u4efb\u8d54\u507f\u3002NYPE\u79df\u7ea6\u7b2c8\u6761\u6761\u6b3e\u5982\u4e0b\uff1a<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u79df\u5bb6\u56e0\u6b64\u5c06\u627f\u62c5\u4e0d\u5f53\u79ef\u8f7d\u6240\u4ea7\u751f\u7684\u8d27\u7269\u8d23\u4efb\u3002<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u8bf7\u6ce8\u610f\uff0c\u7a0b\u79df\u79df\u5bb6\u4f1a\u9047\u5230\u76f8\u540c\u7684\u8d23\u4efb\u3002\u6807\u51c6GENCON\u7b2c5\u6761\u6761\u6b3e\u89c4\u5b9a\uff1a<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; .<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u56e0\u6b64\uff0c\u5373\u4f7f\u627f\u79df\u8239\u8236\u4e0a\u7684\u8d27\u7269\u662f\u7531\u79df\u5bb6\u6216\u5176\u59ca\u59b9\u516c\u53f8\u6240\u62e5\u6709\u7684\uff0c\u6211\u4eec\u5efa\u8bae\u79df\u5bb6\u4e0d\u5e94\u8be5\u4e8e\u4ed6\u4eec\u79df\u5bb6\u8d23\u4efb\u9669\u5185\u5b8c\u5168\u5254\u9664\u8d27\u7269\u8d23\u4efb\uff0c\u9664\u975e\u8d27\u4e3b(\u5373\u79df\u5bb6)\u83b7\u5f97\u5176\u8d27\u7269\u4fdd\u9669\u4eba\u7684\u540c\u610f\uff0c\u653e\u5f03\u4ee3\u4f4d\u6743\u5411\u539f\u8239\u4e1c\u6216\u79df\u5bb6\u8ffd\u8ba8\u8d23\u4efb\u8d54\u507f\u3002<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u6211\u4eec\u5728\u6b64\u4ea6\u63d0\u9192\u79df\u5bb6\uff0c\u5982\u679c\u4e0e\u8239\u4e1c\u7684\u79df\u7ea6\u5df2\u5e76\u5165\u300c\u4fdd\u8d54\u534f\u4f1a\u95f4\u534f\u8bae2011\u300d(Interclub Agreement 2011)\uff0c\u79df\u5bb6\u5c06\u9700\u8981\u5e94\u5bf9\u8239\u4e1c\u7684\u9700\u6c42\uff0c\u9488\u5bf9\u6709\u5173\u7684\u8d27\u7269\u7d22\u8d54\u51fa\u5177\u62c5\u4fdd\uff0c\u65e0\u8bba\u79df\u5bb6\u4e0e\u8239\u4e1c\u662f\u5426\u5df2\u6309\u300c\u4fdd\u8d54\u534f\u4f1a\u95f4\u534f\u8bae2011\u300d(Interclub Agreement 2011)\u4f5c\u51fa\u5206\u644a\u3002<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px;
