Legislation recently enacted in these countries can result in Charterers potentially being held strictly accountable, whether directly or jointly with the Owners, for losses, damages, fines or compensation arising out of an oil pollution incident including pollution from bunkers.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">In our Circular we invited Assureds regularly trading to these jurisdictions to review their existing and future contractual terms insofar as pollution liabilities are concerned. Given the increased exposure faced by Charterers, we have drafted two (2) clauses (the &#8220;Clauses&#8221; ) specially designed to deal with pollution claims depending on whether the vessel is on time or voyage charter. While the Clauses are of worldwide application they can be adapted to suit a specific vessel\/P&amp;I Club, trade or jurisdiction and the Club will be available to assist in this respect. The Clauses are attached to this Circular.<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">See attached file: 2012 004 Pollution Clauses Circular.pdf<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">&nbsp;<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><span style=\"font-size: 14pt; color: #022469;\"><strong>\u4f9b\u671f\u79df\u548c\u7a0b\u79df\u79df\u7ea6\u4f7f\u7528\u7684 &#8220;\u6c61\u67d3\u6761\u6b3e&#8221;<\/strong><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u79df\u5bb6\u4fdd\u8d54\u534f\u4f1a2012\u5e74003\u53f7\u901a\u51fd\u4e2d\u5f3a\u8c03\u4e86\u7a0b\u79df\u548c\u671f\u79df\u7684\u79df\u5bb6\u5728\u67d0\u4e9b\u5730\u533a\u9762\u4e34\u6c61\u67d3\u7d22\u8d54\u7684\u98ce\u9669\uff0c\u8bf8\u5982\u6fb3\u5927\u5229\u4e9a\u3001\u65b0\u897f\u5170\u7b49\u5730\uff0c\u4e5f\u5305\u62ec\u5df4\u897f\u548c\u4e2d\u56fd\u3002\u6309\u7167\u8fd9\u4e9b\u5730\u533a\u9881\u5e03\u7684\u6cd5\u5f8b\uff0c\u79df\u5bb6\u6709\u53ef\u80fd\u76f4\u63a5\u6216\u8005\u548c\u8239\u4e1c\u5171\u540c\u5bf9\u5305\u62ec\u71c3\u6cb9\u6c61\u67d3\u5728\u5185\u7684\u6cb9\u6c61\u4e8b\u4ef6\u6240\u5f15\u8d77\u7684\u635f\u5931\u3001\u635f\u5bb3\u3001\u7f5a\u6b3e\u6216\u8d54\u507f\uff0c\u627f\u62c5\u4e25\u683c\u8d23\u4efb\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u5728\u672c\u901a\u51fd\u4e2d\uff0c\u534f\u4f1a\u5efa\u8bae\u7ecf\u5e38\u524d\u5f80\u8fd9\u4e9b\u5730\u533a\u7684\u88ab\u4fdd\u9669\u4eba\u68c0\u67e5\u5176\u76ee\u524d\u548c\u5c06\u6765\u6240\u91c7\u7528\u7684\u6709\u5173\u6c61\u67d3\u8d23\u4efb\u7684\u5408\u540c\u6761\u6b3e\u3002\u8003\u8651\u5230\u79df\u5bb6\u9762\u4e34\u8d8a\u6765\u8d8a\u5927\u7684\u98ce\u9669\uff0c\u534f\u4f1a\u4e13\u95e8\u8d77\u8349\u4e86\u5e94\u5bf9\u6c61\u67d3\u7d22\u8d54\u7684\u671f\u79df\u548c\u7a0b\u79df\u6761\u6b3e\u3002\u8fd9\u4e9b\u6761\u6b3e\u53ef\u5728\u5168\u7403\u8303\u56f4\u9002\u7528\uff0c\u4e5f\u9002\u5408\u4e8e\u67d0\u4e00\u7279\u5b9a\u7684\u8239\u8236\/\u4fdd\u8d54\u534f\u4f1a\u3001\u822a\u884c\u533a\u57df\u6216\u8005\u53f8\u6cd5\u8f96\u533a\uff0c\u5982\u6709\u9700\u8981\u534f\u4f1a\u5c06\u5728\u8fd9\u65b9\u9762\u7ed9\u4e88\u4f1a\u5458\u5e2e\u52a9\u3002\u5177\u4f53\u6761\u6b3e\uff0c\u8bf7\u89c1\u4e0b\u6587\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><span style=\"font-size: 14pt; color: #022469;\"><strong><br \/><\/strong><\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;ENG&nbsp; &nbsp;&nbsp;CHN The Club&#8217;s Circular no 003 2012 highlighted the exposure of voyage and time charterers to pollution claims in certain jurisdictions like Australia and New Zealand but which could arguably include countries such as Brazil and China.
