\u9999\u6e2f\u9ad8\u9662\u6709\u4e00\u4e2a\u6848\u5b50\uff0cSinokor v Owners of vessel ‘Marcatania’ (2008)\uff0c\u5c31\u53d1\u751f\u8fc7\u7c7b\u4f3c\u60c5\u51b5\u3002\u8be5\u6848\u4e2d\uff0c\u8231\u4f4d\u627f\u79df\u4eba\u8981\u6c42\u539f\u8239\u4e1c\u5728\u5bf9\u671f\u79df\u79df\u5bb6\u64a4\u8239\u540e\uff0c\u5c06\u96c6\u88c5\u7bb1\u8fd0\u81f3\u4ed6\u4eec\u8981\u6c42\u7684\u76ee\u7684\u5730\u3002\u539f\u8239\u4e1c\u62d2\u7edd\u4e86\u8fd9\u4e2a\u8981\u6c42\u3002<\/p>\n

\u63d0\u5355\u662f\u7531\u8231\u4f4d\u627f\u79df\u4eba\u7b7e\u53d1\u7684\u3002<\/p>\n

\u6cd5\u9662\u8ba4\u4e3a\uff0c\u539f\u8239\u4e1c\u6ca1\u6709\u5c06\u96c6\u88c5\u7bb1\u8fd0\u81f3\u76ee\u7684\u5730\u7684\u4e49\u52a1\u3002\u539f\u8239\u4e1c\u548c\u8231\u4f4d\u627f\u79df\u4eba\u4e4b\u95f4\u6ca1\u6709\u5408\u540c\u5173\u7cfb\uff0c\u5e76\u4e14\u63d0\u5355\u4e5f\u4e0d\u662f\u7531\u539f\u8239\u4e1c\u7b7e\u53d1\u7684\u3002<\/p>\n

\u8231\u4f4d\u627f\u79df\u4eba\u8ba4\u4e3a\uff0c\u8239\u957f\u8d1f\u8d23\u76d1\u7763\u96c6\u88c5\u7bb1\u7684\u88c5\u8f7d\u548c\u79ef\u8f7d\uff0c\u539f\u8239\u4e1c\u4e0e\u96c6\u88c5\u7bb1\u8231\u4f4d\u627f\u79df\u4eba\u4e4b\u95f4\u6210\u7acb\u5408\u540c\u5173\u7cfb\uff0c\u4f46\u6cd5\u9662\u6ca1\u6709\u91c7\u7eb3\u8fd9\u4e00\u4e3b\u5f20\u3002<\/p>\n

\u8231\u4f4d\u627f\u79df\u4eba\u8fd8\u4e3b\u5f20\uff0c\u539f\u8239\u4e1c\u662f\u53d7\u6258\u4eba\uff0c\u59d4\u6258\u5173\u7cfb\u53d7\u8231\u4f4d\u79df\u8d41\u534f\u8bae\u7ea6\u675f\uff0c\u56e0\u6b64\u539f\u8239\u4e1c\u4e0d\u4ec5\u6709\u8d23\u4efb\u7167\u6599\u8d27\u7269\uff0c\u800c\u4e14\u6709\u8d23\u4efb\u5b8c\u6210\u672c\u822a\u6b21\u53ca\u4ea4\u4ed8\u8d27\u7269\u3002\u4f46\u8be5\u4e3b\u5f20\u88ab\u6cd5\u9662\u62d2\u7edd\uff0c\u6cd5\u9662\u8ba4\u4e3a\u539f\u8239\u4e1c\u548c\u8231\u4f4d\u627f\u79df\u4eba\u4e4b\u95f4\u6b20\u7f3a\u5408\u540c\u76f8\u5bf9\u6027\uff0c\u5e76\u4e14\u6ca1\u6709\u6cd5\u5f8b\u6216\u5408\u7406\u7684\u7406\u7531\u53ef\u4ee5\u89e3\u91ca\u4e3a\u4ec0\u4e48\u5f53\u671f\u79df\u79df\u5bb6\u6ca1\u6709\u80fd\u529b\u5c65\u884c\u5408\u540c\u65f6\uff0c\u539f\u8239\u4e1c\u9700\u627f\u62c5\u671f\u79df\u79df\u5bb6\u7684\u8d23\u4efb\u3002\u540c\u65f6\uff0c\u4e5f\u6ca1\u6709\u5145\u5206\u7684\u7406\u7531\u53ef\u4ee5\u89e3\u91ca\u4e3a\u4ec0\u4e48\u8231\u4f4d\u627f\u79df\u4eba\u7684\u63d0\u5355\u53ef\u4ee5\u7ea6\u675f\u539f\u8239\u4e1c\uff1b\u539f\u8239\u4e1c\u5e76\u6ca1\u6709\u6279\u51c6\u6216\u770b\u89c1\u63d0\u5355\uff0c\u539f\u8239\u4e1c\u4ec5\u627f\u62c5\u79df\u7ea6\u4e0b\uff0c\u671f\u79df\u79df\u5bb6\u4f9d\u636e\u79df\u7ea6\u88c5\u8d27\u800c\u4ea7\u751f\u7684\u8d23\u4efb\u3002<\/p>\n

\u56e0\u6b64\uff0c\u539f\u8239\u4e1c\u4e0e\u8231\u4f4d\u627f\u79df\u4eba\u4e4b\u95f4\u7684\u4efb\u4f55\u59d4\u6258\u5173\u7cfb\uff0c\u5fc5\u987b\u540c\u65f6\u53d7\u671f\u79df\u79df\u7ea6\u7ea6\u675f\u3002<\/p>\n

Owner under no duty to Slot charterer<\/strong><\/span><\/p>\n

We have many clients who enter into slot charter agreements and such agreements are increasingly common due to the poor shipping market which does not allow a liner operator to charter and load a complete vessel.<\/p>\n

It is however important for slot charterers of slots or space from the time charterers to be aware they have no contractual rights with the head owner and in the event the time charterers default under the time charterparty with the head owners enabling the head owners to withdraw the vessel, the slot charterers and cargo owners may find themselves in a difficult position.<\/p>\n

The foregoing circumstances was the subject of a case in the Hong Kong High Courts. In Sinokor v Owners of vessel ‘Marcatania’ (2008) the slot charterers required the head owners after they had withdrawn the vessel from the time charterers, to carry the containers onto their destination. The head owners refused.<\/p>\n

The bills of lading were issued by the slot charterers.<\/p>\n

It was held the head owners were not obliged to carry the containers onto destination. There was no contract between the head owners and the slot charterers and further the bills of lading were not issued by the head owners.<\/p>\n

The slot charterer’s argument failed that because the master supervised the loading and stowage of the containers, the head owners had entered into a contractual relationship with the slot charterer.<\/p>\n

The slot charterer’s additionally argued the head owners was a bailee and the terms of the bailment was subject to the slot charter agreement, and hence there was a duty for head owners not only to take reasonable care of the cargo, but also to complete the voyage and deliver the cargo. This was rejected by the Court as there was no privity of contract between the head owners and slot charterers and there was no legal or reasonable reason why the head owners should assume the liabilities of the time charterer if the time charterer was insolvent. There was also no good reason why the slot charterer’s bills of ladings should govern the terms of bailment of the head owners ; The head owners had not approved or sighted the bills of ladings and the head owner’s duties solely arose from the time charterparty allowing the time charterer to load cargo in accordance with the time charterparty.<\/p>\n

Accordingly any bailment owed by head owners to the slot charterers must have been also subject to the time charterparty.<\/p>\n

\u6cd5\u9662\u8ba4\u4e3a\uff0c\u539f\u8239\u4e1c\u6ca1\u6709\u5c06\u96c6\u88c5\u7bb1\u8fd0\u81f3\u76ee\u7684\u5730\u7684\u4e49\u52a1\u3002\u539f\u8239\u4e1c\u548c\u8231\u4f4d\u627f\u79df\u4eba\u4e4b\u95f4\u6ca1\u6709\u5408\u540c\u5173\u7cfb\uff0c\u5e76\u4e14\u63d0\u5355\u4e5f\u4e0d\u662f\u7531\u539f\u8239\u4e1c\u7b7e\u53d1\u7684\u3002 \u8231\u4f4d\u627f\u79df\u4eba\u8ba4\u4e3a\uff0c\u8239\u957f\u8d1f\u8d23\u76d1\u7763\u96c6\u88c5\u7bb1\u7684\u88c5\u8f7d\u548c\u79ef\u8f7d\uff0c\u539f\u8239\u4e1c\u4e0e\u96c6\u88c5\u7bb1\u8231\u4f4d\u627f\u79df\u4eba\u4e4b\u95f4\u6210\u7acb\u5408\u540c\u5173\u7cfb\uff0c\u4f46\u6cd5\u9662\u6ca1\u6709\u91c7\u7eb3\u8fd9\u4e00\u4e3b\u5f20\u3002
