\u62df\u8ba2\u7684\u534f\u4f1a\u62b5\u62bc\u6743\u4eba\u8239\u8236\u5229\u76ca\u4fdd\u9669\u6761\u6b3e\uff08Institute Mortgagees Interest Clauses-Hulls\uff0c\u4ee5\u4e0b\u7b80\u79f0IMI Clauses\uff09\uff0c\u5e76\u4e8e1997\u5e74\u4f5c\u4e86\u4fee\u8ba2\u3002<\/p>\n<p style=\"text-align: justify;\">\u4ee5\u4e0b\u662f\u62b5\u62bc\u6743\u4eba\u8239\u8236\u5229\u76ca\u4fdd\u96691997\u6761\u6b3e\u5217\u660e\u7684\u627f\u4fdd\u98ce\u9669\u5305\u62ec\uff1a<\/p>\n<ul style=\"text-align: justify;\">\n<li>\u88ab\u4fdd\u9669\u4eba\u6216\u5176\u4fdd\u9669\u4ee3\u7406\u4eba\u3001\u4fdd\u9669\u7ecf\u7eaa\u4eba\u7684\u8bef\u8ff0\uff08Misrepresentation\uff09\u6216\u672a\u5c65\u884c\u544a\u77e5\u4e49\u52a1\uff08Non-disclosure\uff09\uff1b<\/li>\n<li>\u8fdd\u53cd\u4efb\u4f55\u6cd5\u5b9a\u6216\u8005\u4efb\u4f55\u660e\u793a\u6216\u9ed8\u793a\u7684\u4fdd\u8bc1\u6216\u6761\u4ef6\uff0c\u5305\u62ec\u4f46\u4e0d\u9650\u4e8e\uff1a<\/li>\n<\/ul>\n<ol style=\"text-align: justify;\">\n<li>\u8fdd\u53cd\u9ed8\u793a\u7684\u4fdd\u8bc1\u6216\u8005\u9002\u822a\u6027\u6216\u5408\u6cd5\u6027\u7684\u4fdd\u8bc1\uff1b<\/li>\n<li>\u8fdd\u53cdMIA1906\u7b2c39\u6761\u7b2c5\u6b3e\u89c4\u5b9a\uff0c\u5373\u5728\u8239\u8236\u5b9a\u671f\u4fdd\u9669\u4e2d\uff0c\u88ab\u4fdd\u9669\u4eba\u5bf9\u8239\u8236\u7684\u4e0d\u9002\u822a\u72b6\u6001\u6709\u79c1\u8c0b\uff1b<\/li>\n<li>\u8fdd\u53cd\u4fdd\u5355\u4e2d\u7684\u822a\u533a\u4fdd\u8bc1\uff1b<\/li>\n<li>\u8fdd\u53cd\u4fdd\u5355\u4e2d\u7684\u6709\u5173\u8239\u8236\u8239\u7ea7\u7684\u4efb\u4f55\u4fdd\u8bc1\u6216\u6761\u4ef6\uff1b<\/li>\n<li>\u8fdd\u53cd\u4fdd\u5355\u4e2d\u7684\u6709\u5173\u68c0\u9a8c\u4fdd\u8bc1\u6216\u68c0\u9a8c\u8981\u6c42\uff1b<\/li>\n<li>\u8fdd\u53cd\u4fdd\u5355\u4e2d\u7684\u6709\u5173\u8239\u8236\u6240\u6709\u6743\u3001\u8239\u65d7\u3001\u7ba1\u7406\u6216\u5149\u79df\u7684\u4fdd\u8bc1\u6216\u6761\u4ef6\u3002<\/li>\n<\/ol>\n<ul style=\"text-align: justify;\">\n<li>\u88ab\u62b5\u62bc\u8239\u8239\u4e1c\u6216\u8239\u8236\u7ba1\u7406\u4eba\u672a\u5c31\u88ab\u62b5\u62bc\u8239\u8236\u7684\u706d\u5931\u6216\u635f\u574f\u4f5c\u8c28\u614e\u5904\u7406\uff1b<\/li>\n<li>\u6545\u610f\u6216\u6076\u610f\u9020\u6210\u88ab\u62b5\u62bc\u8239\u8236\u706d\u5931\u6216\u635f\u574f\uff1b<\/li>\n<li>\u8fdd\u53cd\u8bda\u4fe1\u4e49\u52a1\uff1b<\/li>\n<li>\u5411\u8239\u8236\u4fdd\u9669\u4eba\u6216\u4fdd\u8d54\u4fdd\u9669\u4eba\u7d22\u8d54\u8d85\u8fc7\u65f6\u6548\u6216\u65f6\u9650\uff1b<\/li>\n<li>\u65e0\u6cd5\u4e3e\u8bc1\u88ab\u62b5\u62bc\u8239\u8236\u5168\u635f\u662f\u67d0\u4e00\u5217\u660e\u98ce\u9669\u6240\u81f4\uff1b<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">&lt;\u4ec0\u4e48\u662f\u62b5\u62bc\u6743\u4eba\u989d\u5916\u6cb9\u6c61\u4fdd\u9669&gt;<\/p>\n<p style=\"text-align: justify;\">\u6cb9\u6c61\u4e8b\u6545\u5f88\u5bb9\u6613\u5f15\u81f4\u975e\u5e38\u5e9e\u5927\u7684\u7d22\u8d54\u91d1\u989d\uff0c\u5047\u5982\u53d7\u5bb3\u4eba\u7684\u635f\u5931\u8d85\u51fa\u8239\u4e1c\u4fdd\u8d54\u9669\u7684\u8d54\u507f\u9650\u989d\uff0c\u53d7\u5bb3\u4eba\u53ef\u4ee5\u5bf9\u8239\u8236\u4eab\u6709\u4f18\u5148\u6743\u4ee5\u8865\u507f\u8d85\u989d\u7684\u635f\u5931\uff0c\u56e0\u6b64\u5bfc\u81f4\u62b5\u62bc\u6743\u4eba\u7684\u5229\u76ca\u53d7\u5230\u4e86\u4e25\u91cd\u7684\u635f\u5bb3\u3002\u8fd9\u79cd\u5f71\u54cd\u4e5f\u53ef\u4ee5\u6765\u81ea\u62b5\u62bc\u8239\u8236\u7684\u59ca\u59b9\u8239\u7684\u6cb9\u6c61\u4e8b\u6545\uff0c\u56e0\u4e3a\u53d7\u5bb3\u4eba\u4e5f\u53ef\u4ee5\u6263\u62bc\u5f53\u4e8b\u8239\u8236\u7684\u59ca\u59b9\u8239\uff0c\u4e00\u65b9\u9762\u8239\u4e1c\u56e0\u8239\u8236\u88ab\u6263\u62bc\u800c\u96be\u4ee5\u5411\u62b5\u62bc\u6743\u4eba\u5c65\u884c\u8fd8\u6b3e\u4e49\u52a1\uff0c\u53e6\u4e00\u65b9\u9762\u59ca\u59b9\u8239\u751a\u81f3\u88ab\u62cd\u5356\uff0c\u4f7f\u62b5\u62bc\u6743\u4eba\u7684\u5229\u76ca\u5f97\u4e0d\u5230\u4fdd\u62a4\u3002\u6545\u6b64\u62b5\u62bc\u6743\u4eba\u53ef\u4ee5\u8d2d\u4e70\u62b5\u62bc\u6743\u4eba\u989d\u5916\u6cb9\u6c61\u4fdd\u9669\u6765\u4fdd\u969c\u8fd9\u5de8\u5927\u7684\u98ce\u9669\u3002<\/p>\n<p style=\"text-align: justify;\">\u4ee5\u4e0a\u7531 ANDREW LIU &amp; color: #022469;\"><strong>Introduction of Mortgagees&#8217; Interest Insurance-Hulls<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">Shipowners, when they deal with the banks or leasing companies to arrange the mortgage, may have been requested by their mortgagee to purchase or pay for the Mortgagees&#8217; Interested Insurance. We are pleased to provide a brief introduction about this insurance to let shipowners have better understanding of its coverage.<\/p>\n<p style=\"text-align: justify;\">The Mortgagees&#8217; Interest Insurance was designed when people understood that the traditional marine insurance policy could not provide sufficient protection to the mortgagees&#8217; interest. The Mortgagees&#8217; Interest Insurance (MII) is an insurance specially designed for mortgagees&#8217; interest. The mortgagee is the insured on the policy and the mortgagees&#8217; interest is the insured subject. It covers the loss of the mortgagee when he \/ she lose the right of to obtain the reimbursement in according to the loss payable clause from the shipowner&#8217;s H&amp;M or P&amp;I insurers.<\/p>\n<p style=\"text-align: justify;\">MII is the second layer of protection to mortgagee. The first layer is the shipowner&#8217;s H&amp;M or P&amp;I insurance. Only when this first layer of protection fails to reimburse the claims due to the insured indemnity, the MII policy will be triggered to indemnify the mortgagees for their loss. It provides sufficient protection for mortgagee&#8217;s interests. In principal, due to the act or omission of the insure(s) on the H&amp;M or P&amp;I policy can lead to a claim arising by insured peril uncovered.<\/p>\n<p style=\"text-align: justify;\">Lloyd&#8217;s Market, as a World&#8217;s insurance centre, has been provided mortgagee interest insurance clauses since 1986. The Joint Hull Committee has speculated Institute Mortgagees Interest Clauses \u2013 Hulls (IMI Clauses) which was revised in 1997.<\/p>\n<p style=\"text-align: justify;\">The insured perils under IMI Clauses 1997 include:<\/p>\n<ul style=\"text-align: justify;\">\n<li>A misrepresentation or non-disclosure of any material circumstance from the assured or any of such assured&#8217;s insurance agents or insurance brokers;<\/li>\n<li>Breach of any statutory provision or any express or implied promissory warranty or conditions, including without limitation:<\/li>\n<\/ul>\n<ol style=\"text-align: justify;\">\n<li>breach of any implied warranty or seaworthiness or legality<\/li>\n<li>breach of Section 39(5) of the Marine Insurance Act of 1906, i.e. in a time policy, with the privity of the assured, the ship is sent to sea in an unseaworthy state<\/li>\n<li>breach of trading warranties contained in any of the Owners&#8217; Policies and Club Entries<\/li>\n<li>breach of any warranty or condition in respect of the classification of the Mortgaged Vessel by a Classification Society<\/li>\n<li>breach of any warranty or condition in any of the Owners&#8217; Policies and Club Entries which requires compliance with any condition survey, structural survey or P&amp;I Club survey requirements<\/li>\n<li>breach of any warranty or condition in respect of the Ownership, flag, management or charter on a bareboat basis of the Mortgaged Vessel<\/li>\n<\/ol>\n<ul style=\"text-align: justify;\">\n<li>Failure of the assured to exercise due diligence in respect of any loss or damage to the Mortgaged Vessel<\/li>\n<li>Any deliberate or fraudulent casting away of or damage to the Mortgaged Vessel<\/li>\n<li>Breach of duty of good faith<\/li>\n<li>The operation of any applicable provision which provides for a time limitation on the presentation of claims<\/li>\n<li>The loss has not been proved to have been proximately caused by a peril insured<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Mortgagees Interest and\/or Mortgagees Interest Additional Perils \u2013 Oil Pollutions<\/p>\n<p style=\"text-align: justify;\">Oil pollutions can lead to big claims. Once the loss of victim is in excess the limit of insurance, the victim can exercise liens against the vessel to indemnify the loss in excess. Therefore, the interest of mortgagee would be significantly influenced and this influence can be caused by the oil pollutions from sister ships as well. As the victim can arrest the sister ship of the captioned vessel and once the ship is arrested, it is difficult for shipowners to perform the payment liability. On the other side, sister ship may be auctioned and mortgagees&#8217; interested is unable to be properly protected.
