New Commonwealth laws have come into effect which extend strict liability for oil pollution to Charterers and increase penalties fortyfold.<\/p>\n

Recent amendments to the Protection of the Sea (Prevention of Pollution from Ships) Act 1983 (Cth) ( “the Act” ) extend the present strict liability offence for the discharge of oil or an oily mixture from a ship into the sea from the Master and Owner of a ship to the Charterer of a ship. Under current common law, this will most likely extend to bareboat, time and voyage charterers.<\/p>\n

The extension of strict liability to the Charterer of a ship represents a novel departure from the existing and well settled law in Australia. Previously and in conformity with the position in many similar jurisdictions, Australian law provided for strict liability of the Master and Owner in the event of a discharge of oil or oily mixture from a ship. The offence is a criminal offence and will be found regardless of any actual fault on the part of the Master or Owner.<\/p>\n

In our view, the above provisions are more appropriately directed at deterrence, by seeking to impose liability on those who have some real and relevant connection with the act or event which causes a discharge of oil.<\/p>\n

At present, we are not aware of the intention of any of the States or Territories to make similar amendments. For now, the new offence for Charterers will only apply to oil pollution incidents occurring in Commonwealth waters outside of 3 Nm from Australia’s coastline.<\/p>\n

The amendments also increase the penalties for oil pollution, from A$275,000 to A$11 million for a corporation. Although the increase at first appears rather severe, it should be noted that the increase now brings the penalties for the discharge of oil in Commonwealth waters into line with those applicable to the discharge of oil in the waters of most States.<\/p>\n

Conclusion<\/p>\n

Prior to the amendments, Australian law provided that the Master and Owner of a ship were liable for the discharge of oil, regardless of any fault on their part. Australian law further provided that any crew member or other person involved in the operation or maintenance of a ship and whose act caused a discharge was also liable. It is therefore essential that all Charterers operating in Australian waters review their insurance arrangements; risk management practices, including screening of Owners, operators and manning agents responsible for chartered vessels; and consider drafting additional charterparty clauses to deal with this new exposure.<\/p>\n

\u300a1983\u5e74\u6d77\u6d0b\u4fdd\u62a4\u6cd5\uff08\u9632\u6b62\u8239\u8236\u6c61\u67d3\uff09\u300b\u8fd1\u671f\u7684\u4fee\u6b63\u6848\u5c06\u76ee\u524d\u627f\u62c5\u6cb9\u6216\u6cb9\u6027\u6df7\u5408\u7269\u6cc4\u6f0f\u81f3\u6d77\u6d0b\u4e2d\u7684\u4e25\u683c\u8d23\u4efb\u7684\u8303\u56f4\uff0c\u4ece\u8239\u957f\u3001\u8239\u4e1c\u6269\u5927\u5230\u79df\u5bb6\u3002\u73b0\u884c\u666e\u901a\u6cd5\u4e0b\uff0c\u8fd9\u4e00\u4e25\u683c\u8d23\u4efb\u5c06\u5f88\u53ef\u80fd\u6269\u5927\u5230\u5149\u79df\u3001\u671f\u79df\u53ca\u7a0b\u79df\u7684\u79df\u5bb6\u8eab\u4e0a\u3002<\/p>\n

\u5c06\u4e25\u683c\u8d23\u4efb\u6269\u5927\u5230\u79df\u5bb6\u8eab\u4e0a\uff0c\u80cc\u79bb\u4e86\u6fb3\u5927\u5229\u4e9a\u73b0\u884c\u6cd5\u5f8b\u7684\u660e\u786e\u89c4\u5b9a\u3002\u4e4b\u524d\u7684\u6fb3\u5927\u5229\u4e9a\u6cd5\u5f8b\u4e0e\u8bb8\u591a\u76f8\u4f3c\u53f8\u6cd5\u8f96\u533a\u4fdd\u6301\u4e00\u81f4\uff0c\u89c4\u5b9a\u5982\u679c\u6cb9\u6216\u6cb9\u6027\u6df7\u5408\u7269\u4ece\u8239\u4e0a\u6cc4\u6f0f\u81f3\u6d77\u6d0b\u4e2d\uff0c\u8239\u4e1c\u548c\u8239\u957f\u627f\u62c5\u4e25\u683c\u8d23\u4efb\u3002\u8be5\u884c\u4e3a\u5c5e\u4e8e\u5211\u4e8b\u72af\u7f6a\uff0c\u65e0\u8bba\u8239\u4e1c\u6216\u8239\u957f\u662f\u5426\u6709\u5b9e\u9645\u8fc7\u9519\u90fd\u9700\u8981\u627f\u62c5\u8d23\u4efb\u3002<\/p>\n

\u6211\u4eec\u8ba4\u4e3a\uff0c\u4e0a\u8ff0\u89c4\u5b9a\u529b\u56fe\u901a\u8fc7\u5c06\u8d23\u4efb\u5f3a\u52a0\u4e8e\u90a3\u4e9b\u4e0e\u5f15\u8d77\u6f0f\u6cb9\u7684\u884c\u4e3a\u6216\u4e8b\u4ef6\u6709\u5b9e\u9645\u548c\u76f8\u5173\u8054\u7cfb\u7684\u4eba\u8eab\u4e0a\uff0c\u4ee5\u6b64\u8d77\u5230\u5a01\u6151\u7684\u4f5c\u7528\u3002<\/p>\n

\u76ee\u524d\uff0c\u6211\u4eec\u8fd8\u6ca1\u6709\u53d1\u73b0\u4efb\u4f55\u5176\u4ed6\u5dde\u548c\u5730\u533a\u6709\u5236\u5b9a\u7c7b\u4f3c\u6cd5\u6848\u7684\u610f\u56fe\u3002\u73b0\u5728\uff0c\u9488\u5bf9\u79df\u5bb6\u7684\u65b0\u6761\u6b3e\u4ec5\u9002\u7528\u4e8e\u6fb3\u5927\u5229\u4e9a\u6d77\u5cb8\u7ebf\u59163\u6d77\u91cc\u7684\u8054\u90a6\u6c34\u57df\u4e2d\u53d1\u751f\u7684\u6cb9\u6c61\u4e8b\u4ef6\u3002<\/p>\n

\u4fee\u6b63\u6848\u8fd8\u52a0\u5927\u4e86\u6cb9\u6c61\u7f5a\u6b3e\uff0c\u5bf9\u516c\u53f8\u7684\u7f5a\u6b3e\u4ece275,000\u6fb3\u5143\u589e\u52a0\u52301100\u4e07\u6fb3\u5143\u3002\u5c3d\u7ba1\u6b64\u6b21\u7f5a\u6b3e\u589e\u52a0\u4e4d\u770b\u662f\u6bd4\u8f83\u82db\u523b\u7684\uff0c\u4f46\u503c\u5f97\u6ce8\u610f\u7684\u662f\u8fd9\u6b21\u589e\u52a0\u7684\u7f5a\u6b3e\u4f7f\u8054\u90a6\u6c34\u57df\u6f0f\u6cb9\u7f5a\u6b3e\u6570\u989d\u4e0e\u9002\u7528\u4e8e\u5927\u591a\u6570\u5dde\u7684\u6c34\u57df\u6f0f\u6cb9\u7f5a\u6b3e\u4fdd\u6301\u4e00\u81f4\u3002<\/p>\n

\u7ed3\u8bba<\/p>\n

\u5728\u8be5\u4fee\u6b63\u6848\u4e4b\u524d\uff0c\u6fb3\u5927\u5229\u4e9a\u6cd5\u5f8b\u89c4\u5b9a\uff0c\u8239\u957f\u548c\u8239\u4e1c\u5bf9\u6f0f\u6cb9\u8d1f\u6709\u8d23\u4efb\uff0c\u65e0\u8bba\u4ed6\u4eec\u662f\u5426\u6709\u8fc7\u9519\u3002\u6fb3\u5927\u5229\u4e9a\u6cd5\u5f8b\u8fdb\u4e00\u6b65\u89c4\u5b9a\uff0c\u6d89\u53ca\u64cd\u4f5c\u6216\u7ef4\u62a4\u8239\u8236\u7684\u4efb\u4f55\u8239\u5458\u6216\u8005\u5176\u4ed6\u4eba\u5458\uff0c\u4ee5\u53ca\u5176\u884c\u4e3a\u5f15\u8d77\u6cc4\u6f0f\u7684\u4eba\uff0c\u90fd\u5bf9\u6b64\u8d1f\u6709\u8d23\u4efb\u3002<\/p>\n

\u8be5\u4fee\u6b63\u6848\u628a\u79df\u5bb6\u5217\u5165\u627f\u62c5\u6cb9\u6c61\u8d23\u4efb\u7684\u8303\u56f4\u4e4b\u4e2d\uff0c\u800c\u65e0\u8bba\u5176\u662f\u5426\u6709\u8fc7\u9519\u3002\u4fee\u6b63\u6848\u4f3c\u4e4e\u5e76\u4e0d\u7b26\u5408\u5bf9MARPOL\u516c\u7ea6\u76ee\u7684\u7684\u9002\u5f53\u8003\u8651\u6216\u8005\u603b\u4f53\u5a01\u6151\u6027\u8003\u8651\u3002\u56e0\u4e3a\u4e8b\u5b9e\u4e0a\uff0c\u5728\u5927\u591a\u6570\u60c5\u51b5\u4e0b\uff0c\u79df\u5bb6\u5bf9\u53ef\u80fd\u5bfc\u81f4\u6cb9\u6c61\u7684\u64cd\u4f5c\u548c\u884c\u4e3a\u7684\u63a7\u5236\u529b\u5f88\u5c0f\u3002<\/p>\n

\u56e0\u6b64\uff0c\u79df\u5bb6\u9762\u4e34\u7684\u6cb9\u6c61\u8d23\u4efb\u5728\u4e00\u591c\u4e4b\u95f4\u4ece0\u6fb3\u5143\u589e\u52a0\u5230\u4e861100\u4e07\u6fb3\u5143\u3002\u5728\u6fb3\u5927\u5229\u4e9a\u6c34\u57df\u8fd0\u8425\u8239\u8236\u7684\u6240\u6709\u79df\u5bb6\uff0c\u5fc5\u987b\u91cd\u65b0\u68c0\u67e5\u4ed6\u4eec\u7684\u4fdd\u9669\u5b89\u6392\u548c\u98ce\u9669\u7ba1\u7406\u5b9e\u8df5\uff0c\u5305\u62ec\u4e3a\u6240\u79df\u7684\u8239\u8236\u7b5b\u9009\u8239\u4e1c\u3001\u8425\u8fd0\u4eba\u548c\u8239\u5458\u4ee3\u7406\u516c\u53f8\uff1b\u8003\u8651\u8d77\u8349\u9644\u52a0\u79df\u7ea6\u6761\u6b3e\u4ee5\u5e94\u5bf9\u8fd9\u4e00\u65b0\u89c4\u5b9a\u3002<\/p>\n
