{"id":10699,"date":"2012-03-06T03:24:30","date_gmt":"2012-03-06T03:24:30","guid":{"rendered":"http:\/\/192.168.1.14\/index.php\/2012\/03\/06\/deck-cargo-clauses-in-charterparties\/"},"modified":"2025-09-01T01:21:49","modified_gmt":"2025-08-31T17:21:49","slug":"deck-cargo-clauses-in-charterparties","status":"publish","type":"post","link":"https:\/\/andrewliu.com.hk\/zh\/deck-cargo-clauses-in-charterparties\/","title":{"rendered":"Deck Cargo Clauses in Charterparties"},"content":{"rendered":"<p><span style=\"text-align: justify;\">&nbsp;<\/span><img decoding=\"async\" class=\"size-full wp-image-9071\" src=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2010\/06\/pdf.png\" alt=\"pdf\" width=\"16\" height=\"16\" style=\"padding: 0px; outline: 0px; text-align: justify;\" \/><span style=\"text-align: justify;\">&nbsp;<\/span><a href=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2012\/03\/B191_ALCO20120013Deck-Cargo-Clauses-in-Charterparties.pdf\" style=\"padding: 0px; border: 0px; outline: 0px; text-align: justify;\">ENG<\/a>&nbsp; &nbsp;<img decoding=\"async\" class=\"size-full wp-image-9071\" src=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2010\/06\/pdf.png\" alt=\"pdf\" width=\"16\" height=\"16\" style=\"padding: 0px; outline: 0px; text-align: justify;\" \/><span style=\"text-align: justify;\">&nbsp;<\/span><a href=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2012\/03\/B191_ALCO20120013Deck-Cargo-Clauses-in-Charterparties-chi.pdf\" style=\"padding: 0px; border: 0px; outline: 0px; text-align: justify;\">\u4e2d\u6587<\/a><span style=\"text-align: justify;\">&nbsp;&nbsp;<\/span><\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">A charterparty would usually contain a rider clause excluding the owner&#8217;s liability for deck carriage of cargo, such as :<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">&#8220;Any loss\/damage\/liability of whatsoever nature caused to the vessel as a result of carriage of cargo on deck to be fully borne by the charterers which would not have arisen had deck cargo not been loaded.&#8221;<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">In the case of Onego Shipping v Arcadia Shipping (2010), one of the cause of loss of cargo on deck was the vessel&#8217;s instability as a result of loading an extra tier of timber.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">The owners sought to be indemnified for liability for the cargo loss from the charterers in accordance with such a rider clause in the charterparty transferring all deck cargo liability to the charterers, but the charterers argued the cause of the loss was the vessel&#8217;s fault and the rider clause transferring deck cargo liability onto the charterers did not apply.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">It was held the rider clause was not sufficiently clear and certain to be extended to include the owners&#8217; and or crew&#8217;s negligence and the rider clause did not transfer liability for the deck cargo loss to the charterers if this loss was caused by the vessel&#8217;s negligence or the vessel&#8217;s unseaworthiness. Reference was made to the test stated in the case of Canada SS (1952), which provided that exclusion clauses unless the wording is clear do not encompass a party&#8217;s negligence, and further the interpretation of the clause is construed against the party in which the exclusion clause was intended to benefit.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">To ensure the owners receive a full and complete indemnity arising from such deck cargo clauses in charterparties, these clauses should be reviewed and amended to encompass the vessel&#8217;s negligence.<\/p>\n<p><span style=\"text-align: justify;\"><\/span><\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u79df\u7ea6\u4e2d\u901a\u5e38\u4f1a\u6709\u9644\u52a0\u6761\u6b3e\uff0c\u514d\u9664\u8239\u4e1c\u5bf9\u7532\u677f\u8d27\u7684\u8d23\u4efb\uff0c\u4f8b\u5982\uff1a<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">&#8220;\u56e0\u8fd0\u8f93\u7532\u677f\u8d27\u5bfc\u81f4\u8239\u8236\u4efb\u4f55\u6027\u8d28\u7684\u635f\u5931\/\u635f\u5bb3\/\u8d23\u4efb\u5168\u90e8\u7531\u8239\u4e1c\u627f\u62c5\uff0c\u5982\u679c\u6ca1\u6709\u88c5\u8f7d\u7532\u677f\u8d27\uff0c\u4e0a\u8ff0\u635f\u5931\u4e0d\u4f1a\u53d1\u751f\u3002&#8221;<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">Onego Shipping v Arcadia Shipping (2010)\u4e00\u6848\u4e2d\uff0c\u7532\u677f\u8d27\u635f\u5931\u7684\u539f\u56e0\u4e4b\u4e00\u662f\u88c5\u8f7d\u8fc7\u591a\u7684\u6728\u6750\uff0c\u5bfc\u81f4\u8239\u8236\u7a33\u5b9a\u6027\u4e0d\u826f\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u6839\u636e\u79df\u7ea6\u4e2d\u7684\u9644\u52a0\u6761\u6b3e\uff0c\u8239\u4e1c\u53ef\u4ee5\u4ece\u79df\u5bb6\u8eab\u4e0a\u83b7\u5f97\u8d27\u635f\u8d54\u507f\uff0c\u5c06\u6240\u6709\u7684\u7532\u677f\u8d27\u8d23\u4efb\u8f6c\u5ac1\u5230\u79df\u5bb6\u8eab\u4e0a\u3002\u4f46\u662f\u79df\u5bb6\u8ba4\u4e3a\uff0c\u635f\u5931\u7684\u539f\u56e0\u662f\u8239\u8236\u672c\u8eab\u7684\u95ee\u9898\uff0c\u4e0d\u9002\u7528\u9644\u52a0\u6761\u6b3e\u5c06\u7532\u677f\u8d27\u8d23\u4efb\u8f6c\u5ac1\u5230\u79df\u5bb6\u8eab\u4e0a\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u6cd5\u9662\u8ba4\u4e3a\uff0c\u9644\u52a0\u6761\u6b3e\u4e0d\u591f\u6e05\u695a\u548c\u786e\u5b9a\u662f\u5426\u5305\u62ec\u8239\u4e1c\u548c\/\u6216\u8239\u5458\u758f\u5ffd\uff0c\u5e76\u4e14\u5982\u679c\u635f\u5931\u7531\u4e8e\u8239\u8236\u758f\u5ffd\u6216\u4e0d\u9002\u822a\u5f15\u8d77\uff0c\u9644\u52a0\u6761\u6b3e\u4e0d\u80fd\u8f6c\u5ac1\u7532\u677f\u8d27\u635f\u5931\u8d23\u4efb\u7ed9\u79df\u5bb6\u3002\u6cd5\u9662\u63f4\u5f15 Canada SS (1952) \u4e00\u6848\u7684\u6807\u51c6\uff1a\u9664\u975e\u660e\u786e\u89c4\u5b9a\uff0c\u5426\u5219\u514d\u8d23\u6761\u6b3e\u4e0d\u9002\u7528\u4e8e\u4e00\u65b9\u5b58\u5728\u758f\u5ffd\u7684\u60c5\u51b5\uff0c\u5e76\u4e14\u6761\u6b3e\u7684\u89e3\u91ca\u5c06\u4e0d\u5229\u4e8e\u514d\u8d23\u6761\u6b3e\u8bd5\u56fe\u4fdd\u62a4\u7684\u4e00\u65b9\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u56e0\u6b64\uff0c\u5728\u79df\u7ea6\u7532\u677f\u8d27\u6761\u6b3e\u4e0b\uff0c\u4e3a\u786e\u4fdd\u8239\u4e1c\u83b7\u5f97\u5168\u9762\u548c\u5b8c\u5168\u7684\u8d54\u507f\uff0c\u5e94\u5ba1\u67e5\u548c\u4fee\u6539\u8fd9\u4e9b\u6761\u6b3e\u4f7f\u4e4b\u5305\u62ec\u8239\u8236\u758f\u5ffd\u3002<\/p>\n<p style=\"border: 0px;
