US v Canal Barge Co (2011) \u4e00\u6848\u4e2d\uff0c\u4e00\u8258\u9a73\u8239\u8239\u58f3\u51fa\u73b0\u4e00\u6761\u88c2\u7f1d\uff0c\u5e76\u91c7\u53d6\u4e86\u4e34\u65f6\u6027\u4fee\u7406\u3002\u8fd9\u4e00\u4e8b\u4ef6\u548c\u4e34\u65f6\u88c2\u7f1d\u4fee\u7406\u90fd\u6ca1\u6709\u4e0a\u62a5\u7ed9\u7f8e\u56fd\u6d77\u5cb8\u8b66\u536b\u961f\u3002\u8be5\u4e34\u65f6\u6027\u4fee\u7406\u968f\u540e\u51fa\u73b0\u4e86\u95ee\u9898\uff0c\u5bfc\u81f4\u82ef\u8d27\u7269\u6f0f\u51fa\u8239\u4f53\uff0c\u7f8e\u56fd\u6d77\u5cb8\u8b66\u536b\u961f\u968f\u5373\u53d1\u73b0\u4e86\u8be5\u88c2\u7f1d\u7684\u76f8\u5173\u60c5\u51b5\u3002<\/p>\n

Consequences of Negligent and criminal failure to report in the US<\/strong><\/span><\/p>\n

USCG under the Ports and Waterways Safety Act require any vessel to notify any \u2018hazardous condition on board’. There is additional responsibility to send a written report to USCG.<\/p>\n

A hazardous condition includes any condition that may adversely affect the safety of the vessel or the environment, port, waterway, harbor, and a casualty such as a collision or grounding is not necessary for a hazardous condition to exist on board.<\/p>\n

A negligent failure to report a hazardous condition may be subject to a civil prosecution. A willful or knowing failure to report a hazardous condition may be subject to a criminal prosecution and will include criminal charges against the owner and the crew.<\/p>\n

In the case of US v Canal Barge Co (2011), a barge had a crack in her hull and temporary repairs were carried out. This incident and the temporarily repaired crack was not reported to the USCG. The USCG found out about the circumstances of the crack<\/p>\n

It was held all the defendants were criminally liable as they knowingly and willfully failed to report the crack. In coming to this conclusion, it was taken into account there was a breach of the company’s vessel response plan which required the reporting of such an incident and spill, and there was a failure by the master to mention the crack, repairs and spill in the vessel’s logs.<\/p>\n

It is important the vessel’s crew is trained to understand US reporting requirements and the consequences of such failures or breaches.<\/p>\n
