<\/span><\/p>\n

The case of (The Kyzikos) (1989) is a House of Lords decision which held the exception clause should only apply where the unavailability of the berth is the sole reason the vessel cannot enter berth. Accordingly the words ‘Whether in berth or not’ should apply only to cases where a berth is not available and not also to cases where a berth is available but is not reachable due to bad weather. In other words NOR can be served when a berth is not available, but cannot be served when a berth is not available which is not reachable due to bad weather.<\/p>\n

<\/span><\/p>\n

A case in 2011 (The Hang Ta) is an interesting case with similar circumstances but concerning a cargo sales contract (and not a voyage charterparty) including the words WIBON. On that voyage, the vessel arrived at the discharge port of Amsterdam and tendered NOR. The berth was occupied but the vessel would also have been prevented from entering into berth due to bad weather conditions.<\/p>\n

<\/span><\/p>\n

The buyer’s position was that since the berth was unavailable because it was both occupied and inaccessible due to bad weather, the NOR was invalid in reliance on the judgement in The Kyzikos case.<\/p>\n

<\/span><\/p>\n

The seller’s argument was simply that if the vessel cannot reach berth due to the berth being occupied and due to bad weather, the NOR can be tendered if the weather lifts before the berth becomes available.<\/p>\n

<\/span><\/p>\n

Judgement was given in favour of the sellers. It is noteworthy there is a difference in interpretation under a voyage charterparty and under a sales contract. Under a voyage charterparty the NOR could be tendered if the sole cause of the delay was berth unavailability. Under a sales contract, the NOR could be tendered if the proximate cause of the delay was berth unavailability.<\/p>\n

The Kyzikos (1989) \u662f\u4e0a\u8bae\u9662\u5224\u51b3\u7684\u4e00\u4e2a\u6848\u5b50\uff0c\u6cd5\u9662\u8ba4\u4e3a\u514d\u8d23\u6761\u6b3e\u53ea\u9002\u7528\u4e8e\u6cca\u4f4d\u4e0d\u53ef\u7528\u662f\u4f7f\u8239\u8236\u4e0d\u80fd\u9760\u6cca\u7684\u552f\u4e00\u539f\u56e0\u7684\u60c5\u51b5\u3002\u56e0\u6b64\uff0c”\u4e0d\u8bba\u9760\u6cca\u4e0e\u5426” \u6761\u6b3e\uff0c\u53ea\u9002\u7528\u4e8e\u6cca\u4f4d\u4e0d\u53ef\u7528\u7684\u60c5\u51b5\uff0c\u800c\u4e0d\u9002\u7528\u4e8e\u6cca\u4f4d\u53ef\u7528\uff0c\u4f46\u56e0\u6076\u52a3\u5929\u6c14\u4f7f\u8239\u8236\u4e0d\u80fd\u9760\u6cca\u7684\u60c5\u51b5\u3002\u4e5f\u5c31\u8bf4\uff0c\u5f53\u6cca\u4f4d\u4e0d\u53ef\u7528\u65f6\uff0c\u53ef\u4ee5\u9012\u4ea4\u88c5\u5378\u51c6\u5907\u5c31\u7eea\u901a\u77e5\u4e66\uff0c\u800c\u56e0\u6076\u52a3\u5929\u6c14\u4f7f\u6cca\u4f4d\u4e0d\u53ef\u7528\u65f6\uff0c\u5c31\u4e0d\u80fd\u9012\u4ea4\u88c5\u5378\u51c6\u5907\u5c31\u7eea\u901a\u77e5\u4e66\u3002<\/p>\n

2011\u5e74 The Hang Ta \u4e00\u6848\u662f\u4e00\u4e2a\u7c7b\u4f3c\u7684\u6709\u8da3\u6848\u4f8b\u3002\u8be5\u6848\u6709\u5173\u8d27\u7269\u9500\u552e\u5408\u540c\uff08\u975e\u822a\u6b21\u79df\u7ea6\uff09\uff0c\u5408\u540c\u4e2d\u8ba2\u660e\u4e86”\u4e0d\u8bba\u9760\u6cca\u4e0e\u5426”\uff08WIBON\uff09\u6761\u6b3e\u3002\u8be5\u822a\u6b21\u4e2d\uff0c\u8239\u8236\u5230\u8fbe\u5378\u8d27\u6e2f\u2014\u963f\u59c6\u65af\u7279\u4e39\uff08Amsterdam\uff09\uff0c\u5e76\u63d0\u4ea4\u4e86\u88c5\u5378\u51c6\u5907\u5c31\u7eea\u901a\u77e5\u4e66\u3002\u5f53\u65f6\u6cca\u4f4d\u62e5\u6324\uff0c\u540c\u65f6\u8239\u8236\u4e5f\u56e0\u6076\u52a3\u5929\u6c14\u72b6\u51b5\u800c\u4e0d\u80fd\u9760\u6cca\u3002<\/p>\n

\u4e70\u65b9\u7acb\u573a\u662f\uff0c\u65e2\u7136\u56e0\u6cca\u4f4d\u62e5\u6324\u548c\u6076\u52a3\u5929\u6c14\u4f7f\u6cca\u4f4d\u4e0d\u53ef\u7528\uff0c\u90a3\u4e48\u4f9d\u636e The Kyzikos \u4e00\u6848\u7684\u5224\u51b3\uff0c\u88c5\u5378\u51c6\u5907\u5c31\u7eea\u901a\u77e5\u4e66\u65e0\u6548\u3002<\/p>\n

\u5356\u65b9\u5219\u8ba4\u4e3a\uff0c\u5982\u679c\u8239\u8236\u7531\u4e8e\u6cca\u4f4d\u62e5\u6324\u548c\u6076\u52a3\u5929\u6c14\u4e0d\u80fd\u9760\u6cca\uff0c\u90a3\u4e48\u53ea\u8981\u5728\u6cca\u4f4d\u53ef\u7528\u524d\u5929\u6c14\u653e\u6674\u4e86\uff0c\u5c31\u53ef\u4ee5\u63d0\u4ea4\u88c5\u5378\u51c6\u5907\u5c31\u7eea\u901a\u77e5\u4e66\u3002<\/p>\n

\u6cd5\u9662\u652f\u6301\u5356\u65b9\u4e3b\u5f20\u3002\u503c\u5f97\u6ce8\u610f\u7684\u662f\uff0c\u822a\u6b21\u79df\u7ea6\u548c\u9500\u552e\u5408\u540c\u5bf9\u540c\u4e00\u95ee\u9898\u7684\u89e3\u91ca\u5b58\u5728\u5dee\u522b\u3002\u822a\u6b21\u79df\u7ea6\u89c4\u5b9a\uff0c\u5982\u679c\u6cca\u4f4d\u4e0d\u53ef\u7528\u662f\u5bfc\u81f4\u5ef6\u8fdf\u7684\u552f\u4e00\u539f\u56e0\uff0c\u53ef\u4ee5\u9012\u4ea4\u88c5\u5378\u51c6\u5907\u5c31\u7eea\u901a\u77e5\u4e66\u3002\u800c\u9500\u552e\u5408\u540c\u89c4\u5b9a\uff0c\u5982\u679c\u6cca\u4f4d\u4e0d\u53ef\u7528\u662f\u5bfc\u81f4\u5ef6\u8fdf\u7684\u8fd1\u56e0\uff0c\u53ef\u4ee5\u9012\u4ea4\u88c5\u5378\u51c6\u5907\u5c31\u7eea\u901a\u77e5\u4e66\u3002<\/p>\n
