\u6700\u8fd1\u6709\u4e0d\u5c11\u5ba2\u6237\u95ee\u5230\u76f8\u7c7b\u4f3c\u7684\u95ee\u9898\uff0c\u5373\u5f53\u8239\u8236\u5230\u957f\u6c5f\u6cbf\u5cb8\u7684\u6e2f\u53e3\u6216\u6cca\u4f4d\u5378\u8d27\u65f6\uff0c\u5728\u4e0a\u6d77\u6e2f\u951a\u5730\u5ef6\u8fdf\u4e86\uff0c\u5728\u8fd9\u79cd\u60c5\u51b5\u4e0b\u5982\u4f55\u8d77\u7b97\u5378\u8d27\u65f6\u95f4\uff1f<\/p>\n

\u6700\u8fd1\u6709\u4e2a\u7f8e\u56fd\u7684\u4ef2\u88c1\u6848\uff0c\u5c31\u6709\u5173\u8239\u8236\u5728\u4e0a\u6d77\u6e2f\u951a\u5730\u9012\u4ea4NOR\u7684\u6709\u6548\u6027\u505a\u51fa\u5224\u51b3\uff0c\u5c3d\u7ba1\u79df\u7ea6\u5378\u8d27\u89c4\u5b9a\u4e2d\u8bb0\u8f7d\u4e86”\u957f\u6c5f\u6cbf\u5cb8\u5b89\u5168\u6cca\u4f4d\/\u5b89\u5168\u6e2f”\u5b57\u6837\u3002<\/p>\n

\u8239\u4e1c\u4ece\u4e0a\u6d77\u6e2f\u951a\u5730\u9012\u4ea4\u88c5\u5378\u51c6\u5907\u5c31\u7eea\u901a\u77e5\u4e66\uff08NOR\uff09\u65f6\u5f00\u59cb\u8ba1\u7b97\u88c5\u5378\u65f6\u95f4\u3002\u800c\u627f\u79df\u4eba\u5219\u8ba4\u4e3a\u8fd9\u79cd\u505a\u6cd5\u662f\u4e0d\u5408\u6cd5\u7684\uff0c\u56e0\u4e3a\u8239\u8236\u5e76\u6ca1\u6709\u5230\u8fbe\u6cca\u4f4d\u3002<\/p>\n

\u4ef2\u88c1\u5458\u9700\u8981\u5224\u65ad\u7684\u95ee\u9898\u662f\uff0c\u8be5\u79df\u7ea6\u662f\u6cca\u4f4d\u79df\u7ea6\u8fd8\u662f\u6e2f\u53e3\u79df\u7ea6\u3002\u5982\u679c\u662f\u6e2f\u53e3\u79df\u7ea6\uff0c\u7531\u4e8e\u79df\u7ea6\u4e2d\u6ca1\u6709\u6307\u5b9a\u7684\u6e2f\u53e3\uff0c\u6545\u8239\u4e1c\u53ef\u4ee5\u5728\u4e0a\u6d77\u6e2f\u6709\u6548\u7684\u9012\u4ea4\u88c5\u5378\u51c6\u5907\u5c31\u7eea\u901a\u77e5\u4e66\uff08NOR\uff09\u3002\u4ef2\u88c1\u5458\u8ba4\u4e3a\u4ec5\u4ec5\u63d0\u5230”\u5b89\u5168\u6cca\u4f4d”\u8fd9\u6837\u7684\u63aa\u8f9e\uff0c\u4e0d\u80fd\u5c06\u8be5\u79df\u7ea6\u4ece\u6e2f\u53e3\u79df\u7ea6\u8f6c\u53d8\u4e3a\u6cca\u4f4d\u79df\u7ea6\uff0c\u56e0\u4e3a\u957f\u6c5f\u6cbf\u5cb8\u6e2f\u53e3\u4f17\u591a\uff0c\u79df\u7ea6\u4e2d\u5e76\u6ca1\u6709\u6307\u5b9a\u5378\u8d27\u6e2f\uff0c\u56e0\u6b64\u8be5\u79df\u7ea6\u4e0d\u4f1a\u662f\u4e00\u4e2a\u6cca\u4f4d\u79df\u7ea6\u3002<\/p>\n

\u5982\u679c\u540c\u6837\u7684\u6848\u5b50\u4ea4\u7ed9\u4f26\u6566\u4ef2\u88c1\u59d4\u5904\u7406\uff0c\u88c1\u51b3\u5c06\u4f1a\u4e0d\u540c\u3002\u65e0\u8bba\u5728\u4ec0\u4e48\u60c5\u51b5\u4e0b\uff0c\u7ed3\u8bba\u90fd\u662f\uff1a\u4e3a\u4e86\u786e\u4fdd\u9002\u7528\u6cca\u4f4d\u79df\u7ea6\u7684\u6cd5\u5f8b\u540e\u679c\uff0c\u5e94\u8be5\u6307\u5b9a\u6216\u786e\u5b9a\u5378\u8d27\u6e2f\u3002<\/p>\n

\u5224\u65ad\u79df\u7ea6\u662f\u6cca\u4f4d\u79df\u7ea6\u8fd8\u662f\u6e2f\u53e3\u79df\u7ea6\u53ef\u80fd\u53d6\u51b3\u4e8e\u8bed\u5e8f\u3002\u5728”the Finix”(1975 2 LL 415)\u4e00\u6848\u4e2d\uff0c\u4f7f\u7528\u7684\u662f”\u5b89\u5168\u6cca\u4f4d\uff0c\u4f26\u6566”\uff0c\u662f\u6cca\u4f4d\u79df\u7ea6\u3002\u5982\u679c\u662f”\u4f26\u6566\uff0c\u5b89\u5168\u6cca\u4f4d”\u53ef\u80fd\u4f1a\u88ab\u89e3\u91ca\u4e3a\u6e2f\u53e3\u79df\u7ea6\u3002\u5728\u5224\u65ad\u54ea\u79cd\u624d\u662f\u6b63\u786e\u89e3\u91ca\u65f6\uff0c\u6211\u4eec\u9700\u8981\u8003\u8651\u6574\u4e2a\u79df\u7ea6\u4e2d\u7684\u4e0a\u4e0b\u6587\u8bed\u5e8f\u3002<\/p>\n

Laytime – the Yangtze River – Anchorage of Shanghai<\/strong><\/span><\/p>\n

We have been asked on several occasions about the commencement of laytime when a vessel is fixed to discharge at a port or berth along the Yangtze river but is delayed at the anchorage of Shanghai.<\/p>\n

There was a recent US arbitration to decide whether the vessel could give a valid NOR at Shanghai anchorage despite the charterparty provided for discharge “one safe berth\/safe port Yangtze river.”<\/p>\n

The owner based their laytime calculations from the time of giving NOR at Shanghai anchorage. The charterers disputed this was unlawful as the vessel had not arrived at berth.<\/p>\n

The issue to be decided by the arbitrators was whether the charter was a berth or port charter. If it was a port charter, the owners could validly tender NOR at Shanghai port as no ports were named in the charterparty. The arbitrator decided the mere reference to “a safe berth” does not change a port charter into a berth charter as there were numerous ports along the Yangtze river and as the ports of discharge were not identified, the charter could not have been a berth charter.<\/p>\n

If the same issue came before a London arbitration, the award may have been different. In any event the conclusion is that to ensure the legal consequences of a berth charter apply, the names of discharge ports should be identified or named.<\/p>\n

The determination of whether a charterparty is a berth or port charterparty may be dependent on the order of words. In “The Finix” (1975 2 LL 415) it was held the words ‘one safe berth, London’ was a berth charterparty whereas a different order of words ‘London, one safe berth’ may be interpreted as a port charterparty. The order of words in context of the whole charterparty must be considered to determine which was the correct interpretation.<\/p>\n
