This means that if a vessel was knowingly unseaworthy when used and the loss or damage resulted from it being unseaworthy, the claim can be refused. The axiom of the principle of seaworthiness is well defined in Section 39 of the Marine Insurance Act 1906 (&#8220;MIA 1906&#8221;)<\/p>\n<p style=\"text-align: justify;\">In deciding whether a vessel is unseaworthy, Section 39(4) of MIA 1906 states that a vessel is deemed to be seaworthy when<\/p>\n<p style=\"text-align: justify;\">&#8220;she is reasonably fit in all respects to encounter the ordinary perils of the seas of the adventure insured.&#8221; (emphasis added)<\/p>\n<p style=\"text-align: justify;\">Practically, the Court will look to evidence such as whether the vessel has regular maintenance, manned by a team of competent and qualified marine engineers, carries essential spare parts necessary for the journey, installed with standard fire fighting equipments, crew given proper fire fighting training and master and officers of the vessel exercise due diligence.<\/p>\n<p style=\"text-align: justify;\">&#8220;Seaworthiness&#8221; is embedded as an implied warranty in a voyage policy. Section 39(1) of MIA 1906 states that<\/p>\n<p style=\"text-align: justify;\">&#8220;In a voyage policy there is an implied warranty that at the commencement of the voyage the ship shall be seaworthy for the purpose of the particular adventure insured&#8221;<\/p>\n<p style=\"text-align: justify;\">In Quebec Marine Insurance v Commercial Maritime [1870], a vessel was insured on a voyage policy from Montreal to Halifax. After leaving Montreal, the boiler, which had been defective prior to the start of the voyage, broke down, requiring the vessel to seek shelter and for repair. After repairing the boiler, the vessel sailed but was lost during heavy weather. Insurers declined the claim since the vessel had originally sailed in an unseaworthy condition due to the defective boiler, thus breaching the implied warranty of seaworthiness in a voyage policy. The Privy Council agreed that insurers were not liable, even though the breach (the defective boiler) had been put right at the time of the Total Loss.<\/p>\n<p style=\"text-align: justify;\">It shows the importance of words &#8220;at the commencement of voyage the ship shall be seaworthy&#8230;&#8221; in a voyage policy. We will look into time policy in our forthcoming articles.<\/p>\n<p style=\"text-align: justify;\">Should you have any query, please feel free to contact us.<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"font-size: 14pt; color: #022469;\"><br \/><\/span><\/strong><\/p>\n<p><strong><span style=\"font-size: 14pt; color: #022469;\">\u9002\u822a\u548c\u4fdd\u5355\uff08\u7b2c\u4e00\u90e8\u5206\uff09\u822a\u6b21\u4fdd\u5355<\/span><\/strong><\/p>\n<p style=\"font-size: 12px; text-align: justify;\">\u5927\u591a\u6570\u6d77\u4e8b\u4fdd\u5355\u5bf9\u4e8e\u8239\u8236&#8221;\u4e0d\u9002\u822a&#8221;\u6240\u5f15\u8d77\u7684\u635f\u5931\u4e0d\u4e88\u627f\u4fdd\u3002\u4e5f\u5c31\u662f\u8bf4\u5982\u679c\u6295\u4fdd\u4eba\u660e\u77e5\u4e00\u8258\u8239\u5904\u4e8e\u4e0d\u9002\u822a\u7684\u72b6\u6001\uff0c\u800c\u53d7\u4fdd\u7684\u6807\u7684\u7269\u7684\u706d\u5931\u6216\u635f\u574f\u7531\u4e0d\u9002\u822a\u9020\u6210\uff0c\u4fdd\u9669\u516c\u53f8\u53ef\u4ee5\u62d2\u8d54\u3002\u82f1\u56fd1906\u5e74\u6d77\u4e0a\u4fdd\u9669\u6cd5\uff08Marine Insurance Act, MIA 1906\uff09\u7b2c39\u6761\u7b2c4\u70b9\u5bf9\u5982\u4f55\u5224\u65ad\u4e00\u8258\u8239\u8236\u662f\u5426\u9002\u822a\u89c4\u5b9a\u5982\u4e0b\uff1a<\/p>\n<p style=\"font-size: 12px; text-align: justify;\">&#8220;\u5177\u6709\u9002\u822a\u80fd\u529b\u7684\u8239\u8236\uff0c\u5728\u5404\u65b9\u9762\u5747\u6709\u5408\u7406\u7684\u914d\u5907\u548c\u8bbe\u5907, \u80fd\u627f\u53d7\u8d77\u6d77\u4e0a\u8fd0\u52a1\u8fc7\u7a0b\u4e2d\u901a\u5e38\u906d\u9047\u5230\u6d77\u4e0a\u98ce\u9669\u3002&#8221;<\/p>\n<p style=\"font-size: 12px; text-align: justify;\">\u5728\u5b9e\u52a1\u4e0a\uff0c\u6cd5\u9662\u4f1a\u67e5\u770b\u8bc1\u636e\uff0c\u6bd4\u5982\u8239\u8236\u662f\u5426\u6709\u6b63\u5e38\u7684\u7ef4\u4fee\uff0c\u662f\u5426\u59a5\u5584\u914d\u5907\u6709\u80fd\u529b\u548c\u6709\u8d44\u8d28\u7684\u8239\u5458\uff0c\u88c5\u6709\u822a\u7a0b\u4e2d\u91cd\u8981\u7684\u5907\u4ef6\u548c\u6551\u706b\u8bbe\u65bd\uff0c\u8239\u5458\u662f\u5426\u63a5\u53d7\u8fc7\u706d\u706b\u57f9\u8bad\uff0c\u8239\u957f\u548c\u9ad8\u7ea7\u8239\u5458\u662f\u5426\u514b\u5c3d\u804c\u8d23\u7b49\u3002<\/p>\n<p style=\"font-size: 12px; text-align: justify;\">\u9002\u822a\u7684\u6982\u5ff5\u5728\u822a\u6b21\u4fdd\u5355\u4e2d\u5df2\u6709\u4f53\u73b0\u3002\u82f1\u56fd1906\u5e74\u6d77\u4e0a\u4fdd\u9669\u6cd5\u7b2c39\u6761\u7b2c\u4e00\u70b9\uff1a<\/p>\n<p style=\"font-size: 12px; text-align: justify;\">&#8220;\u822a\u7a0b\u4fdd\u5355\u5177\u6709\u9ed8\u793a\u4fdd\u8bc1, \u5373\u8239\u8236\u5728\u53d1\u822a\u524d\u5e94\u5177\u9002\u822a\u529b, \u80fd\u9002\u5e94\u4fdd\u5355\u6240\u6307\u5b9a\u7684\u001c<\/p>\n<p style=\"font-size: 12px; text-align: justify;\">\u5728Quebec Marine Insurance v Commercial Maritime [1870]\u6848\u4e2d\uff0c\u4e00\u8258\u8d2d\u4e70\u4e86\u4ece\u8499\u7279\u5229\u5c14(Montreal)\u5230\u54c8\u91cc\u6cd5\u514b\u65af(Halifax)\u822a\u6b21\u4fdd\u5355\u7684\u8239\u8236, \u5728\u79bb\u5f00\u8499\u7279\u5229\u5c14\u4ee5\u540e, \u7531\u4e8e\u5728\u822a\u6b21\u5f00\u59cb\u524d\u5df2\u7ecf\u53d1\u73b0\u6709\u7f3a\u9677\u7684\u9505\u7089\u51fa\u73b0\u95ee\u9898\uff0c\u9700\u8981\u9760\u5cb8\u4fee\u7406\u3002\u7b49\u4fee\u5b8c\u9505\u7089\u4ee5\u540e\uff0c\u7ee7\u7eed\u822a\u7a0b\u3002\u4e0d\u5e78\uff0c\u5728\u540e\u7eed\u822a\u7a0b\u9014\u4e2d\uff0c\u7531\u4e8e\u6076\u52a3\u5929\u6c14\u8239\u8236\u706d\u5931\u3002\u4fdd\u9669\u4eba&#8221;\u7531\u4e8e\u9505\u7089\u7684\u7f3a\u9677\uff0c\u8239\u8236\u5e76\u6ca1\u6709\u5728\u5f00\u822a\u524d\u505a\u5230\u9002\u822a&#8221;\u7684\u7406\u7531\u62d2\u7edd\u8d54\u4ed8\u3002\u6848\u4ef6\u7ecf\u591a\u756a\u8bc9\u8bbc\uff0c\u6700\u540e\u82f1\u56fd\u67a2\u5bc6\u9662\u540c\u610f\uff0c\u867d\u7136\u9505\u7089\u7f3a\u9677\u5df2\u7ecf\u5728\u5168\u635f\u524d\u5f97\u5230\u4fee\u6b63\uff0c\u4fdd\u9669\u4eba\u4f9d\u7136\u4e0d\u9700\u8981\u5bf9\u8be5\u5168\u635f\u8d1f\u8d23\u3002\u8fd9\u4e2a\u88c1\u51b3\u7684\u7ed3\u679c\uff0c\u7279\u663e\u4e86\u5728\u822a\u6b21\u4fdd\u5355\u4e2d\uff0c\u822a\u6b21\u5f00\u59cb\u524d\u8239\u8236\u5fc5\u987b\u9002\u822a\u7684\u91cd\u8981\u6027\u3002<\/p>\n<p style=\"font-size: 12px; text-align: justify;\">\u6211\u4eec\u5c06\u5728\u4e0b\u671f\u6587\u7ae0\u4e2d\u4ecb\u7ecd\u5b9a\u671f\u4fdd\u5355\u5bf9\u8239\u8236\u9002\u822a\u7684\u8981\u6c42\u3002<\/p>\n<p style=\"font-size: 12px; text-align: justify;\">\u5982\u679c\u60a8\u6709\u4efb\u4f55\u95ee\u9898\uff0c\u6b22\u8fce\u4e0e\u6211\u4eec\u8054\u7cfb\u3002<\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;ENG&nbsp;CHN &nbsp; Most marine insurance policies exclude losses attributable to &#8220;unseaworthiness&#8221;.
