The law and practice in respect of the arrest of ships in South Africa is regulated by the Admiralty Jurisdiction Regulation Act of 1983 as amended with effect from 1 July 1992 (&#8220;the Act&#8221;). In the drafting of the Act, certain aspects of the Arrest Convention 1953 were taken into account and incorporated into the legislation, such as the provision for the arrest of &#8220;associated ships&#8221;, which is a wider concept than &#8220;sister ships&#8221;. The Act provides the formula to determine what law applies to the substantive merits of a maritime claim, but the arrest procedures are determined by the provisions of the Act itself.<\/p>\n<p style=\"text-align: justify;\">See attached file: Ship Arrest in South Africa.pdf<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">&nbsp;<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><span style=\"font-size: 14pt; color: #022469;\"><strong>\u56fd\u9645\u6263\u8239\u5b9e\u52a1-\u5357\u975e<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">\u5357\u975e\u6263\u8239\u6709\u4e09\u79cd\u4e3b\u8981\u7684\u65b9\u5f0f\uff1a<br \/>(i) \u5bf9\u7269\u8bc9\u8bbc\u6263\u8239; (ii) \u5bf9\u4eba\u8bc9\u8bbc\u6263\u62bc; (iii) \u4fdd\u5168\u6263\u62bc<\/p>\n<p style=\"text-align: justify;\">\u5357\u975e\u6ca1\u6709\u52a0\u5165\u4efb\u4f55\u6709\u5173\u6263\u8239\u7684\u56fd\u9645\u516c\u7ea6\u3002\u300a1983\u5e74\u6d77\u4e8b\u7ba1\u8f96\u89c4\u5219\u6cd5\u300b\u89c4\u8303\u5357\u975e\u5728\u6263\u8239\u65b9\u9762\u7684\u6cd5\u5f8b\u4e0e\u5b9e\u8df5\uff0c\u8be5\u6cd5\u6848\u4e8e1992\u5e747\u67081\u65e5\u8fdb\u884c\u8fc7\u4fee\u8ba2\u3002\u8be5\u6cd5\u6848\u7684\u8d77\u8349\u53c2\u8003\u4e86\u300a1953\u5e74\u6263\u8239\u516c\u7ea6\u300b\u7684\u67d0\u4e9b\u5185\u5bb9\uff0c\u5e76\u5c06\u5176\u5e76\u5165\u5230\u8be5\u6cd5\u4e2d\u3002\u8bf8\u5982\uff0c\u5173\u8054\u8239\u8236\u7684\u6263\u8239\u89c4\u5b9a\uff0c\u8be5\u5b9a\u4e49\u6bd4&#8221;\u59d0\u59b9\u8239&#8221;\u8303\u56f4\u66f4\u5e7f\u6cdb\u3002\u8be5\u6cd5\u6848\u4e3a\u6d77\u4e8b\u7d22\u8d54\u5b9e\u4f53\u8bc9\u8bbc\u7684\u6cd5\u5f8b\u9002\u7528\u63d0\u4f9b\u4e86\u786e\u5b9a\u65b9\u6cd5\uff0c\u800c\u6cd5\u6848\u672c\u8eab\u89c4\u5b9a\u4e86\u6263\u8239\u7a0b\u5e8f\u3002<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002<\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;ENG&nbsp; &nbsp;&nbsp;CHN&nbsp;&nbsp; There are essentially three ways in which one can arrest or attach a ship in South Africa:(i) An arrest in rem; (ii) An arrest in personam; (iii) A security arrest; South Africa has not acceded to any International Convention related to the arrest of ships.
