\u5728\u88c5\u8fd0\u6613\u6db2\u5316\u8d27\u7269\u65f6\uff0c\u5bf9\u4e8e\u8d27\u7269\u662f\u5426\u9002\u5408\u5b89\u5168\u8fd0\u8f93\uff0c\u8239\u4e1c\u548c\u79df\u5bb6\u4e0d\u65f6\u53d1\u751f\u4e89\u8bae\u3002\u7d27\u63a5\u7740\u5c31\u5fc5\u987b\u62ff\u6837\u54c1\u53bb\u5b9e\u9a8c\u5ba4\u505a\u68c0\u6d4b\uff0c\u4ee5\u786e\u5b9a\u8d27\u7269\u7684\u9002\u8fd0\u6c34\u5206\u9650\u91cf(\u4ee5\u4e0b\u7b80\u79f0TML)\uff0c\u8fd9\u6837\u5c31\u4e0d\u53ef\u907f\u514d\u4ea7\u751f\u65f6\u95f4\u635f\u5931\u3002<\/p>\n

\u4ece\u6211\u4eec\u5904\u7406\u7684\u5927\u91cf\u6848\u5b50\u6765\u770b\uff0c\u4fdd\u8d54\u534f\u4f1a\u5bf9\u6b64\u7c7b\u95ee\u9898\u7684\u610f\u89c1\u662f\uff1a\u63d0\u4f9b\u5b89\u5168\u8d27\u7269\u662f\u53d1\u8d27\u4eba\u7684\u4e25\u683c\u8d23\u4efb\uff0c\u5982\u679c\u8d27\u7269TML\u503c\u4e0e\u53d1\u8d27\u4eba\u4e4b\u524d\u5ba3\u79f0\u7684\u4e0d\u540c\u6216\u8d85\u8fc7\uff0c\u90a3\u4e48\u65e0\u8bba\u8239\u4e1c\u5728\u786e\u5b9aTML\u503c\u8fc7\u7a0b\u4e2d\u662f\u5426\u6709\u8fc7\u5931\uff0c\u8239\u8236\u6240\u6709\u7684\u65f6\u95f4\u635f\u5931\u90fd\u5e94\u8be5\u7531\u79df\u5bb6\u627f\u62c5\u3002<\/p>\n

Dangerous cargoes<\/strong><\/span><\/p>\n

Disputes between owners and charterers are frequent when loading cargoes which may liquefy on the matter whether the cargo is safe for carriage, and the ensuing time loss arising from sampling and laboratory testing to determine the TML.<\/p>\n

Based on the numerous number of cases we are handling, it appears the view and stance taken by the P&I Clubs is that the shippers are under a strict liability to provide a safe cargo and in the event it turns out the TML is different or exceeds the figure which is declared by the shipper, all time loss of the vessel is borne by the charterer regardless the owner had been negligent during the course of determining the TML.<\/p>\n
