Even though this is the established position in English Law under a NYPE time charter, there was included also a rider clause in the charterparty the charterers do not pay for the bunkers at the time of delivery notwithstanding they agree to pay for all fuel consumed under clause 2 of NYPE, which prompted a possible argument that the property in the bunkers remain with the owners, and the charterers only pay for the fuel consumed.<\/p>\n<p style=\"text-align: justify;\">However the words &#8216;charterers to take over the bunkers and pay for all fuel on board&#8217; in clause 3 NYPE do not support this argument.<\/p>\n<p style=\"text-align: justify;\">See attached file: ALCO20140012 Bunkers &#8211; who they belong to under a Time charter.pdf<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">&nbsp;<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><span style=\"font-size: 14pt; color: #022469;\"><strong>\u671f\u79df\u4e0b\u71c3\u6cb9\u7684\u6240\u6709\u6743<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">\u79df\u8239\u671f\u95f4\u71c3\u6cb9\u59cb\u7ec8\u662f\u79df\u5bb6\u7684\u8d22\u4ea7\u3002\u5c3d\u7ba1\u8fd9\u662f\u82f1\u56fd\u6cd5\u4e0bNYPE\u671f\u79df\u79df\u7ea6\u4e2d\u65e2\u5b9a\u7684\u5185\u5bb9\uff0c\u4f46\u79df\u7ea6\u9644\u52a0\u6761\u6b3e\u4e5f\u53ef\u80fd\u89c4\u5b9a\uff0c\u4ea4\u8239\u65f6\u79df\u5bb6\u5e76\u4e0d\u652f\u4ed8\u8239\u4e0a\u7684\u5168\u90e8\u71c3\u6cb9\uff0c\u800c\u662f\u6839\u636eNYPE\u7b2c2\u6761\u7684\u89c4\u5b9a\u540c\u610f\u652f\u4ed8\u6240\u6709\u6d88\u8017\u7684\u71c3\u6cb9\u3002\u56e0\u6b64\uff0c\u8fd9\u5c31\u53ef\u80fd\u5f15\u8d77\u4e89\u8bae\uff0c\u5373\u8239\u4e0a\u71c3\u6cb9\u6240\u6709\u6743\u4ecd\u7136\u5c5e\u4e8e\u8239\u4e1c\uff0c\u79df\u5bb6\u53ea\u662f\u652f\u4ed8\u4e86\u6d88\u8017\u7684\u71c3\u6cb9\u3002<\/p>\n<p style=\"text-align: justify;\">\u4f46\u662f\uff0cNYPE\u7b2c3\u6761\u7684\u89c4\u5b9a\u201c\u79df\u5bb6\u63a5\u7ba1\u71c3\u6cb9\u5e76\u652f\u4ed8\u6240\u6709\u8239\u4e0a\u71c3\u6cb9\u201d\uff0c\u8fd9\u6761\u5c31\u5426\u8ba4\u4e86\u8fd9\u4e00\u89c2\u70b9\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002<\/p>\n<p><span style=\"text-align: justify;\"><br \/><\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;ENG&nbsp; &nbsp;&nbsp;CHN&nbsp;&nbsp; The bunker is invariably the property of the charterers during the period of the charter.
