\u4f26\u6566\u5546\u4e8b\u6cd5\u9662\u4ee5\u4e00\u81f4\u7684\u610f\u89c1\u652f\u6301\u4e00\u4e2a\u8457\u540d\u4ef2\u88c1\u5ead\u7684\u51b3\u5b9a\uff0c\u5f53\u4e00\u8258\u8239\u8236\u5728\u7ebd\u7ea6\u571f\u4ea7\u4ea4\u6613\u683c\u5f0f46 \u4e0b\u51fa\u79df\u65f6\uff0c\u5f53\u5176\u88ab\u6d77\u76d7\u52ab\u6301\u5e76\u63a7\u5236\u7684\u65f6\u5019\uff0c\u8239\u8236\u4ecd\u7136\u5904\u4e8e\u51fa\u79df\u72b6\u6001\u3002<\/p>\n

\u8fd9\u8d77\u6848\u4ef6\u7684\u4e3b\u8981\u5185\u5bb9\u662f\u4e00\u8258\u540d\u53ebSaldanha\u7684\u8239\u8236\u5728\u822a\u884c\u5728\u4e9a\u4e01\u6e7e\u7684UKMTO\u7a7f\u8d8a\u901a\u9053\u65f6\u88ab\u7d22\u9a6c\u91cc\u6d77\u76d7\u52ab\u6301\uff0c\u7136\u540e\u8239\u8236\u88ab\u6d77\u76d7\u63a7\u5236\u5e76\u5e26\u8d70\u3002<\/p>\n

\u8239\u4e1c\u575a\u6301\u8ba4\u4e3a\u5728\u88ab\u6d77\u76d7\u52ab\u6301\u671f\u95f4\uff0c\u8239\u8236\u4ecd\u5c5e\u4e8e\u51fa\u79df\u72b6\u6001\uff0c\u56e0\u4e3a\u8239\u8236\u7684\u72b6\u51b5\u5e76\u4e0d\u5c5e\u4e8e\u505c\u79df\u6761\u6b3e\u7684\u60c5\u51b5\u3002\u8bc1\u660e\u8239\u8236\u5c5e\u4e8e\u505c\u79df\u7684\u8d23\u4efb\u5219\u5728\u79df\u5bb6\u8eab\u4e0a\u3002<\/p>\n

3.   \u88ab\u6d77\u76d7\u62ff\u6355\u5c5e\u4e8e\u89c4\u5b9a”\u4efb\u4f55\u5176\u4ed6\u539f\u56e0”\u7684\u8303\u56f4<\/p>\n

\u5bf9\u4e8e\u7b2c\u4e00\u70b9\uff0c\u4ef2\u88c1\u5458\u53d1\u73b0\u6301\u6709\u91cd\u6b66\u88c5\u7684\u6d77\u76d7\u653b\u51fb\u548c\u62ff\u6355\u8239\u8236\u4e0d\u662f\u610f\u5916\u4e8b\u4ef6\uff0c\u56e0\u4e3a\u5b83\u4e0e\u5728The Mareva\u6848\u4ef6\u4e2d”\u4e00\u822c\u610f\u5916”\u7684\u5b9a\u4e49\u4e0d\u540c\u3002

\u6cd5\u5b98\u540c\u65f6\u62d2\u7edd\u4e86\u79df\u5bb6\u4e3a\u4f7f\u6d77\u76d7\u6263\u8239\u6ee1\u8db3”\u4efb\u4f55\u5176\u4ed6\u539f\u56e0”\u7684\u4e3b\u5f20\u3002<\/p>\n

\u6700\u540e\u6cd5\u5b98\u9075\u4ece\u4e86\u4ee5\u4e0b\u4e3b\u5f20: \u8be5\u79df\u7ea6\u91cc\u5305\u542b\u4e86\u4e00\u6761\u5173\u4e8e\u62ff\u6355\u3001\u6263\u7559\u548c\u6263\u62bc\u6761\u6b3e\uff0c \u4f46\u662f\u62ff\u6355\u6761\u6b3e\u4e0d\u80fd\u5ef6\u4f38\u5230\u88ab\u6d77\u76d7\u62ff\u6355\u3002<\/p>\n

The London Commercial Court rules<\/strong><\/span><\/p>\n

The London Commercial Court rules that vessel chartered on NYPE terms remains on hire whilst detained by pirates<\/strong><\/p>\n

COSCO Bulk Carrier Co., Ltd v Team-up Owning Co. Ltd [2010] EWHC 1340 (Comm) (The Saldanha) <\/p>\n

The London Commercial Court has upheld the unanimous decision of an eminent arbitration tribunal that a vessel chartered on the NYPE 46 from which were seized by pirates remained on hire whilst under the control of the pirates.<\/p>\n

The case is manly on the bulk carrier m\/v Saldanha was seized by Somali pirates whilst sailing through UKMTO transit corridor in Gulf of Aden, then the vessel was taken by the pirates.<\/p>\n

The owner insisted that the vessel remained on hire during the period of detention due to that the seizure by pirates does not fall within the off-hire clause. The onus of prove is on charterer.<\/p>\n

Charterer tried to argue that the vessel was off-hire on following points:<\/p>\n

    \n
  1. detention by pirates amounts to “detention by average accidents to ship or cargo\u201d;<\/li>\n
  2. “default and or deficiency of men” is including negligent errors, by the master and crew.<\/li>\n
  3. seizure by pirates falls in provision of “any other cause”<\/li>\n<\/ol>\n

    For the first point, the arbitrators have found heavily armed pirates attacking and seizing a vessel was not an accident, since it doesn’t fall in the meaning of “average accident” in the case The Mareva A.S [1977] 1 Lloyd’s Rep 368.<\/p>\n

    For the second point, the arbitrators and the judge accepted the natural meaning of “default” of men can include a negligent or inadvertent performance of duties by the Master or Crew, but “default of men” shall be constructed narrowly. Considering the marine industry practice also, the tribunal rejected the argument of Charterer which intended to include any failure by the Master and crew to perform their duties or any breach by them of their duties.<\/p>\n

    The judge also rejected other reasoning raised by the charterer trying to put the detention by the pirates fell within the scope of “any other cause”\uff0e\u3000<\/p>\n

    Finally the judge observed that the Charterparty included a “bespoke” clause dealing with the risk of seizure, arrest, requisition and detention, however the seizure clause did not extend to cover seizure by pirates.<\/p>\n

\u8fd9\u8d77\u6848\u4ef6\u7684\u4e3b\u8981\u5185\u5bb9\u662f\u4e00\u8258\u540d\u53ebSaldanha\u7684\u8239\u8236\u5728\u822a\u884c\u5728\u4e9a\u4e01\u6e7e\u7684UKMTO\u7a7f\u8d8a\u901a\u9053\u65f6\u88ab\u7d22\u9a6c\u91cc\u6d77\u76d7\u52ab\u6301\uff0c\u7136\u540e\u8239\u8236\u88ab\u6d77\u76d7\u63a7\u5236\u5e76\u5e26\u8d70\u3002 \u8239\u4e1c\u575a\u6301\u8ba4\u4e3a\u5728\u88ab\u6d77\u76d7\u52ab\u6301\u671f\u95f4\uff0c\u8239\u8236\u4ecd\u5c5e\u4e8e\u51fa\u79df\u72b6\u6001\uff0c\u56e0\u4e3a\u8239\u8236\u7684\u72b6\u51b5\u5e76\u4e0d\u5c5e\u4e8e\u505c\u79df\u6761\u6b3e\u7684\u60c5\u51b5\u3002\u8bc1\u660e\u8239\u8236\u5c5e\u4e8e\u505c\u79df\u7684\u8d23\u4efb\u5219\u5728\u79df\u5bb6\u8eab\u4e0a\u3002
