In an important decision for the P&I industry, on 6 March 2014 the Court of Appeal has ruled that a Limitation Fund can now be constituted by way of a Letter of Undertaking (“LOU”) given by a P&I Club, as opposed to a cash payment into court.<\/p>\n

Clyde & Co were instructed by the owners of the vessel that was lost and their P&I insurers.<\/p>\n

The vessel sank off Oman on 3 April 2013 following a fire on board and on 13 May 2013, Owners commenced limitation proceedings under the Convention on Limitation of Liability for Maritime Claims 1976 (as amended by the 1996 Protocol) (“LLMC 1976”) to limit Owners’ liability. To do so, Owners are required to establish a Limitation Fund for the limitation amount, calculated with reference to the vessel’s tonnage.<\/p>\n

Clyde & Co\u5f8b\u6240\u662f\u672c\u6848\u706d\u5931\u8239\u8236\u7684\u8239\u4e1c\u548c\u4fdd\u8d54\u9669\u4fdd\u9669\u4eba\u6307\u5b9a\u7684\u8bc9\u8bbc\u4ee3\u7406\u4eba\u3002<\/p>\n

\u6d89\u6848\u8239\u8236\u4e8e2013\u5e744\u67083\u65e5\u8d77\u706b\uff0c\u968f\u540e\u5728\u963f\u66fc\u6cbf\u6d77\u6c89\u6ca1\u3002\u540c\u5e745\u670813\u65e5\uff0c\u8239\u4e1c\u6839\u636e\u300a1976\u5e74\u6d77\u4e8b\u8d54\u507f\u8d23\u4efb\u9650\u5236\u516c\u7ea6\u300b(1996\u5e74\u8bae\u5b9a\u4e66)(LLMC 1976)\u7684\u89c4\u5b9a\u542f\u52a8\u8d23\u4efb\u9650\u5236\u7a0b\u5e8f\u3002\u542f\u52a8\u8d23\u4efb\u9650\u5236\u7a0b\u5e8f\uff0c\u8981\u6c42\u8239\u4e1c\u6839\u636e\u8239\u8236\u8f7d\u91cd\u5428\u8ba1\u7b97\u8d23\u4efb\u9650\u5236\u603b\u989d\uff0c\u5e76\u8bbe\u7acb\u6d77\u4e8b\u8d54\u507f\u8d23\u4efb\u9650\u5236\u57fa\u91d1\u3002<\/p>\n
