The Association has advised the Members to have charterparty and bill of lading clauses expressly chosen one set of general average rules to the express exclusion of the other, in order to avoid risks of disputes as well as missing time bars.<\/p>\n

The basic rule of General Average is that all loss which arises in consequence of extraordinary sacrifices made or expenses incurred for the preservation of the ship and cargo losses must be borne proportionately by all who are interested.<\/p>\n

The rule of a general contribution, by rendering it immaterial whose property is taken in the first instance and material only that that should be taken which will most surely and effectually, and at least cost, save the whole, does away with any conflict in the captain\u2019s mind between interest and duty, leaves him alone with purely nautical considerations, and thus, no doubt, brings mass effect for the preservation of life and property at sea.<\/p>\n

\u5171\u540c\u6d77\u635f\u7684\u57fa\u672c\u539f\u5219\u662f\uff0c\u4e3a\u7ef4\u62a4\u8239\u8236\u548c\u8d27\u7269\u7684\u5171\u540c\u5b89\u5168\uff0c\u800c\u505a\u51fa\u7684\u67d0\u4e9b\u7279\u6b8a\u727a\u7272\u6216\u652f\u51fa\u7684\u989d\u5916\u8d39\u7528\uff0c\u5176\u635f\u5931\u5e94\u7531\u5404\u5229\u76ca\u65b9\u5171\u540c\u6309\u6bd4\u4f8b\u5206\u644a\u3002<\/p>\n

\u5728\u5171\u540c\u6d77\u635f\u5206\u644a\u5236\u5ea6\u4e0b\uff0c\u8239\u957f\u7eaf\u7cb9\u4ece\u822a\u884c\u5b89\u5168\u7684\u89d2\u5ea6\u8003\u8651\uff0c\u5148\u727a\u7272\u8c01\u7684\u8d22\u4ea7\u4e0d\u91cd\u8981\uff0c\u91cd\u8981\u7684\u662f\u6240\u505a\u7684\u8d22\u4ea7\u727a\u7272\u662f\u6709\u610f\u5730\u4e14\u6709\u6548\u5730\uff0c\u4ee5\u6700\u4f4e\u6210\u672c\u4f7f\u6574\u8239\u83b7\u6551\uff0c\u8239\u957f\u5728\u5229\u76ca\u548c\u804c\u8d23\u4e4b\u95f4\u6ca1\u6709\u4e1d\u6beb\u601d\u60f3\u6597\u4e89\uff0c\u4ece\u800c\u6700\u5927\u9650\u5ea6\u5730\u4fdd\u62a4\u6d77\u4e0a\u4eba\u547d\u548c\u8d22\u4ea7\u5b89\u5168\u3002<\/p>\n
