The Development<\/strong>
The doctrine of frustration under English law has been a difficult topic, not least because it is often erroneously associated with the civil law concept of \u201cforce majeure\u201d.<\/p>\n

There is a mistaken perception that because a contract works out differently than intended that this doctrine allows an exit to the deal.<\/p>\n

In both situations a misunderstanding of the correct legal position may lead to decisions being made that do not result in the contract being ended due to a correct implementation of the doctrine, but results in a breach of the charterparty by the party seeking to exit.<\/p>\n

\u6b64\u5916\uff0c\u8239\u4e1c\u5e38\u6709\u4e00\u79cd\u9519\u8bef\u7684\u89c2\u70b9\uff0c\u5373\uff0c\u5982\u679c\u5408\u540c\u5c65\u884c\u4e0d\u540c\u4e8e\u9884\u671f\uff0c\u90a3\u4e48\u5c31\u53ef\u4ee5\u6839\u636e\u5408\u540c\u53d7\u963b\u539f\u5219\uff0c\u9000\u51fa\u5408\u540c\u3002<\/p>\n

\u4ee5\u4e0a\u4e24\u79cd\u60c5\u51b5\u90fd\u6ca1\u6709\u6b63\u786e\u7406\u89e3\u5408\u540c\u53d7\u963b\u7684\u6cd5\u5f8b\u7acb\u573a\uff0c\u5f88\u53ef\u80fd\u5bfc\u81f4\u6240\u505a\u51b3\u5b9a\u4e0d\u4ec5\u4e0d\u80fd\u901a\u8fc7\u6b63\u786e\u6267\u884c\u8be5\u539f\u5219\u7ec8\u6b62\u5408\u540c\uff0c\u53cd\u800c\u4f7f\u5f97\u671f\u671b\u9000\u51fa\u5408\u540c\u7684\u4e00\u65b9\u8fdd\u53cd\u79df\u8239\u5408\u540c\u3002<\/p>\n
