According to the circular<\/a> issued by International Maritime Organization, the 1996 Protocol to the Convention on Limitation of Liability for Maritime Claims (LLMC) that were adopted in April 2012 and which take effect on 8 June 2015 substantially increases the limits of liaiblity.<\/p>\n

Factors inducing LLMC amendments<\/strong>
Article 8.5 of the 1996 Protocol provides for three factors to be taken into consideration when acting on a proposal to amend the limitation amount, namely: (i) the experience of incidents; (ii) the changes in monetary values, and (iii) the effect of the proposed amendment on insurance costs.<\/p>\n

Arguably the main factor prompting the latest amendments is the change in monetary values during the period since the limits were previously set and the above below increase reflects this change. This is illustrated in the proposal to amend the 1996 limits that was submitted by Japan to the Legal Committee of the IMO, which was also fully supported by the International Chamber Shipping (ICS) and the International Group of P&I Clubs (IG) in their joint proposal.<\/p>\n

\u300a\u6d77\u4e8b\u8d54\u507f\u8d23\u4efb\u9650\u5236\u516c\u7ea6\u300b\u4fee\u8ba2\u7684\u539f\u56e0<\/strong>
1996\u5e74\u8bae\u5b9a\u4e66\u7b2c8.5\u6761\u89c4\u5b9a\uff0c\u4fee\u6539\u8d23\u4efb\u9650\u989d\u65f6\uff0c\u5e94\u8003\u86513\u4e2a\u56e0\u7d20\uff0c(i)\u4e8b\u6545\u8bb0\u5f55 (ii)\u8d27\u5e01\u4ef7\u503c\u53d8\u5316 (iii)\u4fee\u6539\u9650\u989d\u5bf9\u4fdd\u9669\u6210\u672c\u7684\u5f71\u54cd\u3002<\/p>\n

\u8d27\u5e01\u4ef7\u503c\u7684\u6539\u53d8\u5927\u6982\u662f\u4fc3\u4f7f\u4fee\u8ba2\u7684\u4e3b\u8981\u56e0\u7d20\uff0c\u7531\u4e8e\u6709\u5173\u9650\u989d\u90fd\u662f\u8fc7\u53bb\u8bbe\u5b9a\u7684\uff0c\u9700\u8981\u901a\u8fc7\u589e\u5e45\u53cd\u6620\u8fd9\u79cd\u4ef7\u503c\u7684\u53d8\u5316\u3002\u8fd9\u4e00\u70b9\u5df2\u53cd\u6620\u5728\u65e5\u672c\u5411\u56fd\u9645\u6d77\u4e8b\u7ec4\u7ec7\u6cd5\u5f8b\u59d4\u5458\u4f1a\u63d0\u4ea4\u7684\u5bf91996\u5e74\u9650\u989d\u7684\u4fee\u8ba2\u5efa\u8bae\u4e66\u5185\uff0c\u5e76\u5f97\u5230\u56fd\u9645\u822a\u8fd0\u516c\u4f1a\u548c\u56fd\u9645\u4fdd\u8d54\u534f\u4f1a\u96c6\u56e2\u8054\u5408\u63d0\u6848\u7684\u5927\u529b\u652f\u6301\u3002<\/p>\n
