The hypothetical backgrounds of the scenario are,<\/p>\n<ol style=\"color: #000000; line-height: normal;\">\n<li>The vessel: Panama Flag.<\/li>\n<li>The crew members were employed through a ship\u2019s management company which is registered in Hong Kong for a shipowner company which is also registered in Hong Kong.<\/li>\n<li>The employment contract was signed in mainland China between the Chinese crew and the ship\u2019s management company which office is located in China.<\/li>\n<li>A fatal incident happened to some Chinese crew.<\/li>\n<\/ol>\n<p style=\"font-size: 12px;\">The Clubs have been asked to consider:<\/p>\n<ol style=\"color: #000000; line-height: normal;\">\n<li>Under this circumstance, what applicable law should be applied to this case?<\/li>\n<li>If the social insurance is not in place, will the Club cover the damages or compensations in relation to the crew death which should have been paid by Owner under the social insurance scheme such as, Regulations on Work-related Insurance 2011?<\/li>\n<li>If Part 2 is negative, what other avenues for compensation can the Owner recover from the Club if the social insurance is not in place, e.g. Tort?<\/li>\n<li>If there are other means which the Owner can seek recovery from the Club despite the social insurance is not placed, will the Club deduct any compensations which should have been paid under the social insurance scheme?<\/li>\n<\/ol>\n<p style=\"font-size: 12px;\">See attached file: ALCO20140039 Crew death case with regard to compensation.pdf<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">&nbsp;<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><span style=\"font-size: 14pt; color: #022469;\"><strong>\u6709\u5173\u8239\u5458\u6b7b\u4ea1\u4e8b\u6545\u7684\u8d54\u507f<\/strong><\/span><\/p>\n<p style=\"font-size: 12px;\">\u6700\u8fd1\uff0c\u6211\u53f8\u5bf9\u4e00\u9879\u6709\u5173\u8239\u5458\u6b7b\u4ea1\u4e8b\u6545\u7684\u8d54\u507f\u60c5\u51b5\u8fdb\u884c\u4e86\u8c03\u7814\u3002\u5047\u8bbe\u80cc\u666f\u5982\u4e0b\uff1a<\/p>\n<ol style=\"color: #000000; line-height: normal;\">\n<li>\u8239\u65d7\u56fd\uff1a\u5df4\u62ff\u9a6c<\/li>\n<li>\u8239\u5458\u901a\u8fc7\u9999\u6e2f\u6ce8\u518c\u7684\u8239\u8236\u7ba1\u7406\u516c\u53f8\u53d7\u8058\uff0c\u8239\u4e1c\u516c\u53f8\u4e5f\u5728\u9999\u6e2f\u6ce8\u518c<\/li>\n<li>\u4e2d\u56fd\u7c4d\u8239\u5458\u548c\u8239\u8236\u7ba1\u7406\u516c\u53f8\u53cc\u65b9\u5728\u5176\u5185\u5730\u529e\u516c\u5ba4\u7b7e\u7f72\u4e86\u8239\u5458\u96c7\u4f63\u5408\u540c<\/li>\n<li>\u4e2d\u56fd\u8239\u5458\u5728\u4e8b\u4ef6\u4e2d\u8eab\u4ea1<\/li>\n<\/ol>\n<p style=\"font-size: 12px;\">\u6211\u53f8\u9080\u8bf7\u534f\u4f1a\u5c31\u4ee5\u4e0a\u63d0\u4f9b\u7684\u80cc\u666f\u8d44\u6599\u56de\u5e94\u4ee5\u4e0b\u95ee\u9898\uff1a<\/p>\n<ol style=\"color: #000000; line-height: normal;\">\n<li>\u9002\u7528\u4e8e\u6b64\u79cd\u60c5\u51b5\u7684\u6cd5\u5f8b\uff1f<\/li>\n<li>\u5982\u8239\u5458\u6ca1\u6709\u8d2d\u4e70\u793e\u4f1a\u4fdd\u9669\uff0c\u534f\u4f1a\u4f1a\u5426\u4ecd\u7136\u6839\u636e\u300a\u5de5\u4f24\u4fdd\u9669\u6761\u4f8b2011\u300b\u5bf9\u6b7b\u4ea1\u8239\u5458\u5bb6\u5c5e\u4f5c\u51fa\u76f8\u5e94\u7684\u8d54\u507f\u6216\u8865\u507f\uff1f<\/li>\n<li>\u5982\u4e0a\u9898\u7b54\u6848\u4e3a\u201c\u5426\u201d\uff0c\u5728\u6ca1\u6709\u8d2d\u4e70\u793e\u4f1a\u4fdd\u9669\u7684\u60c5\u51b5\u4e0b\uff0c\u8239\u4e1c\u53ef\u4ece\u4ec0\u4e48\u5176\u4ed6\u9014\u5f84\u5411\u534f\u4f1a\u53d6\u5f97\u8d54\u4ed8\uff0c\u4f8b\u5982\uff1a\u4fb5\u6743\u6cd5\u5417\uff1f<\/li>\n<li>\u5c3d\u7ba1\u6ca1\u6709\u8d2d\u4e70\u793e\u4f1a\u4fdd\u9669\uff0c\u5982\u8239\u5458\u5bb6\u5c5e\u4ece\u5176\u4ed6\u65b9\u6cd5\u5411\u8239\u4e1c\u53d6\u5f97\u8d54\u507f\u540e\uff0c\u534f\u4f1a\u662f\u5426\u4f1a\u5728\u5411\u8239\u4e1c\u7684\u8865\u507f\u4e2d\u6263\u9664\u4efb\u4f55\u5e94\u5728\u793e\u4f1a\u4fdd\u9669\u8ba1\u5212\u4e0b\u6240\u5f97\u5230\u7684\u91d1\u989d?<\/li>\n<\/ol>\n<p style=\"font-size: 12px; text-align: justify;\">\u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002<\/p>\n<p><span style=\"text-align: justify;\"><br \/><\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;ENG&nbsp; &nbsp;&nbsp;CHN&nbsp;&nbsp; Recently, we have conducted a research regarding the practice of the Clubs in handling crew death case under a specific situation as stated as below.
