text-align: justify;\"><strong>The following analysis, aimed to clarify certain issues related to bulk Cargo shortages claims in Morocco, has recently been received from the Club\u2019s correspondent in Casablanca.<\/strong><\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">Before 01.11.1992, (Hamburg Rules entry into force), Moroccan courts admitted the sea carrier\u2019s exoneration from any liability for shortages in bulk cargo not exceeding 2 % of the B\/L quantity.<\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">After 01.11.1992, the local courts were refusing this due to the Hamburg Rules do not provide such exoneration.<br \/>Resisting strongly to this position and after long judicial fight, we obtained:<\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">&#8211;&nbsp;In 2005, the re-admission of trade allowance in favour of the sea carrier by extension to the sea carriage of a provision applicable in road carriage, and<\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">&#8211; In 2007, the first judicial decision accepting the automatic deduction of the trade allowance admitted by local uses at discharge port which level must be ascertained by the courts.<\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">&#8211;&nbsp;Since 2010 the courts are ordering systematically court surveys to determine in each case if the shortages are or not within the level of the trade allowance.<\/p>\n<p style=\"font-size: 11.818181991577148px; outline: 0px; font-size: 12px; text-align: justify;\"><span style=\"font-size: 14pt; color: #022469;\"><strong>\u6563\u8d27\u77ed\u91cf\u7d22\u8d54\u6700\u65b0\u60c5\u51b5\u548c\u6982\u8ff0 &#8211; \u6469\u6d1b\u54e5<\/strong><\/span><\/p>\n<p style=\"font-size: 11.818181991577148px;\"><strong>\u8fd1\u671f\u4ece\u534f\u4f1a\u5728\u5361\u8428\u5e03\u5170\u5361\u7684\u901a\u8baf\u4ee3\u7406\u5904\u6536\u5230\u4ee5\u4e0b\u5206\u6790\u5185\u5bb9\uff0c\u8be5\u5206\u6790\u65e8\u5728\u5398\u6e05\u4e0e\u6469\u6d1b\u54e5\u6563\u8d27\u77ed\u91cf\u7d22\u8d54\u76f8\u5173\u7684\u82e5\u5e72\u95ee\u9898\u3002<\/strong><\/p>\n<p style=\"font-size: 11.818181991577148px;\">1992\u5e7411\u67081\u65e5 (\u300a\u6c49\u5821\u89c4\u5219\u300b\u751f\u6548\u65e5\u671f\u524d)\uff0c\u6469\u6d1b\u54e5\u6cd5\u9662\u8ba4\u53ef\u6d77\u8fd0\u627f\u8fd0\u4eba\u5bf9\u4e8e\u4e0d\u8d85\u8fc7\u63d0\u5355\u6570\u91cf2%\u7684\u6563\u8d27\u77ed\u91cf\u53ef\u514d\u8d23\u3002<\/p>\n<p style=\"font-size: 11.818181991577148px;\">\u4f461992\u5e7411\u67081\u65e5\u540e\uff0c\u5f53\u5730\u6cd5\u9662\u4ee5\u300a\u6c49\u5821\u89c4\u5219\u300b\u5e76\u672a\u89c4\u5b9a\u6b64\u7b49\u8c41\u514d\u4e3a\u7531\u62d2\u7edd\u4e88\u4ee5\u8ba4\u53ef\u3002<\/p>\n<p style=\"font-size: 11.818181991577148px;\">\u7ecf\u5f3a\u70c8\u6297\u8bae\u8be5\u7b49\u7acb\u573a\u548c\u957f\u671f\u53f8\u6cd5\u6597\u4e89\u540e\uff0c\u6211\u4eec\u83b7\u53d6\uff1a<\/p>\n<p style=\"font-size: 11.818181991577148px;\">&#8211; 2005\u5e74\uff0c\u901a\u8fc7\u5c06\u4e00\u6761\u516c\u8def\u8fd0\u8f93\u9002\u7528\u89c4\u5b9a\u5ef6\u5c55\u81f3\u6d77\u4e0a\u8fd0\u8f93\u4f7f\u5229\u4e8e\u6d77\u8fd0\u627f\u8fd0\u4eba\u7684\u8d38\u6613\u8865\u8d34\u5f97\u4ee5\u91cd\u65b0\u8ba4\u53ef\uff0c\u548c<br \/>&#8211; 2007\u5e74\uff0c\u7b2c\u4e00\u4e2a\u63a5\u53d7\u81ea\u52a8\u6263\u51cf\u5378\u8d27\u6e2f\u60ef\u4f8b\u5141\u8bb8\u7684\u8d38\u6613\u8865\u8d34\uff08\u6263\u51cf\u6c34\u5e73\u5fc5\u987b\u7531\u6cd5\u9662\u786e\u5b9a\uff09\u7684\u53f8\u6cd5\u5224\u51b3\u3002<br \/>&#8211; \u81ea2010\u5e74\u8d77\uff0c\u6cd5\u9662\u6709\u8ba1\u5212\u5730\u547d\u4ee4\u5f00\u5c55\u6cd5\u9662\u8c03\u67e5\u4ee5\u786e\u5b9a\u5404\u6848\u4e2d\u7684\u77ed\u91cf\u662f\u5426\u5728\u8d38\u6613\u8865\u8d34\u6c34\u5e73\u8303\u56f4\u5185\u3002<\/p>\n<p style=\"font-size: 11.818181991577148px;
