As a result, shipowners and charterers around the world currently face a number of problems such as who to pay and threat of arrest. We have received a number of similar enquiries relating to these issues. Our advice is to take a cautious approach and not make payment to any party without first consulting your Defence insurer or taking legal advice. This Alert is intended to provide some guidance to Members and clients,including:<\/p>\n<ul style=\"color: #000000; line-height: normal; text-align: justify;\">\n<li>When and to who should an owner\/charterer pay?<\/li>\n<li>Can the physical supplier of the bunkers arrest the vessel?<\/li>\n<li>Should owner load bunkers under charterer\u2019s orders known to have been supplied by OW?<\/li>\n<li>What preventive steps can be taken when an owner is on notice of a supply of bunkers ordered from OW by a time charterer?<\/li>\n<li>Does the bankruptcy include OW\u2019s subsidiaries\/offices worldwide?<\/li>\n<li>Bunker quality beware!<\/li>\n<\/ul>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">Please note these are general comments on some of the issues that could arise. For specific queries we recommend that owners\/charterers contact their Defence insurers and\/or seek legal advice.<\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">See attached file:&nbsp;<br \/>OW Bunker declared bankrupt.pdf<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">&nbsp;<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><span style=\"font-size: 14pt; color: #022469;\"><strong>Gard\u4fdd\u8d54\u534f\u4f1a\u5173\u4e8e\u4e39\u9ea6\u5b9d\u8fd0\u77f3\u6cb9\u5ba3\u544a\u7834\u4ea7\u7684\u76f8\u5173\u5efa\u8bae<\/strong><\/span><\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">\u4e39\u9ea6\u5b9d\u8fd0\u77f3\u6cb9\u516c\u53f8(\u4ee5\u4e0b\u7b80\u79f0 \u201cOW\u201d)\uff0c\u5360\u636e\u5168\u74037%\u7684\u6d77\u4e0a\u71c3\u6cb9\u4f9b\u5e94\u5e02\u573a\uff0c\u5374\u51e0\u4e4e\u5728\u4e00\u591c\u95f4\u5012\u95ed\uff0c\u4e8e2014\u5e7411\u67087\u65e5\u7533\u8bf7\u7834\u4ea7\u3002<\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">OW\u65b0\u52a0\u5761\u5b50\u516c\u53f8 Dynamic Oil Trading \u6d89\u5acc\u4e25\u91cd\u6b3a\u8bc8\u540e\uff0c\u603b\u90e8\u4f4d\u4e8e\u4e39\u9ea6\u7684OW\u8fc5\u901f\u5d29\u6e83\u3002\u5bfc\u81f4\u5168\u7403\u8239\u4e1c\u548c\u79df\u5bb6\u9762\u4e34\u8bf8\u591a\u95ee\u9898\uff0c\u4f8b\u5982\uff0c\u5411\u8c01\u652f\u4ed8\u6cb9\u6b3e\u4ee5\u53ca\u6263\u8239\u5a01\u80c1\u3002\u534f\u4f1a\u6536\u5230\u5927\u91cf\u7c7b\u4f3c\u95ee\u9898\u7684\u54a8\u8be2\uff0c\u6211\u4eec\u7684\u5efa\u8bae\u662f\uff0c\u8c28\u614e\u5904\u7406\uff0c\u5728\u5411\u60a8\u7684\u6297\u8fa9\u9669\u4fdd\u9669\u4eba\u54a8\u8be2\u6216\u5f97\u5230\u6cd5\u5f8b\u610f\u89c1\u4ee5\u524d\uff0c\u4e0d\u8981\u5411\u4efb\u4f55\u4e00\u65b9\u4ed8\u6b3e\u3002\u672c\u6587\u65e8\u5728\u5411\u4f1a\u5458\u548c\u5ba2\u6237\u63d0\u4f9b\u4e00\u4e9b\u6307\u5bfc\uff0c\u5305\u62ec:<\/p>\n<ul style=\"color: #000000; line-height: normal; text-align: justify;\">\n<li>\u8239\u4e1c\/\u79df\u5bb6\u5e94\u8be5\u5728\u4ec0\u4e48\u65f6\u5019\uff0c\u5411\u54ea\u4e00\u65b9\u652f\u4ed8\u6cb9\u6b3e\uff1f<\/li>\n<li>\u71c3\u6cb9\u5b9e\u9645\u4f9b\u5e94\u5546\u53ef\u4ee5\u6263\u8239\u5417\uff1f<\/li>\n<li>\u5982\u679c\u53d1\u73b0\u71c3\u6cb9\u7531OW\u63d0\u4f9b\uff0c\u8239\u4e1c\u8fd8\u5e94\u8be5\u6309\u79df\u5bb6\u6307\u4ee4\u52a0\u8f7d\u71c3\u6cb9\u5417\uff1f<\/li>\n<li>\u5982\u679c\u8239\u4e1c\u5f97\u77e5\uff0c\u671f\u79df\u79df\u5bb6\u4eceOW\u8ba2\u8d2d\u71c3\u6cb9\uff0c\u8239\u4e1c\u53ef\u4ee5\u91c7\u53d6\u54ea\u4e9b\u9632\u635f\u63aa\u65bd\uff1f<\/li>\n<li>\u7834\u4ea7\u6d89\u53caOW\u5728\u5168\u7403\u7684\u5b50\u516c\u53f8\/\u529e\u516c\u5ba4\u5417\uff1f<\/li>\n<li>\u6ce8\u610f\u71c3\u6cb9\u8d28\u91cf\uff01<\/li>\n<\/ul>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">\u8bf7\u6ce8\u610f\uff0c\u672c\u6587\u4ec5\u63d0\u4f9b\u53ef\u80fd\u53d1\u751f\u7684\u67d0\u4e9b\u95ee\u9898\u7684\u4e00\u822c\u5efa\u8bae\u3002\u5177\u4f53\u54a8\u8be2\uff0c\u5efa\u8bae\u8239\u4e1c\u548c\u79df\u5bb6\u8054\u7cfb\u5176\u6297\u8fa9\u9669\u4fdd\u9669\u4eba\uff0c\u6216\u5bfb\u6c42\u4e13\u4e1a\u6cd5\u5f8b\u5efa\u8bae\u3002<\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">\u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002<\/p>\n<p><span style=\"text-align: justify;\"><br \/><\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;ENG&nbsp; &nbsp;&nbsp;CHN OW Bunker (OW) with a reported 7% share of the marine fuel supply market went out of business almost overnight, filing for bankruptcy on 7 November 2014.
