On 14 April 2014 the Nairobi International Convention on the Removal of Wrecks, 2007 (\u201cthe Convention\u201d) achieved the requisite number of ratifications (10) triggering the entry into force conditions. The Convention will enter into force in State Parties on 14 April 2015.<\/p>\n

The Convention provides a strict liability, compensation and compulsory insurance regime for States affected by a maritime casualty. It makes the registered owner of a ship liable for locating, marking and removing a wreck deemed to be a hazard in a State\u2019s Convention area. Key definitions and terms employed in the Convention are explained at the end of this circular.<\/p>\n

Scope of the Convention<\/strong>
There is provision in article 3(2) for a State Party to include the territorial sea within the scope of the Convention. So far three States (Bulgaria, Denmark and the United Kingdom) have extended the scope of the Convention to their territorial sea.<\/p>\n

2014\u5e744\u670814\u65e5\u300a2007\u5e74\u5185\u7f57\u6bd5\u8239\u8236\u6b8b\u9ab8\u6e05\u9664\u516c\u7ea6\u300b\uff08\u4ee5\u4e0b\u7b80\u79f0\u201c\u300a\u516c\u7ea6\u300b\u201d\uff09\u8fbe\u523010\u4e2a\u56fd\u5bb6\u6279\u51c6\u7684\u751f\u6548\u6761\u4ef6\uff0c\u5c06\u4e8e2015\u5e744\u670814\u65e5\u5bf9\u7f14\u7ea6\u56fd\u751f\u6548\u3002<\/p>\n

\u5bf9\u4e8e\u7f14\u7ea6\u56fd\u53d1\u751f\u7684\u6d77\u4e0a\u4e8b\u6545\uff0c\u300a\u516c\u7ea6\u300b\u91c7\u53d6\u4e25\u683c\u8d54\u507f\u8d23\u4efb\u548c\u5f3a\u5236\u4fdd\u9669\u5236\u5ea6\uff0c\u89c4\u5b9a\u8239\u8236\u7684\u767b\u8bb0\u6240\u6709\u4eba\u6709\u4e49\u52a1\u5bf9\u516c\u7ea6\u533a\u57df\u5185\u88ab\u8ba4\u4e3a\u5177\u6709\u5371\u5bb3\u7684\u8239\u8236\u6b8b\u9ab8\u8fdb\u884c\u5b9a\u4f4d\u3001\u6807\u8bb0\u548c\u6e05\u9664\u3002<\/p>\n

\u516c\u7ea6\u533a\u57df<\/strong>
\u300a\u516c\u7ea6\u300b\u7b2c\u4e09\u6761\u7b2c\u4e8c\u6b3e\u89c4\u5b9a\uff0c\u7f14\u7ea6\u56fd\u53ef\u4ee5\u9009\u62e9\u6269\u5c55\u516c\u7ea6\u533a\u57df\u81f3\u5305\u62ec\u9886\u6d77\u5728\u5185\u7684\u9886\u571f\u3002\u76ee\u524d\u5df2\u6709\u4e09\u4e2a\u56fd\u5bb6(\u4fdd\u52a0\u5229\u4e9a\u3001\u4e39\u9ea6\u548c\u82f1\u56fd)\u5c06\u516c\u7ea6\u533a\u57df\u6269\u5c55\u81f3\u8be5\u56fd\u7684\u9886\u6d77\u3002<\/p>\n
