In a recent case Geden Operations Ltd v. Drybulk Handy Holdings Inc (Bulk Uruguay)<\/em> [2014] EWHC 855 (Comm), where the charterer appealed against the arbitration award on interesting points of law in context of termination of the charterparty by one of the contractual party.<\/p>\n

In this case Disponent Owner agreed a long-term time fixture with Charterers on an amended NYPE form (\u2018charterparty\u2019) for about 35 to 37 months. The charterparty incorporated a Conwartime 2004 clause and a BIMCO piracy clause. Bimco Piracy clause was amended to highlight that vessel could transit Gulf of Aden.<\/p>\n
