\u201cRes Cogitans\u201d\u6848\u662f\u4e39\u9ea6\u71c3\u6cb9\u4f9b\u8d27\u5546\u5b9d\u8fd0\u77f3\u6cb9\u516c\u53f8(OW Bunker)\u5ba3\u5e03\u7834\u4ea7\u540e\u7684\u9996\u4e2a\u76f8\u5173\u6848\u4f8b\u3002\u5b9d\u8fd0\u77f3\u6cb9\/\u8377\u5170\u56fd\u9645\u94f6\u884c\u5728\u6700\u521d\u7684\u4ef2\u88c1\u4e2d\u83b7\u80dc\u3002\u8239\u4e1c\u4e0d\u670d\u88c1\u51b3\u63d0\u8d77\u4e0a\u8bc9\uff0c\u4f46\u82f1\u56fd\u9ad8\u9662\u652f\u6301\u4ef2\u88c1\u5ead\u7684\u88c1\u51b3\u3002\u76ee\u524d\u672c\u6848\u6b63\u5728\u8fdb\u4e00\u6b65\u4e0a\u8bc9\u8fc7\u7a0b\u4e2d\u3002<\/p>\n

Updates on OW Bunkers\/ING issue<\/strong><\/span><\/p>\n

The first test case \u201cRes Cogitans\u201d was first arbitrated and the tribunal found in favour of OWB\/ING. Vessel owners appealed the award but the English High Court upheld the tribunal\u2019s findings. The case is now under appeal.<\/p>\n

The case involved the direct supply by an OWB subsidiary to the vessel owners just before the OW bankruptcy was announced. No payment was made by owners pending clarification of the party rightfully entitled to be paid for the bunker supply. OW Bunkers did not pay the physical supplier.<\/p>\n
