In a recent case tried before Zhejiang High People\u2019s Court, the Judge dismissed the defendants\u2019 challenge of jurisdiction holding that the choice of English High Court clause was invalid as Court found that there was lack of connection with the dispute in question.<\/p>\n

In this case, Company A (a ship bunker supply company in concluded a bunker oil sales agreement with Company B (a ship owner), and there was a clause in relation to the choice of court in this sales agreement. According to this choice of court clause, all the disputes should be referred to exclusive jurisdiction of English High Court for the stemmed bunker oil in Singapore. As Company B failed to pay sales price, therefore Company A sued the Company B before the Ningbo Maritime Court. Company B then argued as to the Court\u2019s jurisdiction as there was a separate choice of court clause agreed upon by both the parties in the agreement. Company A argued that this choice of court clause was invalid in the sales agreement because English High Court has no connection with the dispute.<\/p>\n

\u672c\u6848\u4e2d\uff0cA\u516c\u53f8(\u8239\u8236\u71c3\u6cb9\u4f9b\u5e94\u5546)\u4e0eB\u516c\u53f8(\u8239\u4e1c)\u7b7e\u8ba2\u4e86\u4e00\u4efd\u8239\u7528\u71c3\u6cb9\u4e70\u5356\u5408\u540c\uff0c\u5176\u4e2d\u7684\u7ba1\u8f96\u6743\u6761\u6b3e\u89c4\u5b9a\u8be5\u5408\u540c\u4e0b\u7684\u6240\u6709\u7531\u65b0\u52a0\u5761\u52a0\u6cb9\u5f15\u8d77\u7684\u4e89\u8bae\u5e94\u63d0\u4ea4\u82f1\u56fd\u9ad8\u7b49\u6cd5\u9662\u4e13\u5c5e\u7ba1\u8f96\u3002\u56e0B\u672a\u652f\u4ed8\u6cb9\u6b3e\uff0cA\u9042\u5728\u5b81\u6ce2\u6d77\u4e8b\u6cd5\u9662\u5c06B\u8d77\u8bc9\u3002B\u968f\u5373\u63d0\u51fa\u7ba1\u8f96\u6743\u5f02\u8bae\uff0c\u4e3b\u5f20\u5408\u540c\u7ea6\u5b9a\u4e86\u6709\u6548\u7684\u7ba1\u8f96\u6743\u6761\u6b3e\u3002A\u8fa9\u79f0\u8be5\u7ba1\u8f96\u6743\u6761\u6b3e\u662f\u65e0\u6548\u7684\uff0c\u56e0\u4e3a\u8be5\u4f26\u6566\u9ad8\u9662\u7f3a\u4e4f\u4e0e\u6848\u4ef6\u6240\u6d89\u4e89\u8bae\u7684\u5b9e\u9645\u8054\u7cfb\u3002<\/p>\n
