KI Holdings Co Ltd [2015] EWHC 1250 (Comm) \u4e2d\u8fdb\u4e00\u6b65\u89e3\u91ca\u4e86\u51cf\u635f\u7684\u6982\u5ff5\uff0c\u8be5\u539f\u5219\u4e5f\u9002\u7528\u4e8e\u822a\u8fd0\/\u6d77\u4e8b\u6848\u4f8b\u3002<\/p>\n

\u82f1\u56fd\u5546\u4e8b\u6cd5\u5ead\u5728\u672c\u6848\u4e2d\u786e\u8ba4\uff0c\u9996\u5148\uff0c\u8bc4\u4f30\u5408\u540c\u8fdd\u7ea6\u5bfc\u81f4\u7684\u635f\u5931\u65f6\uff0c\u5fc5\u987b\u6263\u9664<\/span>\u539f\u544a\u91c7\u53d6\u5408\u7406\u63aa\u65bd\u51cf\u5c11\u5176\u635f\u5931\uff0c\u800c\u83b7\u5f97\u7684\u6216\u5c06\u4f1a\u83b7\u5f97\u7684\u4efb\u4f55\u8d27\u5e01\u6536\u76ca\u3002\u5176\u6b21\uff0c\u8bc1\u660e\u8d27\u5e01\u6536\u76ca\u5b58\u5728\u4ee5\u53ca\u91d1\u989d\u7684\u4e3e\u8bc1\u8d23\u4efb\u5728\u6297\u8fa9\u65b9<\/span>\u3002<\/p>\n

Mitigation of Loss \/ Damage<\/strong><\/span><\/p>\n

In a recent non-shipping case of Thai Airways International Public Company Ltd v. KI Holdings Co Ltd [2015] EWHC 1250 (Comm), whose principles are equally valid for shipping\/maritime cases, a concept of mitigation was further explained by the English Court.<\/p>\n

The English Commercial Court in this case has confirmed that, when assessing damages for breach of contract, credit<\/span> must be given for any monetary benefit, whether chosen or not, which a claimant has received, or will receive, as a result of taking reasonable steps to mitigate its loss. The Court has also confirmed that the burden lies with a defendant<\/span> to prove that this monetary benefit exists, and the amount of such a benefit.<\/p>\n
