It was held that the performance by the Charterers was \u201cnot prevented\u201d by a force majeure event, but was \u201chindered or rendered more onerous\u201d and the charterers had the responsibility of nominating the loading berth.<\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">In this matter, the vessel was chartered for a voyage for the carriage of a cargo of sepiolite from \u201c1-2 load berth chop always afloat Santander\u201d to a port in the UK. The Charterers ordered the vessel to load at the sepiolite terminal berth, which was adjacent to a Ro-Ro berth at which cars were waiting to be loaded.<\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">See attached file: ALCO20150016 Force Majeure Clauses.pdf<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">&nbsp;<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><span style=\"font-size: 14pt; color: #022469;\"><strong>\u4e0d\u53ef\u6297\u529b\u6761\u6b3e<\/strong><\/span><\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">\u6700\u8fd1\u7684\u4e00\u5b97\u4f26\u6566\u4ef2\u88c1\u6848London Arbitration 3\/15, (2015) 918 LMLN 3\uff0c\u518d\u6b21\u8bc1\u660e\u4ef2\u88c1\u5458\u4f1a\u5bf9\u4e0d\u53ef\u6297\u529b\u6761\u6b3e\u505a\u72ed\u4e49\u89e3\u91ca\uff0c\u4f7f\u88c1\u51b3\u4e0d\u5229\u4e8e\u63d0\u51fa\u4e0d\u53ef\u6297\u529b\u7684\u4e00\u65b9\u3002\u4ef2\u88c1\u5ead\u8ba4\u4e3a\uff0c\u79df\u5bb6\u5e76\u201c\u6ca1\u6709\u201d\u56e0\u4e3a\u4e0d\u53ef\u6297\u529b\u4e8b\u4ef6\u800c\u201c\u53d7\u963b\u201d\uff0c\u53ea\u662f\u201c\u53d7\u5230\u59a8\u788d\u6216\u4f7f\u5f97\u66f4\u9ebb\u70e6\u201d\u3002\u800c\u4e14\uff0c\u79df\u5bb6\u6709\u4e49\u52a1\u6307\u5b9a\u88c5\u8d27\u6cca\u4f4d\u3002<\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">\u672c\u6848\u4e2d\uff0c\u79df\u5bb6\u4ee5\u822a\u6b21\u79df\u8239\u7684\u5f62\u5f0f\uff0c\u8fd0\u8f93\u6d77\u6ce1\u77f3\uff0c\u4ece\u201c\u6851\u5766\u5fb7\uff0c1-2\u4e2a\u6cca\u4f4d\uff0c\u59cb\u7ec8\u4fdd\u6301\u6f02\u6d6e\u72b6\u6001\u201d\u5230\u82f1\u56fd\u67d0\u6e2f\u53e3\u3002\u79df\u5bb6\u6307\u4ee4\u8239\u8236\u5728\u7801\u5934\u7684\u6d77\u6ce1\u77f3\u6cca\u4f4d\u88c5\u8d27\uff0c\u8be5\u6cca\u4f4d\u6bd7\u90bb\u4e00\u4e2a\u6eda\u88c5\u6cca\u4f4d\uff0c\u6eda\u88c5\u6cca\u4f4d\u4e0a\u6709\u5f88\u591a\u6c7d\u8f66\u5f85\u88c5\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002<\/p>\n<p><span style=\"text-align: justify;\"><br \/><\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;ENG&nbsp; &nbsp;&nbsp;CHN&nbsp;&nbsp; In a recent London Arbitration 3\/15, (2015) 918 LMLN 3, it was again proved that Force majeure Clauses are interpreted narrowly against the party relying on it.
