The question of law was whether the Owners\u2019 claim for demurrage was time barred for not submitting all the documents with their claim within 90 days as prescribed by the clause in the charter party.<\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">A vessel was chartered on an amended BPVOY4 form dated 15 June 2014. In this case, Owners brought a claim for demurrage in the amount of USD364, 847.78 by a formal letter dated 5 August 2011, which attached a number of documents such as invoice for demurrage, laytime calculation, NORs for two load port 4 Letters of Protest, pumping record for one of the discharge port, empty tank certificates and statement of facts for both the load and discharge port, but not e-mails regarding granting of free pratique that was relevant to running of laytime.<\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">See attached file: ALCO20150018 Time Bar for Demurrage Claims.pdf<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">&nbsp;<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><span style=\"font-size: 14pt; color: #022469;\"><strong>\u6ede\u671f\u8d39\u7d22\u8d54\u7684\u65f6\u6548\u95ee\u9898<\/strong><\/span><\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">KASSIOPI MARITIME CO LTD V FAL SHIPPING CO LTD (THE \u201cM\/T ADVENTURE\u201d) [2015] EWHC 318 (Comm)\u662f\u6700\u8fd1\u7684\u4e00\u4e2a\u6848\u4f8b\u30022015\u5e742\u670819\u65e5\uff0c\u8239\u4e1c\u6839\u636e\u300a1996\u5e74\u4ef2\u88c1\u6cd5\u300b\u7b2c69\u6761\u6709\u5173\u201c\u6cd5\u5f8b\u95ee\u9898\u4e0a\u8bc9\u201d\u7684\u89c4\u5b9a\uff0c\u5bf9\u8be5\u6848\u7684\u4ef2\u88c1\u88c1\u51b3\u63d0\u8d77\u4e0a\u8bc9\u3002\u4e0a\u8bc9\u6d89\u53ca\u7684\u6cd5\u5f8b\u95ee\u9898\u662f\uff0c\u5982\u679c\u8239\u4e1c\u6ca1\u6709\u6309\u7167\u79df\u7ea6\u6761\u6b3e\u7684\u89c4\u5b9a\u572890\u5929\u5185\u9012\u4ea4\u6240\u6709\u4e0e\u6848\u4ef6\u6709\u5173\u7684\u6587\u4ef6\uff0c\u6ede\u671f\u8d39\u7d22\u8d54\u662f\u5426\u4f1a\u8d85\u8fc7\u8bc9\u8bbc\u65f6\u6548\uff1f<\/p>\n<p style=\"font-size: 11.818181991577148px; text-align: justify;\">\u6d89\u6848\u8239\u8236\u4e8e2014\u5e746\u670815\u65e5\u7b7e\u8ba2\u79df\u7ea6\uff0c\u91c7\u7528\u7ecf\u4fee\u8ba2\u7684BPVOY4\u683c\u5f0f\u3002\u8239\u4e1c\u4e8e2011\u5e748\u67085\u65e5\u901a\u8fc7\u6b63\u5f0f\u4fe1\u51fd\u63d0\u51fa364,847.78\u7f8e\u5143\u7684\u6ede\u671f\u8d39\u7d22\u8d54\uff0c\u5e76\u968f\u9644\u591a\u4e2a\u6587\u4ef6\uff0c\u5982\uff0c\u6ede\u671f\u8d39\u53d1\u7968\uff0c\u88c5\u5378\u65f6\u95f4\u8ba1\u7b97\uff0c2\u4e2a\u6e2f\u53e3\u7684\u88c5\u5378\u51c6\u5907\u5c31\u7eea\u901a\u77e5\u4e66\uff0c4\u4efd\u6d77\u4e8b\u58f0\u660e\uff0c\u5176\u4e2d\u4e00\u4e2a\u5378\u8d27\u6e2f\u7684\u6c34\u6cf5\u6253\u538b\u8bb0\u5f55\uff0c\u7a7a\u8231\u8bc1\u4e66\u548c\u88c5\u5378\u65f6\u95f4\u4e8b\u5b9e\u8bb0\u5f55\u3002\u4f46\u662f\u6587\u4ef6\u4e2d\u7f3a\u5c11\u5173\u4e8e\u6388\u4e88\u8239\u8236\u5165\u5883\u536b\u751f\u68c0\u75ab\u8bc1\u4e66\u7684\u90ae\u4ef6\uff0c\u8fd9\u5173\u7cfb\u5230\u88c5\u5378\u65f6\u95f4\u7684\u8ba1\u7b97\u3002<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">\u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002<\/p>\n<p><span style=\"text-align: justify;\"><br \/><\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;ENG&nbsp; &nbsp;&nbsp;CHN&nbsp;&nbsp; There was a recent case of KASSIOPI MARITIME CO LTD V FAL SHIPPING CO LTD (THE \u201cM\/T ADVENTURE\u201d) [2015] EWHC 318 (Comm), 19 February 2015 on an appeal of an arbitration award on a question of law under section 69 of the Arbitration Act 1996.
