In a recent London Arbitration 16\/15, (2015) 938 LMLN3, the Claimant\u2019s vessel carrying a full cargo of bentonite (bulk cargo) was ordered by the Port Authority to discharge at a container terminal. Five days later after commencing discharge, the vessel was further ordered off the discharging berth by port authorities and proceeded to a standby berth, where she waited for three weeks. These actions of Port Authority resulted in a serious delay, with a bill for demurrage claim amounting to around half a million US dollars that the Owners of the vessel was claiming against the Charterers. The relevant Charterparty was GENCON 1976.<\/p>\n

\u5728\u6700\u8fd1\u7684\u4e00\u8d77\u4f26\u6566\u4ef2\u88c1 London Arbitration 16\/15, (2015) 938 LMLN3 \u6848\u4e2d\uff0c\u539f\u544a\u8239\u8236\u6ee1\u8f7d\u4e00\u79cd\u540d\u4e3a\u201c\u81a8\u6da6\u571f\u201d(bentonite) \u7684\u6563\u8d27\uff0c\u6e2f\u53e3\u5f53\u5c40\u8981\u6c42\u8be5\u8239\u5728\u96c6\u88c5\u7bb1\u6cca\u4f4d\u5378\u8d27\u3002\u5378\u8d27\u5f00\u59cb\u4e94\u5929\u540e\uff0c\u6e2f\u53e3\u5f53\u5c40\u6307\u4ee4\u8239\u8236\u9a76\u79bb\u8be5\u96c6\u88c5\u7bb1\u6cca\u4f4d\uff0c\u524d\u5f80\u4e00\u4e2a\u5907\u7528\u6cca\u4f4d\u7b49\u5f85\uff0c\u8239\u8236\u6700\u7ec8\u5728\u90a3\u91cc\u7b49\u5f85\u4e86\u957f\u8fbe\u4e09\u5468\u4e4b\u4e45\u3002\u7531\u4e8e\u6e2f\u53e3\u65b9\u9762\u7684\u4e0a\u8ff0\u884c\u4e3a\u5bfc\u81f4\u8239\u671f\u4e25\u91cd\u5ef6\u8bef\uff0c\u8239\u4e1c\u5411\u79df\u5bb6\u63d0\u8d77\u7ea6\u4e94\u5341\u4e07\u7f8e\u91d1\u7684\u6ede\u671f\u8d39\u7d22\u8d54\u3002\u672c\u6848\u79df\u7ea6\u91c7\u75281976\u5e74\u91d1\u5eb7\u683c\u5f0f\u79df\u8239\u5408\u540c\u3002<\/span><\/p>\n
