On 14 October 2016, a doubt that was existing in the mind of legal fraternity for over 92 years was cleared by the judgment in the case The Aqasia [2016] EWHC 2514 (Comm), whereby it was made clear that the package limitation in Article IV, r. 5 of Hague (Hague-Visby Rules) Rules does not apply to bulk carrier\u2019s freight unit. In this case, the judge concluded that the word \u2018unit\u2019 in this rule Hague (Hague Visby Rules) means a physical unit for shipment, and not a unit of measurement or what they in US the customary freight unit that is used as the basis of calculation of freight rate that is charged by the Carrier.<\/p>\n

2016\u5e7410\u670814\u65e5\uff0cThe Aqasia [2016] EWHC 2514 (Comm) \u6848\u7684\u5224\u51b3\uff0c\u6f84\u6e05\u4e86\u5728\u6cd5\u5f8b\u754c\u957f\u8fbe92\u5e74\u4e4b\u4e45\u7684\u4e00\u4e2a\u4e0d\u786e\u5b9a\u95ee\u9898\u3002\u300a\u6d77\u7259\u89c4\u5219\u300b(\u300a\u6d77\u7259-\u7ef4\u65af\u6bd4\u89c4\u5219\u300b)\u7b2c4\u6761\u7b2c5\u6b3e\u89c4\u5b9a\u7684\u6bcf\u5355\u4f4d\u8d54\u507f\u8d23\u4efb\u9650\u989d\u4e0d\u9002\u7528\u4e8e\u6563\u8d27\u8239\u7684\u8ba1\u8d39\u5355\u4f4d\u3002\u672c\u6848\u4e2d\uff0c\u6cd5\u5b98\u5224\u51b3\uff0c\u300a\u6d77\u7259\u89c4\u5219\u300b(\u300a\u6d77\u7259-\u7ef4\u65af\u6bd4\u89c4\u5219\u300b)\u4e2d\u7684\u201c\u6bcf\u4ef6\u201d\u4e00\u8bcd\u6307\u7684\u662f\u8fd0\u8f93\u7684\u5b9e\u7269\u4e2a\u4f53\uff0c\u4e0d\u662f\u8ba1\u7b97\u5355\u4f4d\uff0c\u4e5f\u4e0d\u662f\u7f8e\u56fd\u4e60\u60ef\u8ba1\u8d39\u5355\u4f4d\uff0c\u5373\u627f\u8fd0\u4eba\u7528\u4ee5\u6536\u53d6\u8fd0\u8d39\u7684\u4e00\u79cd\u8d39\u7387\u8ba1\u7b97\u57fa\u7840\u3002<\/span><\/p>\n
