The case of the \u201cOcean Victory\u201d has courted much publicity and interest and the various Maritime Law firms are now circulating their bulletins summarising the case. Rather than regurgitating and repeating we thought we would simply comment in Layman\u2019s terms.<\/p>\n

The \u201cOcean Victory\u201d was a Capesize dry bulk carrier that sank off the coast of Japan. The Ship was discharging cargo at Kashima, but then sailed from that port because it was decided that due to an unusual combination of adverse weather conditions it was too dangerous for her to stay at her berth. Unfortunately, whilst attempting to leave the port she ran aground and broke up. The estimate of the loss arising from this case is around US$170 million.<\/p>\n

\u201cOcean Victory\u201d\u8f6e\u6848\u5f15\u8d77\u4e86\u5e7f\u6cdb\u5173\u6ce8\u548c\u5174\u8da3\uff0c\u8bf8\u591a\u6d77\u4e8b\u5f8b\u6240\u53d1\u5e03\u52a0\u4ee5\u6574\u7406\u7684\u6848\u60c5\u7b80\u62a5\u3002\u672c\u6587\u4e0d\u518d\u91cd\u590d\uff0c\u5e76\u4f5c\u4ee5\u4e0b\u7b80\u5355\u8bc4\u8ff0\u3002<\/p>\n

\u201cOcean Victory\u201d\u8f6e\u662f\u597d\u671b\u89d2\u578b\u5e72\u6563\u8d27\u8239\uff0c\u5728\u65e5\u672c\u6cbf\u6d77\u6c89\u6ca1\u3002\u8239\u8236\u5728\u9e7f\u5c9b\u6e2f\u5378\u8d27\uff0c\u4e4b\u540e\u7531\u4e8e\u5f02\u5e38\u6076\u52a3\u5929\u6c14\u72b6\u51b5\u53e0\u52a0\uff0c\u8239\u8236\u505c\u7559\u5728\u6cca\u4f4d\u592a\u5371\u9669\uff0c\u800c\u51b3\u5b9a\u79bb\u5f00\u8be5\u6e2f\u53e3\u3002\u4e0d\u5e78\u7684\u662f\uff0c\u5f53\u5c1d\u8bd5\u9a76\u79bb\u6e2f\u53e3\u65f6\uff0c\u8239\u8236\u6401\u6d45\u4e14\u65ad\u88c2\u3002\u672c\u6848\u9884\u8ba1\u635f\u5931\u7ea61.7\u4ebf\u7f8e\u91d1\u3002<\/p>\n
