Maritime claims, including ship arrest claims, have unceasingly occurred in the much more competitive maritime industry. The first claim resulting in a ship arrest took place in early 1990\u2019at the request filed with the people\u2019s court of Da Nang city, Vietnam. Since that time, legislation covering ship arrest has increasingly developed. A ship can be arrested and detained until the claim is settled. The Vietnam Maritime Code 1990, as amended in 2005, the Ordinance on Ship Arrest 2008 and the Civil Procedure Code are the major sources of legislation governing ship arrest.<\/p>\n<p style=\"text-align: justify;\">To the best of our knowledge, Vietnam has not ratified any International Convention on ship arrest even though Vietnam has been encouraged to accede to International Convention on the Arrest of Ship Geneva, March 12 1999.<\/p>\n<p style=\"text-align: justify;\">See attached file: ALCO20190009 Ship Arrest in Vietnam.pdf<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\">&nbsp;<\/p>\n<p style=\"border: 0px; outline: 0px; font-size: 12px; text-align: justify;\"><span style=\"font-size: 14pt; color: #022469;\"><strong>\u56fd\u9645\u6263\u8239\u5b9e\u52a1 &#8211; \u8d8a\u5357<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">\u8d8a\u5357\u7684\u6d77\u5cb8\u7ebf\u6f2b\u957f\uff0c\u5176\u6d77\u8fd0\u4e1a\u5728\u52a0\u5f3a\u56fd\u5bb6\u7ecf\u6d4e\u6d3b\u52a8\u65b9\u9762\u53d1\u6325\u4e86\u81f3\u5173\u91cd\u8981\u7684\u4f5c\u7528\uff0c\u5c24\u5176\u662f\u57282007\u5e74\u8d8a\u5357\u52a0\u5165\u4e86\u4e16\u754c\u8d38\u6613\u7ec4\u7ec7\u3002\u6d77\u4e8b\u8bf7\u6c42\uff0c\u5305\u62ec\u8239\u8236\u6263\u62bc\u7d22\u8d54\uff0c\u5728\u6d77\u8fd0\u4e1a\u65e5\u76ca\u6fc0\u70c8\u7684\u7ade\u4e89\u4e2d\u4e0d\u65ad\u53d1\u751f\u3002\u5bfc\u81f4\u8239\u8236\u88ab\u6263\u62bc\u7684\u7b2c\u4e00\u9879\u7d22\u8d54\u662f\u57281990\u5e74\u521d\u6839\u636e\u5411\u8d8a\u5357\u5c98\u6e2f\u5e02\u4eba\u6c11\u6cd5\u9662\u63d0\u51fa\u7684\u8981\u6c42\u8fdb\u884c\u7684\u3002\u4ece\u90a3\u65f6\u8d77\uff0c\u5173\u4e8e\u8239\u8236\u6263\u62bc\u7684\u7acb\u6cd5\u65e5\u76ca\u53d1\u5c55\u6210\u719f\u3002\u5728\u7d22\u8d54\u5f97\u5230\u89e3\u51b3\u4e4b\u524d\uff0c\u8239\u8236\u662f\u53ef\u4ee5\u88ab\u6263\u62bc\u548c\u6ede\u7559\u7684\u30021990\u5e74\u4fee\u8ba2\u7684\u300a\u8d8a\u5357\u6d77\u4e8b\u6cd5\u300b\uff0c\u300a2008\u5e74\u8239\u8236\u6263\u62bc\u6761\u4f8b\u300b\u548c\u300a\u6c11\u4e8b\u8bc9\u8bbc\u6cd5\u300b\u662f\u6709\u5173\u8239\u8236\u6263\u62bc\u7684\u4e3b\u8981\u6cd5\u5f8b\u4f9d\u636e\u3002<\/p>\n<p style=\"text-align: justify;\">\u636e\u6211\u4eec\u6240\u77e5\uff0c\u8d8a\u5357\u5c1a\u672a\u8ba4\u53ef\u4efb\u4f55\u5173\u4e8e\u8239\u8236\u6263\u62bc\u7684\u56fd\u9645\u516c\u7ea6\uff0c\u5c3d\u7ba1\u8d8a\u5357\u5df2\u88ab\u9f13\u52b1\u52a0\u51651999\u5e743\u670812\u65e5\u300a\u65e5\u5185\u74e6\u56fd\u9645\u6263\u8239\u56fd\u9645\u516c\u7ea6\u300b\u3002<\/p>\n<p style=\"text-align: justify;\">\u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002<\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;ENG&nbsp;&nbsp;&nbsp;&nbsp;CHN&nbsp;&nbsp; Having a long coastline, Vietnam maritime industry has played a key role in enhancing the country\u2019s economic activities, especially when Vietnam acceded to the World Trade Organization in 2007.
