After the vessel arrived in China, she waited at the anchorage for 31 days due to congestion and lack of storage ashore. Upon discharge it was found that some of the cargo was damaged with mould and caking. Owners settled the cargo interests&#8217; claim for USD 1.1 million and then sought to recover those losses from charterers in arbitration, however, a preliminary point of law was referred to the Commercial Court.<\/span><\/p>\n<p style=\"font-size: 12px; text-align: justify;\"><span style=\"font-size: 8pt;\">See attached file: Claiming Damages In Addition to Demurrage Following Delay.pdf<\/span><\/p>\n<p style=\"font-size: 12px; text-align: justify;\">&nbsp;<\/p>\n<p><span style=\"font-size: 14pt; color: #003366;\"><strong>\u9664\u4e86\u5ef6\u8bef\u540e\u6ede\u671f\u4ee5\u5916\u7684\u5176\u4ed6\u635f\u5bb3\u8d54\u507f<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 8pt;\">\u82f1\u56fd\u5546\u4e1a\u6cd5\u5ead\u6700\u8fd1\u7684\u4e00\u9879\u5224\u51b3\u9610\u660e\uff0c\u8239\u4e1c\u5728\u9762\u5bf9\u7531\u4e8e\u79df\u5bb6\u7684\u5ef6\u8bef\uff0c\u5bfc\u81f4\u672a\u5728\u88c5\u5378\u65f6\u95f4\u5185\u5378\u8d27\u7684\u8d27\u7269\u88ab\u63d0\u8d77\u635f\u5bb3\u7d22\u8d54\u65f6\uff0c\u8239\u4e1c\u80fd\u5426\u5411\u79df\u5bb6\u8ffd\u507f\u8fd9\u4e9b\u635f\u5931\u3002<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 8pt;\">\u8be5\u6848\u540d\u4e3a\u201cThe Eternal Bliss [2020] EWHC 2373 (Comm)\u201d\uff0cBaker\u6cd5\u5b98\u8981\u9762\u5bf9\u7684\u4e89\u8bae\u6d89\u53ca\u4e00\u4efd\u822a\u6b21\u79df\u7ea6\uff0c\u79df\u7ea6\u4ee5\u5317\u7f8e\u8c37\u7269\u822a\u6b21\u79df\u8239\u6761\u6b3e\u8ba2\u7acb\uff0c\u5408\u540c\u7ea6\u5b9a70133\u516c\u5428\u7684\u5927\u8c46\u6309\u5728\u5df4\u897f\u88c5\u8d27\u5728\u4e2d\u56fd\u5378\u8d27\u3002\u8be5\u8f6e\u62b5\u8fbe\u4e2d\u56fd\u540e\uff0c\u7531\u4e8e\u6e2f\u53e3\u62e5\u6324\u548c\u5cb8\u4e0a\u4ed3\u50a8\u4e0d\u8db3\uff0c\u5728\u8be5\u951a\u5730\u505c\u6cca\u4e8631\u5929\u3002\u5378\u8d27\u65f6\uff0c\u53d1\u73b0\u90e8\u5206\u8d27\u7269\u6709\u9709\u83cc\u548c\u7ed3\u5757\u7684\u8d27\u635f\u3002\u8239\u4e1c\u5c31\u8d27\u635f\u5411\u8d27\u65b9\u8d54\u4ed8\u4e86110\u4e07\u7f8e\u5143\uff0c\u5e76\u4e4b\u540e\u60f3\u5728\u4ef2\u88c1\u4e2d\u5411\u79df\u5bb6\u8ffd\u507f\u8fd9\u4e9b\u635f\u5931\uff0c\u7136\u800c\uff0c\u521d\u6b65\u7684\u6cd5\u5f8b\u95ee\u9898\u88ab\u63d0\u4ea4\u7ed9\u4e86\u5546\u4e1a\u6cd5\u5ead\u3002<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 8pt;\">\u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;ENG&nbsp;&nbsp;&nbsp;&nbsp;CHN A recent judgement in the English Commercial Court has brought clarity to whether a shipowner, faced with a cargo damage claim, following delay by the charterer to discharge the vessel within laytime, can recover those losses from the charterer.
