{"id":14995,"date":"2021-04-08T02:35:00","date_gmt":"2021-04-08T02:35:00","guid":{"rendered":"http:\/\/192.168.1.14\/index.php\/2021\/04\/08\/2021-1-4-810\/"},"modified":"2025-08-29T12:53:27","modified_gmt":"2025-08-29T04:53:27","slug":"2021-1-4-810","status":"publish","type":"post","link":"https:\/\/andrewliu.com.hk\/zh\/2021-1-4-810\/","title":{"rendered":"Braganza\u8bc9BP\u8239\u5458\u5931\u8e2a\u6848\u5206\u6790"},"content":{"rendered":"<p><span style=\"font-size: 13.3333px; text-align: justify;\">&nbsp;<img decoding=\"async\" class=\"size-full wp-image-9071\" src=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2010\/06\/pdf.png\" alt=\"pdf\" width=\"16\" height=\"16\" style=\"font-size: 12.6316px;\" \/>&nbsp;<a href=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2021\/04\/ALCO20210005-JUDGMENT-Braganza-Appellant-v-BP-Shipping-Limited-and-another-Respondents.pdf\">ENG<\/a>&nbsp;&nbsp;&nbsp;<\/span><img decoding=\"async\" class=\"size-full wp-image-9071\" src=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2010\/06\/pdf.png\" alt=\"pdf\" width=\"16\" height=\"16\" style=\"font-size: 12.6316px; text-align: justify;\" \/><span style=\"font-size: 13.3333px;\">&nbsp;<\/span><a href=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2021\/01\/USCGIssueCyberRiskManagementGuidelines_CN.pdf\" style=\"font-size: 13.3333px;\">\u4e2d\u6587<\/a><\/p>\n<p>\u3010\u6458\u8981\u3011\u6d77\u4e0a\u822a\u884c\u662f\u4e00\u4e2a\u9ad8\u5371\u9669\u884c\u4e1a\uff0c\u8239\u5458\u5931\u8e2a\u65f6\u6709\u53d1\u751f\uff0c\u5f80\u5f80\u6ca1\u6709\u76f4\u63a5\u8bc1\u636e\u8868\u660e\u8239\u5458\u6b7b\u4ea1\u7684\u539f\u56e0\u662f\u81ea\u6740\u8fd8\u662f\u4e8b\u6545\u4f7f\u7136\u3002\u5728\u8fd9\u79cd\u60c5\u51b5\u4e0b\uff0c\u8c01\u8d1f\u6709\u4e3e\u8bc1\u8d23\u4efb\uff1f\u8239\u65b9\u627f\u62c5\u4fb5\u6743\u8d23\u4efb\u8fd8\u662f\u5408\u540c\u8d23\u4efb\uff1f\u5f80\u5f80\u662f\u8239\u4e1c\u3001\u8239\u8236\u7ba1\u7406\u516c\u53f8\u3001\u8239\u5458\u5916\u6d3e\u516c\u53f8\u3001\u8239\u4e1c\u4e92\u4fdd\u534f\u4f1a\u548c\u8239\u5458\u5bb6\u5c5e\u7b49\u6240\u5173\u5fc3\u7684\u6838\u5fc3\u95ee\u9898\u3002<\/p>\n<p>Braganza v BP Shipping Limited and another [2015] UKSC 17\u4e00\u6848\u5c31\u662f\u8fd9\u6837\u7684\u4e00\u4e2a\u5178\u578b\u6848\u4f8b\uff1a\u8f6e\u673a\u957fBraganza\u5148\u751f\u5728\u822a\u884c\u9014\u4e2d\u5931\u8e2a\uff0c\u5176\u9057\u5b40\u4e3b\u5f20\u662f\u8239\u4e1cBP\u516c\u53f8\u8fc7\u5931\u5bfc\u81f4\u7684\u4e8b\u6545\u81f4\u5176\u843d\u6d77\u6b7b\u4ea1\uff0c\u4f46\u662fBP\u8ba4\u4e3a\u662f\u81ea\u6740\uff0c\u4e0d\u627f\u62c5\u4fb5\u6743\u8d23\u4efb\u6216\u8005\u5408\u540c\u8d23\u4efb\u3002<\/p>\n<p>\u8fd9\u5b97\u6848\u4ef6\u4e0d\u4ec5\u662f\u6b64\u7c7b\u6848\u4ef6\u4e2d\u5c11\u6709\u8bc9\u8bbc\u5230\u82f1\u56fd\u9ad8\u7b49\u6cd5\u9662\u7684\u6848\u4ef6\uff0c\u66f4\u662f\u8fd1\u5e74\u6765\u552f\u4e00\u4e00\u4e2a\u7ecf\u8fc7\u4e86\u4e09\u5ba1\u8bc9\u8bbc\u5230\u82f1\u56fd\u6700\u9ad8\u6cd5\u9662\u7684\u6848\u4ef6\uff1b\u4e0d\u4ec5\u4e09\u7ea7\u6cd5\u9662\u5bf9\u6b64\u6848\u5224\u51b3\u7684\u89c2\u70b9\u4e0d\u540c\uff0c\u540c\u65f6\u82f1\u56fd\u6700\u9ad8\u6cd5\u9662\u7684\u9662\u957f\u548c\u526f\u9662\u957f\u90fd\u53c2\u4e0e\u4e86\u6848\u4ef6\u7684\u5ba1\u7406\uff0c\u5e76\u56e0\u6b64\u6848\u5efa\u7acb\u4e86\u201cBraganza Duty\u201d\u8fd9\u4e00\u6cd5\u5f8b\u8d4b\u4e88\u5408\u540c\u7684\u9ed8\u793a\u8d23\u4efb\uff1b\u4e0d\u4ec5\u5e94\u7528\u4e8e\u8239\u5458\u96c7\u4f63\u5408\u540c\uff0c\u540c\u65f6\u66f4\u5bf9\u5176\u4ed6\u5408\u540c\u4ea7\u751f\u4e86\u5e7f\u6cdb\u7684\u5f71\u54cd\u3002\u77ed\u77ed\u4e94\u5e74\u7684\u65f6\u95f4\uff0c\u5c31\u6709\u8fd1\u767e\u5b97\u6848\u4ef6\u5f15\u7528\u4e86\u8fd9\u4e00\u539f\u5219\uff0c\u56e0\u6b64\uff0c\u503c\u5f97\u5f15\u8d77\u5145\u5206\u7684\u6ce8\u610f\u3002<\/p>\n<p>\u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 14pt; color: #003366;\"><strong>JUDGMENT-Braganza (Appellant) v BP Shipping Limited and another (Respondents)<\/strong><\/span><\/p>\n<p>Between 01.00 and 07.00 on 11 May 2009, Mr Renford Braganza, Chief Engineer on BP\u2019s oil tanker the British Unity, then in the mid-North Atlantic, disappeared. No-one knows for certain what happened to him. But his employers formed the opinion that the most likely explanation for his disappearance was that he had committed suicide by throwing himself overboard. This would mean that his widow was not entitled to the death benefits provided for in his contract of employment. Clause 7.6.3 of that contract provided relevantly as follows:<\/p>\n<p>\u201cFor the avoidance of doubt compensation for death, accidental injury or illness shall not be payable if, in the opinion of the Company or its insurers, the death, accidental injury or illness resulted from amongst other things, the Officer\u2019s wilful act, default or misconduct whether at sea or ashore \u2026.\u201d (emphasis supplied)<\/p>\n<p>It is not the task of this or any other court determining a claim under such a contract to decide what actually happened to Mr Braganza. The task of the court is to decide whether his employer was entitled to form the opinion which it did. The issue of general principle in this appeal, therefore, is the test to be applied by the court in deciding that question.<\/p>\n<p>Please see attached file for details.<\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;ENG&nbsp;&nbsp;&nbsp;&nbsp;CHN \u3010\u6458\u8981\u3011\u6d77\u4e0a\u822a\u884c\u662f\u4e00\u4e2a\u9ad8\u5371\u9669\u884c\u4e1a\uff0c\u8239\u5458\u5931\u8e2a\u65f6\u6709\u53d1\u751f\uff0c\u5f80\u5f80\u6ca1\u6709\u76f4\u63a5\u8bc1\u636e\u8868\u660e\u8239\u5458\u6b7b\u4ea1\u7684\u539f\u56e0\u662f\u81ea\u6740\u8fd8\u662f\u4e8b\u6545\u4f7f\u7136\u3002\u5728\u8fd9\u79cd\u60c5\u51b5\u4e0b\uff0c\u8c01\u8d1f\u6709\u4e3e\u8bc1\u8d23\u4efb\uff1f\u8239\u65b9\u627f\u62c5\u4fb5\u6743\u8d23\u4efb\u8fd8\u662f\u5408\u540c\u8d23\u4efb\uff1f\u5f80\u5f80\u662f\u8239\u4e1c\u3001\u8239\u8236\u7ba1\u7406\u516c\u53f8\u3001\u8239\u5458\u5916\u6d3e\u516c\u53f8\u3001\u8239\u4e1c\u4e92\u4fdd\u534f\u4f1a\u548c\u8239\u5458\u5bb6\u5c5e\u7b49\u6240\u5173\u5fc3\u7684\u6838\u5fc3\u95ee\u9898\u3002 Braganza v BP Shipping Limited and another [2015] UKSC 17\u4e00\u6848\u5c31\u662f\u8fd9\u6837\u7684\u4e00\u4e2a\u5178\u578b\u6848\u4f8b\uff1a\u8f6e\u673a\u957fBraganza\u5148\u751f\u5728\u822a\u884c\u9014\u4e2d\u5931\u8e2a\uff0c\u5176\u9057\u5b40\u4e3b\u5f20\u662f\u8239\u4e1cBP\u516c\u53f8\u8fc7\u5931\u5bfc\u81f4\u7684\u4e8b\u6545\u81f4\u5176\u843d\u6d77\u6b7b\u4ea1\uff0c\u4f46\u662fBP\u8ba4\u4e3a\u662f\u81ea\u6740\uff0c\u4e0d\u627f\u62c5\u4fb5\u6743\u8d23\u4efb\u6216\u8005\u5408\u540c\u8d23\u4efb\u3002 \u8fd9\u5b97\u6848\u4ef6\u4e0d\u4ec5\u662f\u6b64\u7c7b\u6848\u4ef6\u4e2d\u5c11\u6709\u8bc9\u8bbc\u5230\u82f1\u56fd\u9ad8\u7b49\u6cd5\u9662\u7684\u6848\u4ef6\uff0c\u66f4\u662f\u8fd1\u5e74\u6765\u552f\u4e00\u4e00\u4e2a\u7ecf\u8fc7\u4e86\u4e09\u5ba1\u8bc9\u8bbc\u5230\u82f1\u56fd\u6700\u9ad8\u6cd5\u9662\u7684\u6848\u4ef6\uff1b\u4e0d\u4ec5\u4e09\u7ea7\u6cd5\u9662\u5bf9\u6b64\u6848\u5224\u51b3\u7684\u89c2\u70b9\u4e0d\u540c\uff0c\u540c\u65f6\u82f1\u56fd\u6700\u9ad8\u6cd5\u9662\u7684\u9662\u957f\u548c\u526f\u9662\u957f\u90fd\u53c2\u4e0e\u4e86\u6848\u4ef6\u7684\u5ba1\u7406\uff0c\u5e76\u56e0\u6b64\u6848\u5efa\u7acb\u4e86\u201cBraganza Duty\u201d\u8fd9\u4e00\u6cd5\u5f8b\u8d4b\u4e88\u5408\u540c\u7684\u9ed8\u793a\u8d23\u4efb\uff1b\u4e0d\u4ec5\u5e94\u7528\u4e8e\u8239\u5458\u96c7\u4f63\u5408\u540c\uff0c\u540c\u65f6\u66f4\u5bf9\u5176\u4ed6\u5408\u540c\u4ea7\u751f\u4e86\u5e7f\u6cdb\u7684\u5f71\u54cd\u3002\u77ed\u77ed\u4e94\u5e74\u7684\u65f6\u95f4\uff0c\u5c31\u6709\u8fd1\u767e\u5b97\u6848\u4ef6\u5f15\u7528\u4e86\u8fd9\u4e00\u539f\u5219\uff0c\u56e0\u6b64\uff0c\u503c\u5f97\u5f15\u8d77\u5145\u5206\u7684\u6ce8\u610f\u3002 \u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002 &nbsp; JUDGMENT-Braganza (Appellant) v BP Shipping Limited and another (Respondents) Between 01.00 and 07.00 on 11 May 2009, Mr Renford Braganza, Chief Engineer on BP\u2019s oil tanker the British Unity, then in the mid-North Atlantic, disappeared.
