On 10 August 2022 the European Union (EU) published updated FAQs clarifying the application of provisions relating to the carriage of certain cargoes from Russia, including coal and other solid fossil fuels as well as certain types of fertilizer. As this Circular sets out, these clarifications will have a significant impact on the carriage of these commodities by EU entities and the provision of insurance for carriage to any entity regardless of their domicile.<\/p>\n

\u2026<\/p>\n

The EU issued FAQs on 17 April and 14 June 2022 but these appeared to clarify only that EU entities were prohibited from purchasing Russian such cargoes intended for delivery both into and outside the EU but not otherwise being involved in their carriage.<\/p>\n

Further FAQs were issued on 10 August however \u2013 i.e. the date on which the wind-down period for coal and other solid fossil fuel cargoes expired \u2013 which cast significant doubt on the previous interpretation industry had placed on the wording of Articles 3i and 3j. The text of these latest FAQs can be found here. They appeared to suggest that the prohibitions in these Articles were in fact intended to have wider impact than just carriage into the EU and could impact of the carriage of such cargoes from Russia to any other country.<\/p>\n

The International Group (IG) consequently sought immediate clarification from the EU Commission regarding the meaning of these latest FAQs, the scope of the EU prohibitions and potential impacts on both Members and Clubs.<\/p>\n

The EU have made it clear to the IG that whilst the reference to \u201cimport\u201d in the Articles is indeed just limited to import into the EU, the other restrictions on direct or indirect transfers are intended to equally apply to non-EU destinations. It therefore now the case that the involvement of an EU entity in the carriage of Russian fertilisers and coal or other solid fossil fuels to any destination whatsoever and whether inside or outside the EU would be in breach of EU sanctions.<\/p>\n

Furthermore, the EU Commission has clarified to the IG that the prohibition on the provision of \u201cfinancial assistance\u201d in sections (2)(b) of both Article 3i and 3j and which includes insurance and reinsurance services prevents any entity subject to the jurisdiction of the EU from providing insurance and reinsurance for the carriage of Russian fertilisers and coal and other solid fossil fuel cargoes regardless of destination.<\/p>\n

Most of the Clubs that comprise the IG are subject to the jurisdiction of the EU. All IG Clubs, including those that are domiciled outside the territory of the EU, rely on a reinsurance programme that is heavily dependent on the participation of reinsurers that are domiciled within the EU. If any of the IG Clubs are prohibited under these sanctions from contributing their share of any Pool claim, the individual Member will bear the shortfall in accordance with their Club\u2019s sanctions rules. The same principle will apply for claims above US$100 million if any EU domiciled reinsurers on the IG reinsurance programme are prohibited under these sanctions from paying the claim.<\/p>\n

With no suggestion of the EU being willing to grant a further wind-down period to allow the consequences of these latest FAQs to be absorbed by industry, the impacts as set out above for Members involved in these trades have immediate effect. Any Members with questions are strongly encouraged to contact their Club.<\/p>\n

2022\u5e748\u670810\u65e5\uff0c\u6b27\u76df\uff08EU\uff09\u53d1\u5e03\u4e86\u66f4\u65b0\u7684\u5e38\u89c1\u7591\u95ee\u89e3\u7b54\uff08FAQs\uff09\uff0c\u6f84\u6e05\u4e86\u5236\u88c1\u6761\u4f8b\u5bf9\u4ece\u4fc4\u7f57\u65af\u8fd0\u8f93\u67d0\u4e9b\u8d27\u7269\u7684\u9002\u7528\u6027\uff0c\u5305\u62ec\u7164\u70ad\u548c\u5176\u4ed6\u56fa\u4f53\u5316\u77f3\u71c3\u6599\u4ee5\u53ca\u67d0\u4e9b\u7c7b\u578b\u7684\u5316\u80a5\u3002\u6b63\u5982\u672c\u901a\u51fd\u6240\u8ff0\uff0c\u8fd9\u4e9b\u6f84\u6e05\u5c06\u5bf9\u6b27\u76df\u5b9e\u4f53\u5c31\u4e0a\u8ff0\u8d27\u7269\u7684\u8fd0\u8f93\uff0c\u4ee5\u53ca\u5411\u4efb\u4f55\u5b9e\u4f53\uff08\u4e0d\u8bba\u4f4f\u6240\u5730\u662f\u5426\u5728\u6b27\u76df\uff09\u63d0\u4f9b\u8fd0\u8f93\u4fdd\u9669\u4ea7\u751f\u91cd\u5927\u5f71\u54cd\u3002<\/p>\n

\u6b27\u76df\u4e8e2022\u5e744\u670817\u65e5\u548c6\u670814\u65e5\u5206\u522b\u53d1\u5e03\u4e86\u5e38\u89c1\u7591\u95ee\u89e3\u7b54FAQs\uff0c\u4f46\u4f3c\u4e4e\u4ec5\u4ec5\u6f84\u6e05\u4e86\u6b27\u76df\u5b9e\u4f53\u88ab\u7981\u6b62\u8d2d\u4e70\u4fc4\u7f57\u65af\u76f8\u5173\u8d27\u7269\u4ee5\u4ea4\u4ed8\u81f3\u6b27\u76df\u5185\u5916\uff0c\u4f46\u4e0d\u6d89\u53ca\u5176\u4ed6\u65b9\u7684\u8fd0\u8f93\u3002<\/p>\n

\u7136\u800c\uff0c8\u670810\u65e5\u53d1\u5e03\u7684\u8fd9\u4efd\u8fdb\u4e00\u6b65\u7684\u5e38\u89c1\u7591\u95ee\u89e3\u7b54\u4e2d\uff0c\u4f8b\u5982\uff0c\u7164\u70ad\u548c\u5176\u4ed6\u56fa\u4f53\u5316\u77f3\u71c3\u6599\u8d27\u7269\u7684\u7f13\u51b2\u5668\u5df2\u7ecf\u5230\u671f\uff0c\u8fd9\u5bf9\u7b2cArticles 3i\u6761\u548c\u7b2cArticles 3j\u6761\u63aa\u8f9e\u7684\u5148\u524d\u89e3\u91ca\u4ea7\u751f\u4e86\u91cd\u5927\u7591\u95ee\u3002\u8fd9\u4e9b\u6700\u65b0\u5e38\u89c1\u95ee\u9898\u89e3\u7b54FAQs\u7684\u6587\u672c\u53ef\u5728\u6b64\u5904\u627e\u5230\u3002\u4ed6\u4eec\u4f3c\u4e4e\u8ba4\u4e3a\uff0c\u6761\u4f8b\u4e2d\u7684\u7981\u4ee4\u5b9e\u9645\u4e0a\u4ea7\u751f\u4e86\u66f4\u5e7f\u6cdb\u7684\u5f71\u54cd\uff0c\u4e0d\u4ec5\u4ec5\u662f\u5f71\u54cd\u5411\u6b27\u76df\u7684\u8fd0\u8f93\uff0c\u5e76\u53ef\u80fd\u5f71\u54cd\u4ece\u4fc4\u7f57\u65af\u5230\u4efb\u4f55\u5176\u4ed6\u56fd\u5bb6\u5c31\u7981\u4ee4\u8d27\u7269\u7684\u8fd0\u8f93\u3002<\/p>\n

\u56e0\u6b64\uff0c\u56fd\u9645\u4fdd\u8d54\u534f\u4f1a\u96c6\u56e2\uff08IG\uff09\u8981\u6c42\u6b27\u76df\u59d4\u5458\u4f1a\u7acb\u5373\u5c31\u6700\u65b0FAQs\u7684\u542b\u4e49\u3001\u6b27\u76df\u7981\u4ee4\u7684\u8303\u56f4\u4ee5\u53ca\u5bf9IG\u534f\u4f1a\u4ee5\u53ca\u4f1a\u5458\u7684\u6f5c\u5728\u5f71\u54cd\u4f5c\u51fa\u6f84\u6e05\u3002<\/p>\n

\u6b27\u76df\u5df2\u5411IG\u534f\u4f1a\u660e\u786e\u8868\u793a\uff0c\u5c3d\u7ba1\u6761\u4f8b\u4e2d\u63d0\u53ca\u7684\u201c\u8fdb\u53e3\u201d\u5b9e\u9645\u4e0a\u4ec5\u9650\u4e8e\u5411\u6b27\u76df\u8fdb\u53e3\uff0c\u4f46\u5bf9\u76f4\u63a5\u6216\u95f4\u63a5\u8f6c\u79fb\u7684\u5176\u4ed6\u9650\u5236\u540c\u6837\u9002\u7528\u4e8e\u975e\u6b27\u76df\u76ee\u7684\u5730\u3002\u56e0\u6b64\uff0c\u73b0\u5728\u7684\u60c5\u51b5\u662f\uff0c\u6b27\u76df\u5b9e\u4f53\u53c2\u4e0e\u5c06\u4fc4\u7f57\u65af\u5316\u80a5\u3001\u7164\u70ad\u6216\u5176\u4ed6\u56fa\u4f53\u5316\u77f3\u71c3\u6599\u8fd0\u8f93\u5230\u4efb\u4f55\u76ee\u7684\u5730\uff0c\u65e0\u8bba\u662f\u5728\u6b27\u76df\u5185\u8fd8\u662f\u6b27\u76df\u5916\uff0c\u90fd\u5c06\u8fdd\u53cd\u6b27\u76df\u5236\u88c1\u3002<\/p>\n

\u6b64\u5916\uff0c\u6b27\u76df\u59d4\u5458\u4f1a\u5df2\u5411IG\u534f\u4f1a\u6f84\u6e05\uff0c\u7b2cArticle 3i\u6761\u548c\u7b2cArticle 3j\u6761\u7b2c\uff082\uff09\uff08b\uff09\u70b9\u4e2d\u89c4\u5b9a\u7684\u7981\u6b62\u63d0\u4f9b\u201c\u91d1\u878d\u63f4\u52a9\u201d\uff0c\u5305\u62ec\u4e86\u4fdd\u9669\u548c\u518d\u4fdd\u9669\u670d\u52a1\uff0c\u8fd9\u5c31\u7981\u6b62\u4e86\u53d7\u6b27\u76df\u7ba1\u8f96\u7684\u4efb\u4f55\u5b9e\u4f53\u4e3a\u4fc4\u7f57\u65af\u5316\u80a5\u3001\u7164\u70ad\u548c\u5176\u4ed6\u56fa\u4f53\u5316\u77f3\u71c3\u6599\u8d27\u7269\u7684\u8fd0\u8f93\u63d0\u4f9b\u4fdd\u9669\u548c\u518d\u4fdd\u9669\uff0c\u4e0d\u8bba\u8d27\u7269\u8fd0\u8f93\u76ee\u7684\u5730\u3002<\/p>\n

IG\u534f\u4f1a\u7684\u5927\u591a\u6570\u6210\u5458\u90fd\u53d7\u6b27\u76df\u7ba1\u8f96\u3002\u6240\u6709IG\u534f\u4f1a\uff0c\u5305\u62ec\u4f4d\u4e8e\u6b27\u76df\u5883\u5916\u7684\u534f\u4f1a\uff0c\u90fd\u4f9d\u8d56\u4e8e\u518d\u4fdd\u9669\u65b9\u6848\uff0c\u4e5f\u5c31\u6781\u5927\u4f9d\u8d56\u4e8e\u4f4d\u4e8e\u6b27\u76df\u5883\u5185\u7684\u518d\u4fdd\u9669\u4eba\u7684\u53c2\u4e0e\u3002\u5982\u679c\u4efb\u4f55IG\u534f\u4f1a\u56e0\u4e3a\u8fd9\u4e9b\u5236\u88c1\u88ab\u7981\u6b62\u6309\u5176\u4efd\u989d\u5206\u644a\u5927\u989d\u7d22\u8d54\uff08Pool claim\uff09\uff0c\u5219\u4f1a\u5458\u5c06\u6839\u636e\u5176\u534f\u4f1a\u7684\u5236\u88c1\u89c4\u5219\u627f\u62c5\u5dee\u989d\u90e8\u5206\u3002\u5bf9\u4e8e1\u4ebf\u7f8e\u5143\u4ee5\u4e0a\u7684\u7d22\u8d54\uff0c\u5982\u679cIG\u518d\u4fdd\u9669\u65b9\u6848\u4e2d\u7684\u4efb\u4f55\u6b27\u76df\u7c4d\u518d\u4fdd\u9669\u4eba\u56e0\u4e3a\u4e0a\u8ff0\u5236\u88c1\u88ab\u7981\u6b62\u4f5c\u51fa\u8d54\u4ed8\uff0c\u5219\u8fd9\u4e00\u539f\u5219\u5c06\u540c\u6837\u9002\u7528\u3002<\/p>\n

\u5e76\u6ca1\u6709\u8ff9\u8c61\u8868\u660e\u6b27\u76df\u613f\u610f\u7ed9\u4e88\u8fdb\u4e00\u6b65\u7684\u7f13\u51b2\u671f\uff0c\u4ee5\u5141\u8bb8\u884c\u4e1a\u638c\u63a7\u8fd9\u4e9b\u6700\u65b0\u5e38\u89c1\u95ee\u9898\u7684\u540e\u679c\uff0c\u4e0a\u8ff0\u8fd9\u4e9b\u6f84\u6e05\u5bf9\u534f\u4f1a\u4f1a\u5458\u7684\u5f71\u54cd\u5df2\u7acb\u5373\u751f\u6548\u3002\u5f3a\u70c8\u5efa\u8bae\u4f1a\u5458\u6709\u4efb\u4f55\u95ee\u9898\u5e94\u8054\u7cfb\u5176\u534f\u4f1a\u3002<\/p>\n
