&nbsp;<img decoding=\"async\" class=\"size-full wp-image-9071\" src=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2010\/06\/pdf.png\" alt=\"pdf\" width=\"16\" height=\"16\" \/>&nbsp;<a style=\"line-height: 24px;\" href=\"https:\/\/andrewliu.com.hk\/wp-content\/uploads\/2012\/05\/B235_ALCO20120038-Rightship-approval-in-CP.pdf\" target=\"_blank\">ENG<\/a><\/p>\n<p style=\"text-align: justify;\">\u671f\u79df\u60c5\u51b5\u4e0b\uff0c\u5982\u679c\u5408\u7ea6\u4e2d\u6ca1\u6709RIGHTSHIP\u7684\u76f8\u5173\u89c4\u5b9a\uff0c\u8239\u4e1c\u662f\u5426\u6709\u4e49\u52a1\u786e\u4fdd\u8239\u8236\u62e5\u6709RIGHTSHIP?<\/p>\n<p style=\"text-align: justify;\">(RIGHTSHIP \u662f\u7531\u6fb3\u5927\u5229\u4e9a\u5927\u8d27\u4e3b\u548c\u6e2f\u53e3\u8054\u5408\u8fdb\u884c\u7684\u4e00\u9879\u68c0\u9a8c\uff0c\u5bf9\u4e8e\u9760\u6cca\u6fb3\u5927\u5229\u4e9a\u7684\u8239\u8236\uff0c\u5fc5\u987b\u901a\u8fc7\u8fd9\u4e2a\u68c0\u9a8c\uff0c\u5426\u5219\u8d27\u4e3b\u548c\u7801\u5934\u4e0d\u4f1a\u63a5\u53d7\u3002\u68c0\u9a8c\u4e3b\u8981\u8003\u5bdf\u7684\u662f\u8239\u8236\u7684\u603b\u4f53\u8239\u51b5\u548c\u6253\/\u6392\u538b\u8f7d\u6c34\u7684\u901f\u5ea6\uff0c\u901a\u8fc7\u4e86RIGHTSHIP\u68c0\u9a8c\u540c\u65f6\uff0c\u8239\u8236\u4f1a\u88ab\u6388\u4e88\u4e00\u4e2a\u661f\u7ea7\u8bc4\u5b9a\uff0c\u4e94\u661f\u6700\u9ad8\uff0c\u4e00\u661f\u6700\u4f4e\u3002)<\/p>\n<p style=\"text-align: justify;\">\u8fd9\u662f 2008 \u5e74 <span style=\"text-decoration: underline;\">Seagate Shipping Ltd v Glencore Intl AG (2008)<\/span> \u6848\u4ef6\u4e2d\u63d0\u51fa\u6765\u7684\u95ee\u9898\u3002<\/p>\n<p style=\"text-align: justify;\">\u5408\u7ea6\u4e2d\u5305\u542b\u4e00\u4e2a\u6807\u51c6\u6761\u6b3e\uff0c\u5373\u8239\u8236\u5fc5\u987b\u4fdd\u8bc1\u5728\u6574\u4e2a\u671f\u79df\u4e0b\uff0c\u6240\u6709\u8bc1\u4e66\u5fc5\u987b\u6ee1\u8db3\u6240\u6302\u9760\u6e2f\u53e3\u7684\u8981\u6c42\u3002\u5728\u9644\u52a0\u6761\u6b3e\u4e2d\u4e5f\u89c4\u5b9a\uff0c\u8239\u8236\u5fc5\u987b\u6301\u6709\u56fd\u9645\u8d38\u6613\u8fd0\u8f93\u6240\u5fc5\u987b\u7684\u6240\u6709\u8bc1\u4e66\u3002<\/p>\n<p style=\"text-align: justify;\">\u79df\u5bb6\u8ba4\u4e3a\uff0c\u65e2\u7136\u5408\u7ea6\u89c4\u5b9a\u8239\u8236\u5fc5\u987b\u6301\u6709\u56fd\u9645\u8d38\u6613\u8fd0\u8f93\u6240\u9700\u7684\u6240\u6709\u8bc1\u4e66\uff0c\u90a3\u4e48\u8239\u4e1c\u5c31\u6709\u4e49\u52a1\u53bb\u53d6\u5f97RIGHTSHIP\u3002\u800c\u4e14\u7ebd\u7ea6\u571f\u4ea7\u6807\u51c6\u5408\u540c\u7b2c8\u6761\u4e5f\u89c4\u5b9a\uff0c\u8239\u4e1c\u5fc5\u987b\u6309\u79df\u5bb6\u7684\u5c65\u7ea6\u8981\u6c42\u53bb\u505aRIGHTSHIP\u68c0\u9a8c\u3002<\/p>\n<p style=\"text-align: justify;\">\u4ef2\u88c1\u652f\u6301\u79df\u5bb6\uff0c\u4f46\u9ad8\u9662\u63a8\u7ffb\u4e86\u4ef2\u88c1\uff0c\u9ad8\u9662\u8ba4\u4e3a\u8239\u4e1c\u5fc5\u987b\u4fdd\u8bc1\u6240\u6709\u8bc1\u4e66\u6ee1\u8db3\u56fd\u9645\u8d38\u6613\u8fd0\u8f93\u8981\u6c42\u7684\u4e49\u52a1\u4ec5\u9650\u4e8e\u76d1\u7ba1\u7684\u548c\u653f\u5e9c\u7684\u8981\u6c42\u3002<\/p>\n<p style=\"text-align: justify;\">\u9ad8\u9662\u8ba4\u4e3a\uff0c\u8239\u4e1c\u4fdd\u8bc1\u6240\u6709\u8bc1\u4e66\u6ee1\u8db3\u56fd\u9645\u8d38\u6613\u8fd0\u8f93\u8981\u6c42\u7684\u4e49\u52a1\u4ec5\u9650\u4e8e\u76d1\u7ba1\u7684\u548c\u653f\u5e9c\u7684\u8981\u6c42\uff0c\u4f8b\u5982\u8239\u65d7\u56fd\u548c\u6302\u9760\u56fd\u5bb6\u7684\u6cd5\u5f8b\u548c\u89c4\u5b9a\uff0c\u8fd9\u4e0d\u5305\u62ec\u901a\u8fc7RIGHTSHIP\u68c0\u9a8c\u3002<\/p>\n<p style=\"text-align: justify;\">\u540c\u65f6\u9ad8\u9662\u8ba4\u4e3a\uff0c\u867d\u7136\u8239\u8236\u6ca1\u6709\u4e49\u52a1\u901a\u8fc7RIGHTSHIP\u68c0\u9a8c\uff0c\u4f46\u6309\u7167\u7ebd\u7ea6\u571f\u4ea7\u6807\u51c6\u5408\u540c\u7b2c8\u6761\u7684\u89c4\u5b9a\uff0c\u8239\u4e1c\u6709\u4e49\u52a1\u6309\u7167\u79df\u5bb6\u7684\u6307\u793a\uff0c\u540c\u610f\u8239\u8236\u7531RIGHTSHIP\u8fdb\u884c\u68c0\u9a8c\u3002<\/p>\n<p style=\"text-align: justify;\">\u4ee5\u4e0a\u7531 ANDREW LIU &amp; CO.,LTD \u7f16\u8bd1\uff0c\u5e94\u4ee5\u82f1\u6587\u4e3a\u51c6\uff01<\/p>\n<p style=\"text-align: justify;\">\u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 12pt; color: #022469;\"><strong>Rightship approval in CP<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">Are shipowners obliged under a time charterparty to ensure the vessel is Rightship approved even though there is no clause in the charterparty in this connection ?<\/p>\n<p style=\"text-align: justify;\">This was the subject of litigation in the case of <span style=\"text-decoration: underline;\">Seagate Shipping Ltd v Glencore Intl AG (2008)<\/span>.<\/p>\n<p style=\"text-align: justify;\">The charterparty contained a standard clause the vessel must be in a thorough effecient state &#8220;&#8230;with all certificates necessary to comply with current requirements of all ports of call&#8221; and there was also a rider clause the vessel had to have all certificates for international trading.<\/p>\n<p style=\"text-align: justify;\">Charterers submitted the owners were obliged to obtain Rightship approval as the charterparty provided the vessel must have all certificates for international trading, and further clause 8 NYPE obliging owners to follow charterer&#8217;s employment orders required the owners to permit Rightship inspection.<\/p>\n<p style=\"text-align: justify;\">The High Court reversed the arbitrator&#8217;s decision who awarded in favour of the charterers as they found that the owner&#8217;s obligation to have in possession all certificates for international trading was limited to regulatory and Governmental requirements.<\/p>\n<p style=\"text-align: justify;\">The High Court said the owners&#8217; obligation to have in possession all certificates for international trading was limited to regulatory and Governmental requirements such as the laws and requirements of Flag state and ports of call and did not include Rightship approval.<\/p>\n<p style=\"text-align: justify;\">The High Court also decided that even though the vessel was not obliged to obtain Rightship approval, the owners were however obliged to comply with the charterer&#8217;s instructions to permit the ship to be inspected by Rightship in accordance with clause 8 of NYPE.<\/p>\n<p style=\"text-align: justify;\">See attached file : ALCO20120038 Rightship approval in CP.pdf<\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;CHN&nbsp;
