justify;\">\u73b0\u4eca\u56fd\u9645\u4e0a\uff0c\u7f8e\u56fd\u3001\u6b27\u76df\u53ca\u8054\u5408\u56fd\u90fd\u5c31\u4f0a\u6717\u5236\u88c1\u95ee\u9898\u5b9e\u65bd\u5404\u81ea\u7684\u6cd5\u5f8b\u6cd5\u89c4\u3002\u539f\u6cb9\u63d0\u70bc\u662f\u4ed6\u4eec\u6700\u4e3a\u5173\u6ce8\u7684\u7126\u70b9\u95ee\u9898\u4e4b\u4e00\u3002\u672c\u6587\u65e8\u5728\u4ecb\u7ecd\u5236\u88c1\u4e2d\u6709\u5173\u539f\u6cb9\u3001\u77f3\u6cb9\u53ca\u76f8\u5173\u4ea7\u54c1\u8fd0\u8f93\u65b9\u9762\u7684\u6700\u65b0\u8fdb\u5c55\uff0c\u5e76\u5c1d\u8bd5\u8bf4\u660e\u8239\u4e1c\u6216\u79df\u5bb6\u5728\u8fdb\u884c\u4f0a\u6717\u76f8\u5173\u8fd0\u8f93\u65f6\uff0c\u5728\u4fdd\u8d54\u9669\u4e0b\u8f83\u5e38\u89c1\u7684\u7406\u8d54\u56f0\u96be\u548c\u5b9e\u52a1\u3002<\/p>\n<p style=\"text-align: justify;\"><strong>\u7f8e\u56fd<\/strong><br \/> \u7f8e\u56fd\u5b9e\u65bd\u7684\u5236\u88c1\u5236\u5ea6\u8f83\u4e3a\u7e41\u91cd\uff0c\u9002\u7528\u4e8e\u7f8e\u56fd\u516c\u6c11\u548c\u4f01\u4e1a\uff0c\u5e76\u901a\u8fc7 Comprehensive Iran Sanctions, Accountability and Divestment Act of 2010 \u6cd5\u6848\uff08\u4ee5\u4e0b\u7b80\u79f0CISADA\u6cd5\u6848\uff09\uff0c\u5c06\u5236\u88c1\u8303\u56f4\u6269\u5c55\u5230\u975e\u7f8e\u56fd\u6d77\u4e8b\u4fdd\u9669\u516c\u53f8\u53ca\u8239\u4e1c\u3002\u6839\u636eCISADA\u6cd5\u6848\u65bd\u52a0\u7684\u5236\u88c1\uff0c\u53ef\u80fd\u6784\u6210\u5bf9\u4f0a\u6717\u7684\u4e8c\u6b21\u5236\u88c1\u3002\u82e5\u4efb\u4f55\u4e00\u65b9\u5411\u4f0a\u6717\u63d0\u4f9b\u7cbe\u70bc\u77f3\u6cb9\u4ea7\u54c1(RPP)\uff0c\u4fc3\u8fdb\u4f0a\u6717\u5728\u7cbe\u70bc\u77f3\u6cb9\u4ea7\u54c1\u4e0a\u7684\u8fdb\u51fa\u53e3\u80fd\u529b\u53ca\u5bf9\u4f0a\u6717\u77f3\u6cb9\u8fdb\u884c\u6295\u8d44\uff0c\u5747\u53ef\u89e6\u53d1CISADA\u6cd5\u6848\u4e0b\u7684\u5f3a\u5236\u5236\u88c1\u3002\u7f8e\u56fd\u516c\u6c11\u4e0d\u80fd\u8fdb\u884c\u4f0a\u6717\u539f\u6cb9\u6216\u7cbe\u70bc\u77f3\u6cb9\u4ea7\u54c1\u7684\u8d38\u6613\uff0c\u4e5f\u4e0d\u80fd\u4e3a\u8be5\u79cd\u8d38\u6613\u63d0\u4f9b\u8d44\u91d1\u6216\u652f\u6301\u3002\u540c\u6837\u5730\uff0c\u7f8e\u56fd\u516c\u6c11\u4e0d\u80fd\u63d0\u4f9b\u6709\u5229\u4e8e\u4f0a\u6717\u539f\u6cb9\u4ea7\u4e1a\u7684\u670d\u52a1\uff0c\u5305\u62ec\u91d1\u878d\u670d\u52a1\u3001\u8d27\u7269\u4f9b\u5e94\u6216\u6280\u672f\u652f\u63f4\u7b49\u3002<\/p>\n<p style=\"text-align: justify;\"><strong>\u6b27\u76df<\/strong><br \/> \u6b27\u76df\u7b2c961\/2010\u53f7\u6761\u4f8b\u5df2\u88ab\u5e9f\u9664\uff0c\u5e76\u7531\u6b27\u76df\u7b2c267\/2012\u53f7\u6761\u4f8b\u6240\u53d6\u4ee3\u3002\u8be5\u65b0\u6761\u4f8b\u5bf9\u6d89\u53ca\u4f0a\u6717\u539f\u6cb9\u3001\u77f3\u6cb9\u4ea7\u54c1\u548c\u77f3\u5316\u4ea7\u54c1\u7684\u8fd0\u8f93\u3001\u4fdd\u9669\u53ca\u518d\u4fdd\u9669\u505a\u4e86\u65b0\u7684\u89c4\u5b9a\u3002\u6761\u4f8b\u9002\u7528\u4e8e\u539f\u4ea7\u4e8e\u4f0a\u6717\u7684\u8d27\u7269\uff0c\u5982\u679c\u5728\u4f0a\u6717\u5883\u5916\u8f6c\u8fd0\u4f0a\u6717\u539f\u6cb9\u4ecd\u4f1a\u53d7\u5230\u5236\u88c1\u7ea6\u675f\u3002\u5236\u88c1\u4e5f\u9002\u7528\u4e8e\u5168\u7403\u8303\u56f4\u7684\u8fd0\u8f93\uff0c\u5373\u8fd0\u8f93\u8303\u56f4\u5e76\u4e0d\u9650\u4e8e\u6b27\u76df\u3002\u6839\u636e\u6b27\u76df\u7b2c267\/2012\u53f7\u6761\u4f8b\u7b2c11-14\u6761\u7684\u89c4\u5b9a\uff0c\u9664\u67d0\u4e9b\u7279\u5b9a\u7684\u4f8b\u5916\u60c5\u6cc1\u4e4b\u5916\uff0c\u7531\u6b27\u76df\u516c\u53f8\u62e5\u6709\u6216\u7ecf\u8425\u7684\u8239\u8236\u53ca\u5176\u4e1a\u52a1\uff0c\u4ee5\u53ca\u5728\u6b27\u76df\u8303\u56f4\u5185\u4ece\u4e8b\u4ee5\u4e0a\u4e1a\u52a1\u7684\u975e\u6b27\u76df\u6210\u5458\u56fd\u7684\u4e00\u65b9\uff0c\u5c06\u4e0d\u80fd\u518d\u5411\u6b27\u76df\u8fdb\u53e3\u3001\u8d2d\u4e70\u6216\u8fd0\u8f93\u4f0a\u6717\u539f\u6cb9\u3001\u77f3\u6cb9\u4ea7\u54c1\u53ca\/\u6216\u77f3\u5316\u4ea7\u54c1\u3002<\/p>\n<p style=\"text-align: justify;\">\u8239\u4e1c\u53ca\u79df\u5bb6\u9700\u8981\u6ce8\u610f\u5982\u679c\u5728\u6761\u4f8b\u89c4\u5b9a\u7684\u7981\u6b62\u8fd0\u8f93\u539f\u6cb9\u3001\u77f3\u6cb9\u4ea7\u54c1\u6216\u77f3\u5316\u4ea7\u54c1\u7684\u65e5\u671f\u524d\u5df2\u7b7e\u8ba2\u5408\u540c\uff0c\u90a3\u4e48\u4f1a\u5458\u81f3\u5c11\u5728\u6267\u884c\u5408\u540c20\u65e5\u4ee5\u524d\u9700\u901a\u77e5\u516c\u53f8\u6210\u7acb\u5730\u7684\u6b27\u76df\u6210\u5458\u56fd\u4e3b\u7ba1\u5f53\u5c40\u3002<\/p>\n<p style=\"text-align: justify;\">\u53e6\u5916\uff0cThe Iran, North Korea, and Syria Nonproliferation Reform and Modernization Act of 2011 (HR 2105) \u6cd5\u6848\u8bd5\u56fe\u4fee\u6539the Ports and Waterways Safety Act (33 USC 1221 et seq.) \u6cd5\u6848\uff0c\u5e76\u63d0\u51fa\u8bae\u6848\u79f0\u5982\u679c\u8239\u53ea\u5728\u524d180\u65e5\u5185\u6302\u9760\u8fc7\u4f0a\u6717\u3001\u53d9\u5229\u4e9a\u6216\u671d\u9c9c\u6e2f\u53e3\uff0c\u5219\u7981\u6b62\u8239\u53ea\u6302\u9760\u7f8e\u56fd\u6e2f\u53e3\u3002<\/p>\n<p style=\"text-align: justify;\"><strong>\u8054\u5408\u56fd<\/strong><br \/> \u8054\u5408\u56fd\u4ea6\u5bf9\u4f0a\u6717\u5b9e\u65bd\u4e86\u4e00\u7cfb\u5217\u7684\u5236\u88c1\u51b3\u8bae\uff0c\u800c\u8054\u5408\u56fdSecurity Council regulation no. 1929 (2010) \u662f\u6700\u65b0\u6709\u5173\u4f0a\u6717\u6838\u4ea7\u4e1a\u7684\u7acb\u6cd5\u3002\u5728\u67d0\u79cd\u7a0b\u5ea6\u4e0a\uff0c\u7f8e\u56fd\u548c\u6b27\u76df\u65bd\u52a0\u7684\u5236\u88c1\u6bd4\u8054\u5408\u56fd\u66f4\u4e3a\u7e41\u91cd\uff0c\u56e0\u6b64\u5efa\u8bae\u4f1a\u5458\uff08\u53d7\u4fdd\u4eba\uff09\u786e\u4fdd\u81ea\u5df1\u9075\u5b88\u6b27\u76df\/\u7f8e\u56fd\u6700\u65b0\u5236\u88c1\u6761\u4f8b\u3002<\/p>\n<p style=\"text-align: justify;\"><strong>\u8239\u4e1c\/\u79df\u5bb6\u53ef\u80fd\u4f1a\u9047\u5230\u7684\u56f0\u96be<\/strong><br \/> \u5b9e\u9645\u4e0a\uff0cIG\u534f\u4f1a\u627f\u4fdd\u8239\u4e1c\u53ca\u79df\u5bb6\u4e0e\u4f0a\u6717\u7684\u5408\u6cd5\u8d38\u6613\u3002\u4f46\u662f\uff0c\u5728\u6240\u6709\u73b0\u5b58\u5236\u88c1\u5236\u5ea6\u4e0b\uff0c\u5bf9\u91d1\u878d\u673a\u6784\u65bd\u52a0\u5236\u88c1\u7684\u5a01\u80c1\uff0c\u5c06\u4f7f\u5f97\u53d1\u751f\u4fdd\u8d54\u9669\u7d22\u8d54\u540e\uff0c\u534f\u4f1a\u5f88\u96be\u5e2e\u52a9\u8239\u4e1c\u53ca\u79df\u5bb6\u5904\u7406\u8be5\u7d22\u8d54\u3002\u8239\u4e1c\u53ca\u79df\u5bb6\u4ea6\u5f97\u4e0d\u5230\u4ee5\u5f80\u5728\u534f\u4f1a\u6240\u80fd\u5f97\u5230\u7684\u534f\u52a9\uff0c\u5e76\u4e14\u53ef\u80fd\u4f1a\u5728\u81ea\u884c\u5904\u7406\u7d22\u8d54\u7684\u8fc7\u7a0b\u4e2d\u9047\u5230\u4e00\u5b9a\u7684\u56f0\u96be\u3002\u5176\u4e2d\u4e00\u4e2a\u663e\u800c\u6613\u89c1\u7684\u539f\u56e0\u662f\u8bb8\u591a\u5927\u7684\u56fd\u9645\u94f6\u884c\u62d2\u7edd\u4e0e\u4f0a\u6717\u8fdb\u884c\u8d38\u6613\u53ca\u7981\u6b62\u7f8e\u5143\u6d41\u5165\u4f0a\u6717\u3002<\/p>\n<p style=\"text-align: justify;\">\u4f1a\u5458\u5728\u8fdb\u884c\u4f0a\u6717\u76f8\u5173\u8fd0\u8f93\u65f6\u5f88\u53ef\u80fd\u9047\u5230\u4ee5\u4e0b\u56f0\u96be\uff1a<\/p>\n<ul style=\"text-align: justify;\">\n<li>\u65e0\u6cd5\u6536\u5230\u6765\u81ea\u4f0a\u6717\u7684\u8d44\u91d1(\u5982\u79df\u91d1\u3001\u8fd0\u8d39\u53ca\u8d27\u7269\u7684\u4ef7\u683c)<\/li>\n<li>\u65e0\u6cd5\u5411\u4f0a\u6717\u4ed8\u6b3e(\u5982\u4ee3\u7406\u8d39\u3001\u6d77\u5173\u8d39\u7528\u7b49)<\/li>\n<li>\u65e0\u8bba\u8fd0\u8f93\u662f\u5426\u5408\u6cd5\uff0c\u534f\u4f1a\u5c06\u5f88\u53ef\u80fd\u65e0\u6cd5\u5904\u7406\u6d89\u53ca\u4f0a\u6717\u7d22\u8d54\u4eba\u7684\u7d22\u8d54<\/li>\n<li>\u65e0\u8bba\u8fd0\u8f93\u662f\u5426\u5408\u6cd5\uff0c\u534f\u4f1a\u5c06\u4e0d\u80fd\u89e3\u51b3\u6d89\u53ca\u4f0a\u6717\u7d22\u8d54\u4eba\u7684\u7d22\u8d54\u6216\u5411\u4f0a\u6717\u7d22\u8d54\u4eba\u63d0\u4f9b\u62c5\u4fdd<\/li>\n<li>\u65e0\u8bba\u8fd0\u8f93\u662f\u5426\u5408\u6cd5\uff0c\u4f1a\u5458\u4e0d\u80fd\u89e3\u51b3\u6d89\u53ca\u4f0a\u6717\u7d22\u8d54\u4eba\u7684\u7d22\u8d54\uff0c\u5e76\u4e14\u8239\u8236\u53ef\u80fd\u4f1a\u88ab\u6263\u62bc\u4ee5\u89e3\u51b3\u8be5\u7d22\u8d54\u6848\u3002<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\u9274\u4e8e\u8fd9\u4e9b\u53ef\u9884\u89c1\u7684\u56f0\u96be\uff0c\u5728\u53ef\u80fd\u7684\u60c5\u51b5\u4e0b\uff0c\u5f88\u591a\u8239\u4e1c\u4f1a\u9009\u62e9\u4e0d\u4ece\u4e8b\u4e0e\u4f0a\u6717\u76f8\u5173\u7684\u8fd0\u8f93\uff0c\u4ee5\u907f\u514d\u89e6\u53ca\u5177\u6709\u5e7f\u6cdb\u5f71\u54cd\u529b\u7684\u5236\u88c1\u3002\u4ece\u8239\u4e1c\u7684\u7acb\u573a\u6765\u770b\uff0c\u53ef\u8003\u8651\u5728\u79df\u7ea6\u4e2d\u9644\u52a0\u5236\u88c1\u6761\u6b3e\uff0c\u5c06\u6f5c\u5728\u7684\u98ce\u9669\u548c\u8d23\u4efb\u8f6c\u79fb\u5230\u79df\u5bb6\u8eab\u4e0a\uff0c\u4ece\u800c\u4fdd\u62a4\u8239\u4e1c\u7684\u5229\u76ca\u3002\u800c\u4ece\u79df\u5bb6\u7684\u7acb\u573a\u6765\u770b\uff0c\u5728\u7b7e\u8ba2\u79df\u7ea6\u5408\u540c\u65f6\u5e94\u907f\u514d\u9644\u52a0\u4ee5\u4e0b\u6761\u6b3e\u6216\u5bf9\u4ee5\u4e0b\u6761\u6b3e\u4f5c\u76f8\u5e94\u7684\u4fee\u6539\u3002\u4ee5\u4e0b\u9644\u52a0\u6761\u6b3e\u4ec5\u4f9b\u53c2\u8003\u3002<\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p><span style=\"font-size: 12pt;\"><strong><span style=\"color: #022469;\">An update on Iran Sanctions and some difficulties with the P&amp;I cover with IG Clubs<\/span><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">Nowadays on an international level, 3 regimes coexist imposing their respective laws and regulations on the Iran sanctions, inter alia, the United States (US), the European Union (EU) and United Nations (UN). The refining of crude oil is one of the most concerned areas under these 3 regimes. This circular aims to give an introductory update on the sanctions with regard to the trading of the crude oil, petroleum and the related goods and enhance the awareness of those not uncommon difficulties shipowner\/charterers will expect to encounter in the course of conducting any trading with Iran arising out of or in connection with the sanctions regimes.<\/p>\n<p style=\"text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\">United States Sanctions (US)<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\"><\/strong>The US operates an onerous sanctions regime that applies to US nationals and companies and, through its Comprehensive Iran Sanctions, Accountability and Divestment Act of 2010 (CISADA), this has been extended to non-US marine insurers and ship owners. Sanctions that may be imposed under CISADA would constitute a secondary boycott of Iran. Supplying Iran with refined petroleum products (RPP), facilitating Iran&#8217;s ability to import and produce RPP and investing in Iran&#8217;s petroleum sector could trigger the imposition of sanctions under CISADA. US people may not trade in Iranian oil or petroleum products refined in Iran, and they may not finance or support such trading. Similarly, US people may not perform services, including financing services, or supply goods or technology that would benefit the Iranian oil industry.<\/p>\n<p style=\"text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\">European Union Sanctions (EU)<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\"><\/strong>The previous Council Regulation No. 961\/2010 has been revoked and replaced by Council Regulation No. 267\/2012. It introduces new provisions targeting the transportation, insurance and reinsurance of Iranian crude oil, petroleum products and petrochemicals. These provisions apply to cargoes originating in Iran, for example transshipment of Iranian crude outside Iran would still be subject to sanctions. Sanctions also apply for carriage on a worldwide basis i.e. carriage does not have to be to or from the EU. According to the Article 11-14 of Regulation 267\/2012, subject to certain limited exceptions, Vessels owned or operated by EU companies, businesses or non EU parties conducting such business from within the EU may no longer import into the EU, purchase or transport Iranian crude oil, petroleum products and \/ or petrochemicals.<\/p>\n<p style=\"text-align: justify;\">Shipowners\/charterers should be aware that if they are contracted to transport crude oil, petroleum products or petrochemicals, before such transport is prohibited by the Regulation, then they will be required to inform the competent authority of the EU Member state in which the company is established at least 20 days in advance of execution of the contract.<\/p>\n<p style=\"text-align: justify;\">The Iran, North Korea, and Syria Nonproliferation Reform and Modernization Act of 2011 (H.R. 2105), a bill which seeks to amend the Ports and Waterways Safety Act (33 U.S.C. 1221 et seq.), has proposed a ban on vessels from US ports if the vessel has called at a port in Iran, Syria or North Korea within the previous 180 days.<\/p>\n<p style=\"text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\">United Nations Sanctions (UN)<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\"><\/strong>The UN also operates a series of resolution in respect of sanctions on the trading with Iran, and UN Security Council regulation no. 1929 is the latest one concerning Iran&#8217;s nuclear industry. To some extents, EU and US impose more onerous sanctions than the UN and it is recommended that the Members are to ensure the compliance with EU\/US latest regulations on sanctions.<\/p>\n<p style=\"text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\">Difficulties shipowners\/charterers may encounter<\/strong><\/p>\n<p style=\"text-align: justify;\"><strong style=\"padding: 0px; border: 0px; outline: 0px;\"><\/strong>To all intents and purposes shipowners\/charterers engaged in legal trading to Iran are held covered, but the threat of sanctions imposed on financial institutions under all the existing sanctions regimes will make it very difficult for all the IG Clubs to assist with their Owners Members when a claim comes up. Shipowners\/Charterers will not have full access to the claims handling service from Clubs than they used to have. They may also encounter difficulties in dealing with claims on their side. One of the obvious reasons can be many large international banks refuse to trade with Iran and the ban on US dollars being transferred into Iran.<\/p>\n<p style=\"text-align: justify;\">There are some difficulties Members are very likely to encounter when trading in or to Iran:<\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\"><span style=\"line-height: 24px; color: #000000;\">Unable to receive funds originating in Iran (e.g. hire, freight and the price of the goods)<\/span><\/li>\n<li style=\"text-align: justify;\">Unable to pay money into Iran (in respect of agency fees, customs dues etc)<\/li>\n<li style=\"text-align: justify;\">Regardless of the legality of such trading, the IG Clubs will be likely unable to handle claims involving an Iranian claimant<\/li>\n<li style=\"text-align: justify;\">Regardless of the legality of such trading, the IG Clubs will not be able to settle claims involving an Iranian claimant or provide security to an Iranian claimant<\/li>\n<li style=\"text-align: justify;\">Regardless of the legality of such trading, the Members may find that it is unable to settle claims of an Iranian claimant and their vessels may therefore be arrested to settle the claim.<\/li>\n<\/ul>\n<p style=\"font-size: 12px; border: 0px; outline: 0px; text-align: justify;\">In view of these foreseeable difficulties, many Owners are choosing not to trade with Iran if possible and avoid the wide-reaching sanctions implications; in some occasions, the addition of a sanctions clause into any charterparties may however improve the Owners&#8217; position by shifting potential risks and liabilities on to the Charterers.
