It is not certain when weather conditions would improve and when the vessel would be able to complete loading. On account of no bunker facilities at the port of Uglegorsk, the vessel was dangerously running out of bunkers. The nearest port with bunker facilities was some distance away. The terms of the fixture or voyage charterparty state &#8220;Loading port: 1 SAP Uglegorsk&#8221;.<\/p>\n<p style=\"text-align: justify;\">It is well established when the charterers name the ports at the time when the fixture is made, then the owners are considered to have a sufficient opportunity to check themselves whether the ports will be safe and no warranty of safety will be implied, but where the charterparty leaves it to charterers to nominate load and discharge ports then the law will imply a safe port warranty. The question in our case is whether any effect should be given to the word &#8216;1 safe port&#8217; in a context where there is also a single named port. In the case of (The Achimidis)(2008) the fixture similarly was for loading at &#8216;1 safe port Ventspils&#8217; but this issue was not discussed as there was agreement by counsels for both sides that the words &#8216;1 safe port&#8217; amounts to the charterers giving a safe port warranty. We can therefore conclude that where a port is named but there is also an express warranty of safety as in our case, the result is the owners can rely on the charterers&#8217; undertaking.<\/p>\n<p style=\"text-align: justify;\">See attached file:ALCO20130001 Case Study &#8211; SAFE PORT.pdf<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: left;\"><span style=\"color: #022469;\"><strong><span style=\"font-size: 14pt;\">\u6848\u4f8b\u5b66\u4e60\uff1a\u5b89\u5168\u6e2f\u53e3<\/span><\/strong><\/span><\/p>\n<p>\u67d0\u8239\u5728\u4fc4\u7f57\u65afUglegorsk\u6e2f\u88c5\u8d27\uff0c\u7531\u4e8e\u51ac\u5b63\u6076\u52a3\u5929\u6c14\uff0c\u88c5\u8d27\u603b\u662f\u88ab\u4e2d\u65ad\uff0c\u8239\u5728\u88c5\u6e2f\u4e00\u4e2a\u6708\uff0c\u53ea\u88c5\u4e86\u4e00\u5343\u5428\u8d27\u7269\u3002\u5929\u6c14\u72b6\u51b5\u4ec0\u4e48\u65f6\u5019\u80fd\u597d\u8f6c\u4ee5\u53ca\u8239\u8236\u4ec0\u4e48\u65f6\u5019\u80fd\u5b8c\u8d27\u8fd8\u96be\u4ee5\u786e\u5b9a\u3002\u7531\u4e8eUglegorsk\u6e2f\u65e0\u6cd5\u52a0\u6cb9\uff0c\u8be5\u8239\u6709\u8017\u5c3d\u5b58\u6cb9\u7684\u5371\u9669\u3002\u80fd\u52a0\u6cb9\u7684\u6700\u8fd1\u6e2f\u53e3\u79bb\u8fd9\u6709\u4e00\u6bb5\u8ddd\u79bb\u3002\u79df\u8239\u5408\u540c\u89c4\u5b9a\uff1a\u201c\u88c5\u6e2f\uff1a\u4e00\u4e2a\u5b89\u5168\u6e2f\u53e3Uglegorsk\u201d\u3002<\/p>\n<p>\u901a\u5e38\u6211\u4eec\u8ba4\u4e3a\uff0c\u5982\u679c\u79df\u5bb6\u5728\u5408\u540c\u7b7e\u8ba2\u7684\u65f6\u5019\u5df2\u7ecf\u660e\u786e\u4e86\u6302\u9760\u6e2f\u53e3\uff0c\u8239\u4e1c\u5c31\u6709\u8db3\u591f\u7684\u673a\u4f1a\u53bb\u6838\u5b9e\u8fd9\u4e9b\u6e2f\u53e3\u662f\u5426\u5b89\u5168\uff0c\u90a3\u4e48\u5b89\u5168\u6e2f\u53e3\u5c31\u4e0d\u6210\u4e3a\u4e00\u4e2a\u9ed8\u793a\u4fdd\u8bc1\u3002\u4f46\u662f\u5982\u679c\u5408\u540c\u89c4\u5b9a\u8ba2\u7ea6\u540e\u79df\u5bb6\u6765\u6307\u5b9a\u88c5\u5378\u6e2f\uff0c\u90a3\u4e48\u5728\u6cd5\u5f8b\u4e0a\u5c31\u8ba4\u4e3a\uff0c\u5b89\u5168\u6e2f\u53e3\u662f\u4e00\u4e2a\u9ed8\u793a\u4fdd\u8bc1\u3002\u672c\u6848\u63d0\u51fa\u7684\u95ee\u9898\u662f\uff0c\u201c\u4e00\u4e2a\u5b89\u5168\u6e2f\u53e31SAFE PORT\u201d\u8fd9\u4e2a\u63aa\u8f9e\u9664\u4e86\u5217\u660e\u6e2f\u53e3\uff0c\u662f\u5426\u5bf9\u4e8e\u6848\u4ef6\u6709\u5176\u5b83\u5f71\u54cd\uff1f\u57282008\u5e74\u7684The Achimidis\u6848\u4f8b\u4e2d\uff0c\u79df\u7ea6\u4e2d\u4e5f\u6709\u7c7b\u4f3c\u7684\u201c\u4e00\u4e2a\u5b89\u5168\u6e2f\u53e31 safe port Ventspils\u201d\u7684\u89c4\u5b9a\uff0c\u4f46\u662f\u6b64\u6848\u672a\u5c31\u8be5\u95ee\u9898\u8fdb\u884c\u8ba8\u8bba\uff0c\u56e0\u4e3a\u53cc\u65b9\u5f8b\u5e08\u5c31\u201c\u4e00\u4e2a\u5b89\u5168\u6e2f\u53e3\u201d\u8fd9\u4e00\u63aa\u8f9e\u8fbe\u6210\u4e00\u81f4\uff0c\u5373\u79df\u5bb6\u4fdd\u8bc1\u6e2f\u53e3\u5b89\u5168\u3002<\/p>\n<p>\u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002<\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;ENG&nbsp;&nbsp; &nbsp;CHN A vessel was loading at port of Uglegorsk, Russia but due to the bad wintry weather conditions loading was intermittently stopped and after one month at load port, only 1,000 mt of cargo was loaded.
